I called the Court months ago and was told that the Judge was considering the Summons. Why the DOJ answered Dr. Sai BEFORE the Judge presented an Opinion on the Summons, is beyond me.
This is not a victory. When the Court reviews a motion to dismiss, the Court always proceeds from the assumption that all facts asserted by the Plaintiff (or Petitioner) are true. This does not mean they have been established as true - it simply means the Court is not engaging in fact-finding but merely assessing the legal claim. In this case, there was no legal claim which is why it was dismissed. I think the people of Hawaii are entitled to the human right of self-determination and I hope that right is vindicated someday, somehow.
