The plaintiff says he hired the defendant to make 25 T-shirts with his original artwork, but someone changed the drawing. He wants a refund. The defendant says the artwork was too complex and the designer tinkered with it. He says the plaintiff approved the new design, so he doesn’t owe anything.

Okay so I'm a professional graphic designer and this is exactly in my wheelhouse. 1. It's totally on the plaintiff whatever they approve on the proof but 2. what the defendant gave him wasn't what was on the proof lmaooo. It's a completely different illustration technique and honestly it's ugly. We'd have to fight in the parking lot.

It's nice to see people agree with me and know what they're talking about. Marilyn isn't acquainted with commercial cameras, graphics techniques, etc...The Plaintiff didn't get what he gave, plain and simple. The Defendant altered his art. Not acceptable.

Also graphic designers which makes me wonder how much experience their designer have, some printshop owners know minimal design and that’s why they hire us (graphic designers) I have 15 years of experience and 2 years in production my husband has 20 years experience in both and we both are cautious of every detail. A lot of printshop owners only have experience in one department lol so they do tend to oversee quality over quantity

I do city work, often relaying messages between differing agencies, and every phone call has decisions or input that is crucial. So after every phone call I give and receive emails that highlight the phone conversations. I'm surprised to see any business not doing that at this point, because it's so easy to do.

The defendant knew they couldn’t deliver and should have kept it a Buck with him. I have turned down work before because I knew I couldn’t achieve that particular look OR I knew it would be very tedious and I didn’t want to invest my time for that particular price.

That's too bad. My son is an artist, and he's done that specific thing where he'll have his artwork printed onto t-shirts and other products, and they came out looking awesome exactly like the drawing. No pixel problems. Not sure what process he used, but it was over the computer.

I agree with the plaintiff. That shirt job looks HORRIBLE. I’d want a refund too. I use to work somewhere where they screen print tees. This looks like a little kid took a pencil and stenciled it on the shirt. 🙄

That shirt is way too pixelated. I'm not an artist and even the average person could recognize that and that it clearly could have been done better based on average items on the market today. The judge is downplaying this and insulting that young man, anyone in their right mind would expect better. Fuck yeah he cancelled the show, it was mean to put his work on display and I don't see any artist embarrassing themselves with such shoddy work.

His original artwork had NO halftones used in it's rendering so the final product should not have looked as it did. The print shop fucked up, period!

It is not about a judge downplaying the art is about contracts law. The plaintiff needs to proof breach in the contract itself.

I have a small printshop, I never ever run anything without approval or the customer reading and signing my terms. Deposits are never returned once we start working on their projects thank goodness I have never gotten this problem because I have been vigilant about protecting my work and my business

I have done screen printing a lot and I can confirm that the defendant is lying. You can very easily get solid, defined lines with your first attempt. But, that is with silk screen printing though. I don't know if this guy goes the cheaper and much lower quality route.

I've done enlargements for over 35 years and yes, you will lose definition in a hand drawn photo. I don't know what medium he used whether it was pencil, a felt tipped pen, etc...There are a lot of factors that weren't mentioned in this case so I wouldn't go so far as to call the Defendant a liar. I think Rick that maybe you didn't hear the guy say it had to be enlarged from a small picture to the really large copy meant for the tee-shirt. Maybe I'm not clear about your statement but you didn't mention anything about enlarging a small hand drawn picture to a rather large piece to fit the T-shirt.

You are correct. The artwork can easily be vectorized, to allow for sharp, clear lines. The defendant didn't explain that option.

You don’t know what services the defendant offers. The plaintiff might have had a budget and the defendant was working within that budget.

You clean it up and explain how it’s done to the artist. I worked in the print industry and I’m an artist. Some printers just assume the artist will know what’s going on and don’t explain why things happened the way they do. It’s so annoying having been on one side and now on the other side…

There’s nothing wrong with the art itself . Take a digital picture of the velum then render that photo into a vector . Charge the client for vectoring. then print the shirts . Sounds like the printers are incapable. Simple sign making . Had they tried to cut that as a sticker it would be a zillion pieces

defendant's a scammer. you don't mess with someone's artwork. if it's not going to work on the tshirt, you still print it as the artist/customer says they want it, that way if it turns out sucky than it's on them. you change anything, you're not authroized to do it and you lose

I've NEVER heard of a shop using halftones for artwork that came in hand drawn with a pen, pencil or felt tipped pen. I would have sued the man and his shop also. Those shirts are horrible. Marilyn, you got this one wrong as far as not knowing about this process.

Halftoning is needed for screen printing. Otherwise the lines become to broad and it looks worse. I am not in this industry but I am in the art industry and I did take classes on print work. I just think the communication lacked.

And that’s exactly why we have the customer come in and look at the item the want printed on the shirts to be on the color shirts they want. It may take a little longer for us as the printer but the customer now have what it’s going to look like once it’s finalized. Just a mom and pops shop tho.

We send out mock up samples with disclaimers, I always let them know that if it’s low quality so will their shirts. I advice them on what to do and give them options. I never run anything approval and so far they understand. I sometimes zoom in the image and take a screenshot and send it to them I tell them this is how pixilated your image will look lol sometimes it’s not much but that clears up everything for them. Not everyone understands that a small resolution image cannot be expanded and look good people think we can do miracles which we can try when is possible. Time is money and unfortunately I can’t afford to spend a lot of time in a project so I won’t do a sample unless the customer requests an sample order. But that’s rare unless we have a peculiar client than yeah we will spend the time given.

You can do that but the best way is to put the drawing in procreate and draw over it and then send that over. Cuz the then lines will be darker and it's already digital. Then if he wants to color it open it back up in procreate and color it. It's best have artwork digital if you're putting it on shirts for dtg

I feel bad for the plaintiff. It's really discouraging for an artist when you're trying to make a name for yourself and someone tries to take advantage of you. I'm glad that he seems to be taking it in stride and learning from his mistakes.

When I was in high school, I did a work of art for my Latin Club. The work was placed on shirts, and it transferred perfectly. I do not understand why they made so many changes.

I'm a graphic designer... what you have to do with hand drawings is to "vectorize" the image. or you put it on a solid background like put a rectangle or circle behind the image... also depends on what procedure used to put it on the shirt. basically it's possible. seems to me their designer was just lazy or inexperienced.

The artist going on national tv did himself no service by showing he was inflexible. He had a tantrum and refused to go to the show which was self destructive. He said he collaborates with authors illustrating books. He’d be someone I’d hate to have to deal with because he won’t compromise and might have an “artistic difference fit” and walk off the project pffft

I was on the defendants side till I saw how crappy that print was. The defendant didn't change the design, they simply did not re-working the artwork in the correct format, which is so important to do the print correctly. At the very least this should've been noticed when they printed the vellum. That's why you need a high quality printing company not these quantity over quality guys. This should never have happened, if you need a great printing company "Shirt Smith" is the best. Yes I am bias since I'm promoting our families business.

This is my industry. To print shirts like that is negligent and opportunistic. They should have directed the artist to provide vector or quoted him to vectorise it. No vector, no job because you won’t like the result. Reimburse the man.

I would be appalled if my artwork came out looking like that in tee shirt form. ...But I also believe the Defendant when he said that the Plaintiff approved the work on a smart phone and didn't have the advantage of seeing how 'the whole complete picture' would turn out before approving it.

I’ve been screen printing since 1991. The defendant is either full of it or just doesn’t know what he is doing or his artist doesn’t know… or they just don’t care about putting out quality work. They should be embarrassed for charging so much for crap.

I'm a working designer/illustrator for 30 plus years. Plaintiff was using a pencil drawing, he should have redrawn it in ink. There's shadowy gray tones throughout that needed to be cleaned up before printing if he wanted crisp line art. The only reason the defendant would use a halftone screen (see images printed in a newspaper as an example) would be to capture some of those gray areas that would have otherwise dropped out with a clean contrasty scan. halftone is NOT pixelation. The defendant prob could have cleaned up the artwork but that's an extra charge in my book but...he should have provided a proof with the halftone already applied for approval. This didn't turn out well unfortunately, illustrator plaintiff has some things to learn about screen printing and the printing process in general.

To people sending in drawings to screen printers. If you don’t do it yourself ask if the in house art director can convert your work to a vector and ask the thread count of the screens they use. You can get a great amount of detail in screen printing but you will pay for it.

That's why we have art approvals signed and any problems should be worked out ahead of time, then another art approval is sent and repeated until both parties are on the same page. Some of the designs won't appear the same when compared to the printed version.

He should have just negotiated down the cost of the shirts and taken them to the show. His art wasn’t meant for t shirts anyway.

I don't understand why they couldn't have done a sample shirt of the finished product to get final approval. Originals often don't translate well to other media.

This is why I pulled back from doing shirts because my adhd causes me to be very meticulous and I would even go as far as to print one shirt of an order, get approval, make revisions if needed then proceed. It kept my customers coming but it can be tedious for a small shop owner. He could have gotten better vector markups elsewhere. I understand where the plaintiff is coming from but I wouldn’t have canceled my appearance.

Why is it on velum? Why not just print it on toilet paper ? It’s called a digital rendering file Adobe Illustrator “vector” “.ai” file. This artist needs to have things explained as to how shirt printing works. Bec he’s going to need to know for next time . I hope he does well . It’s good art

Regardless of what or who was in the wrong ...the artist certainly is way to picky and couldn't make lemonade 🍋 from Lemon's if his life depended on it...so what if it wasn't exactly what he was expecting,he should have just moved forward with all his plans . after all that's how lots of stuff has been invented over the centuries.😔
