Atty yun pong property na bnibili ko is tax dec. Single pa siya nun nabili nya and now married i think under absolute community of property dahil he is born in 1984. And the property he is selling was bought when about 2015 only. Bago p lang.nsa abroad na sila and hes on his way back to Philippines for signing our contract. Thanks for any advice.

Question po, please answer! I bought a property sa isang subdivision. I got married during the process of transferring the land title and I changed my surname and civil status dun sa BIR. Affected po ba yung processing ng transfer? Sabi kasi ng developer nasa BIR pa daw, 8 months ng nandoon. Ewan ko ba bakit andoon pa dn. Sa Deed of sale po gamit ko pa yung single name and single status ko.

Atty, the condo title was under single title holder then sold to me after married. The wife signed the Deed of Sale as witness. I assume this signifies marital consent? What other proof do I need that I have spouse's consent when we signed the DoS?

Hello atty! Question po, we executed the deed of sale (not yet noratized kasi not yet fully paid under pag-ibig pa) & deed of assumption of mortgage (notarized na) last June 2022. Single pa sya during this time & title is also single pa during execution of both deeds. Hndi ba kami mgka problema once ipa transfer na namin ang title since married na sya July 2022? Note: Lalaki po sya so no name change. Hoping for your response 🙏

you have to go to court and declare the compulsory heir as presumptively dead. otherwise, hindi mo yan pede ma adjudicate on your own. supposing ma declare na presumptively dead the court, you remember that ang maging heirs ng yumao mong kapatid ay mga kapatid nia or kung buhay pa parents nio, sila.

Ang understandind ko nian ay pag kahit verbal lang tapos isa sa kanila ay nagsimula gawin dahil sa verbal agreement, ito ay enforceable na as a contract. Meron din example yung verbal lang na rentahan, implied na month to month ang bayad ng rent or yearly kung buong taon binayaran.

malagay po ang name nia that you are married to him (foreigner) BUT it is yours exclusively. It is merely a description that you are married to him and the waiver was just a mere formality to let him understand that he cannot own real properties in the Philippines.

Actually mam that is misrepresentation. But if no one complains, you will not be in trouble. However, if you sell the property, the marital consent of the husband will still be needed

Poulla, if the seller is saying na single sia and the title says so, it is CORRECT to ask for a CENOMAR. That is a great due diligence tactic too. Usually I do that if I see that the title was issued under the name of the seller a long time ago - say 10 years ago - meaning, the chances of him/her getting married within 10 years or even 5 or 3 years, are high
