Lawyers for Southwest Airlines say they didn't fire a Christian employee because of her faith. It's because she was harassing her union president and creating a hostile work environment.
If the lawyers succeed, they also won't have to take eight hours of “religious-liberty training” from the right-wing hate group Alliance Defending Freedom or pay the former employee $800,000, as dictated by a Trump-appointed federal judge.

The press totally mischaracterized this case. They reported she was fired for posting anti-abortion messages on her personal FB, they never mentioned she was harassing her union president with combative nonsense. I'm sure other cabin crew loved working with her on those 3-4 day trips...

If the airline can't talk about the case because of the privacy of a former employee how would they know it was because of other actions? The only public info would be from whatever the employee said. The only place where it's possible to get additional info is in discovery or in court or in documents filed that are public... when that eventually happens.

@@katyungodly Well, that's because the founding fathers misspelled that part of the constitution. Should have been, "freedom from [someone else's] religion". That's what actually was meant by it, as many were fleeing europe to get away from having someone forcing their religion down their throats.

You do know that judges are elected and run on partisan ticket. So they run as either democrat or republican... It's built in and was made to be that way in order to disadvantage slaves and former slaves. The judicial system and the police as they exist today, were created by and for slave owners so that they could control and oppress black people. So the politicism is just part of it .

What did that judge hope to accomplish? Change the 3 lawyers' religious beliefs? Because I'm sure they went to the "trainings" without open minds (I'd be so pissed, I'd be completely closed off to what the "trainers" had to say). Or did he want to funnel $$$ to the "trainers?" Someone needs to examine the judge's ties to that organization.

At its minimum, the aim is to make the staff accept any christian belief as an acceptable viewpoint. At its worse, it's to enforce said christian beliefs on the staff.

For one thing if I were them I would have went with pro abortion leaflets stickers and passed them out in the seminar. The people would have made a mad dash to get me out of there as fast as possible . This judge needs to be fired and disbarred .

I remember from 2016 a Muslim flight attendant sued Express Jet because she was put on leave when she refused to serve alcohol for religious reasons. She lost on summary judgement in 2018. I wonder how the SW Airlines flight attendant's supporters would have supported the Muslim woman in that case.

I’m not sure what they expect. As a nurse in a hospital if I wear scrubs or shirt signifying where I work at and I act immorally or do something wrong or hurtful to somebody. It’s gonna come back on my job and it probably won’t look good on me. She’s just mad because she got in trouble.

Maybe someone can explain the psychology behind this. Why do so many Christians need to cosplay as early Christian martyrs? Those people may have been a bit obsessive, but they had guts. Whining when you lose your job for being a jerk at work in no way stacks up to bearing your throat to the lions.

The trump judge is required to uphold the constitution which has a separation of church and state. The judge should have his law license revoked permanently.

Religion has no place in a jury or court period. What do they not understand about the separation of church and state? I wish that religion would go away within my lifetime but it won't unfortunately although it has been improving in numbers with the latest generations being more skeptical of unproven religious claims.

@@katyungodly I believe it’s not that explicitly mentioned in the quran, that it’s just saying women AND men need to dress modestly. But because men are more capable of beating their wives into submission than the other way round, men get to decide how the rules are to be interpreted.

"May not discriminate' is poor phrasing anyway. "May" connotates permission, not requiring. So saying 'we may not discriminate' is tantamount to saying "we may, or may not discriminate..." I think the judge meant to have them say, "we shall not...." In my field, we are drilled on the differences between 'may' and 'shall' all the time. lol Frankly, I think Southwest's lawyers should make that argument as to why the original order was silly and 'should not' have been followed anyway.

Part of my job is writing corporate policy. "May" means optional, "may not" doesn't even exist. If I want something to always or never happen, I'm required to use "shall" or "shall not", respectively.

May, Shall, Will, and Must are given a strict and _distinct_ meaning in various fields, including law, politics, and technology. People who are in those fields are familiar with this usage, but I don't think the average person should be expected to know these esoteric meanings.

So the statement "we may not discriminate" is logically equivalent to "we aren't allowed to discriminate". The term "shall" is like "may" but includes intentionality. So the statement "we shall not discriminate" is logically equivalent to "we intend to avoid discriminating" (which I _hope_ is true for Southwest). However, I could forgive a layperson for hearing "we may not discriminate" as a probability statement (as you said: "may or may not..."). Similarly, I imagine a layperson would hear "we shall not discriminate" as a passionate, albeit irrelevant reference to the Bible. As much fun as it is for an unqualified amateur like myself to debate legalese on the internet, the point of my comment was that legalese SUCKS for something as important as communicating rights to the people who deserve to know they have them.

Appointments to the supreme court *MUST BE TAKEN OUT OF THE PRESIDENT'S HANDS* and placed exclusively in the hands of your Congress with a minimum 75% vote of all members across both parties determining who shall be appointed.

And in Australia being obnoxiously religious and/or obviously partisan will ensure you don’t get selected to the bench. Your legal background needs to be impeccable. The Australian judiciary has a habit of revolting against unwise appointments and forcing out bad apples, as happened in Queensland when then premier Campbell appointed an inexperienced magistrate who strayed into partisan politics as chief justice.

If you're going to start a scandals, of course anyone, not just companies, would want to cut all ties with you. This is not religious persecution, it's simply common sense, they can be suspected for colluding or enabling your behaviour thus ruining their reputation

I’d heard of people getting fired because they were atheists or had left the JW religion and worked for a JW boss. I’m Christian and I think that’s disgusting to financially abuse others like that

It does not matter, she represented SW Airlines, however, her actions may have destroyed the reputation of that airline, and in order to keep the brand that they are known for, they had to do what they had to do, and I agree with what SW has done

Judge Star NEEDS to take a course on religous freedom ACTUALLY means from an actually competent org!! That flight attendant clearly was creating a 'hostile work environment' and was a threat to EVERY single other southewest employees' ACTUAL 'religious freedom' was deservedly fired!

Gotta disagree there, it's connected to family and community. Such things are not a choice. Where you live (and who is around) dictates which religion you're in more than the choices you make. Plenty of people are also coerced into it, and that negates any choice.

I would love to see a thinking judge rule on this case. Southwest is correct, this is not religious persecution. Why it is not religious persecution is clearly explained in this video.

Also, fyi on the public school thing, there are very specific rules regarding political opinions in the workplace. During election years, administration has to remind everyone of what they can and cant' do or say. Also, as a side note, it's hard to be a teacher and have a public facebook page these days. In my wife's situation, she has closed her FB page a couple of times and started a new one, but each time, she gets inundated with classroom parents trying to friend her. She just doesn't want to be part of any of that classroom drama outside of class.

It’s weird how southwest singled her out for discrimination. Like of all the Christians they have working for them they were like “No, we cannot allow her to remain in our employment because of her Christian faith. The other ones we’ll get later, but SHE has to go now.”

I have to imagine the union president or some hr person went off on her and disparaged her religion or beliefs when disciplining her in order for a jury to find they discriminated. Otherwise im gobsmacked. Its like the opposite of jury nullification. Finding someone not guilty because you dont like the law. Now you just find someone guilty DESIPITE the law

Separation of Church and State? Our Country has NO Mandated Religion, and we are also free to choose none at all. Supposedly we are now not free to choose our Faith or lack thereof? If someone can't see the difference here between Religious Discrimination and enforcement of sane rules of employment they have an agenda IMO. This Judge's ruling and "punishment" is clearly unconstitutional and VERY appealable. Could this be a poisonous side effect of establishing you Corporate Headquarters in Texas?
