St. Johns hospital/Mercy St. Louis hates photographers and illegally detains them

Ok here is the story behind this elevator. This happened during my February 2011 Meetup in STL. This is actually on the day I was leaving to fly home to Roanoke. I stopped by St. Johns hospital on the way to the airport to meet with with a friend of mine who works at the hospital before I left town. he wanted to show me some of the elevators. Before this elevator, He showed me a service elevator and then what you see in this video is what sparked what happened. Apparantely one of the employees you hear in this elevator called security. KEEP IN MIND, I am being escorted around by an EMPLOYEE of the facility so I FIGURED I was ok to film.
About 10 minutes after filming this me and my friend who was showing me around were walking across the hospital and got on an elevator when a hand opened the door, the hand was one of a "public safety officer" asking me if I had been taking photos or video on the property.
I told him yes and apologized if it was a problem. He said that it definitely was a problem and I was "coming with him" (now 3-4 more guards show up and surround me) They ask for ID which i did not give them. I asked to say bye to my friend at this point they said No, you are being trespassed. They forcively escorted me out the front door and demanded I wait with them while the police were called. A female Creve Couer police officer showed up and asked the security what the problem was and they told them that they wanted me trespassed for using a camera in the building. (the ONLY reason I cooperated with these morons is because I did not want my friend to land in hot water) The cop asked me what i was photographing and I told her I was interested in the old elevators. She then asks security if they have any old elevators and they said they guessed they did. The cop then asked for my ID and ran it and of course it came back clean. Then the security asks for my ID which i did not want them to have and the cop gave it from them!!! I asked them what they wanted it for and they said they had to record my info so if I ever came back I would be prosecuted for criminal trespassing. They also asked me to delete my photos I took, I acted like I did but did not as you can clearly see :) The cop was quite friendly and just politely told me if I am taking photos on private property to ask permission, then she proceeded to ask me if I knew the date and where I was. After I answered those questions, I was told I was free to go. Security then boomed at me "if you are ever seen on this property and are not visiting a patient or receiving services, you will be arrested for criminal trespassing" I just walked to my rental car and then left.
At this point I was pretty pissed off. I called the hospital to complain. And guess who i was transfered to. None other than the head of security who said he remembered me lol. He told me I was lucky I did not go to jail cause I broke the law. I said what law did I break. he said "the 9/11 law!!" and I said what is that, there is no such thing! He said oh yeah there is! It makes it illegal to take photos in hospitals train stations, and airports!" he then said, "if I remember correctly you are flying home today! you better not film any elevators at the airport or you can end up in federal prison!" He also told me he looked at my website and saw alot of elevators. after some small talk he told me to call back in a month and he would see about lifting the trespassing order. I have since left several messages with security at the hospital and never had my calls returned. CLEARLY this security force is very uneducated about the laws governing photography. THE FIRST AMENDMENT!!! PHOTOGRAPHY IS NOT A CRIME!!! WHILE THE HOSPITAL HAS EVERY RIGHT to prohibit photography, THIS is NOT how you deal with photographers! Facebook: / dieselducy

it is completely legal to film an elevator at a hospital, as long as patients aren't getting in the shot, completely legal at a train station, and you can film ANYTHING in an airport you want except the inside of restrooms and the tsa x-ray monitors, you can even take a vid of the process of the screening and everything in a checkpoint, and what am i forgeting? oh yeah - THERE IS NO SUCH THING AS A 9/11 LAW!!!

ABSOLUTELY OUTRAGEOUS!!! This kind of situation shouldn't happen to anyone (except if you're in a restricted/clearly posted no filming area), especially someone like yourself who has gone through this before. If there is such thing as the 9/11 law, I don't know where security found out about it. IT IS NOT A CRIME TO FILM/TAKE PICTURES AT A PUBLIC PLACE!

Jesus Christ PHOTOGRAPHY IS NOT A CRIME!!!!! You have every right to take pictures in that facility, regradless of what management says, as STATED IN THE FIRST AMENDMENT OF THE CONSTITUTION!!!!!!

This is why I hate security guards. They sit around all day and take advantage of anything they can to do something. Cops, on the other hand, are usually much nicer, but of course there are bad ones in the bunch.

This is why I avoid hospitals. Not even for 9/11 reasons, but for the privacy of the patients in there. Unless I have permission, you won't see me filming in a hospital anytime soon. Same goes with airports and federal buildings. You aren't wrong, but you don't understand either. Spend a month or so in NYC and you will understand why people still act this way.

I did a google search on 9/11 law and I did not see anything about photography in airports, hospitals, or anywhere. You may want to search it and look at it yourself.

Yes, they do! :) Hospitals in my opinion are taking the HIPPA law too seriously, all it does is not allow patients to have their pictures taken or information recorded or released, etc. without their permission and says NOTHING about taking photographs or recording information about anything ELSE in the hospital but they still take it that way.

I looked up the “9/11 law” & couldn’t find anything about photography. I think that guy was either lying or was mistaken. Nonetheless, that guy seemed like a jerk.

I don't think you are getting my drift here. My point is regardless of what the rules and laws state, people's reactions are going to be out of anyone's hands. Unfortunately, this generation is going to be struck with paranoia against terrorism. Some cases are reasonable and justified, others are ludicrous. The Port Authority prohibits photography of NYC bridges, which is absolutely ridiculous. The MTA allows photography of all trains and subways as long as it is not beyond a public platform.

What we should be doing is building back up again, showing the world how strong we really are. We should not be staring at people with suspicious looks here and there. Take precautions! Photography should not even be an issue with terrorism. If a terrorist wanted to research something, he could see it in person or simply use Google like the rest of us have. Don't forget September 11, move on.

near me i did this. the hospital kept staff and customers away from my filming. next time ask security before filming. its just from those four. others might let you film.

Also, when I was filming an elevator at one of the office buildings in Downtown Arlington, Virginia, the security guy was sooooo mean, that it brought my mood down completely!!! He just demanded me to leave the premises or he'll call police. grrrr >:( Since then, I learned that I don't want to mess with the office buildings that have a front office desk in them because....who knows, a security guard might be in there watchin' ya...

The line between irrational and rational protection has been blurred. I'm not going to sit here and say terrorism is no more, because it is still out there and it still is a clear and present danger. However, the way American Society has been dealing with this terrorism is actually a bit sickening. People shouldn't be paranoid or scared, LETTING the terrorists win. Their goal was to interfere with American life, and well they've done a pretty good job so far.

Sometimes photography and/or video recordings can be a breach of privacy to others. If I were to film elevators, I would make sure the management is OK with video recordings and photography on selected applications like elevators. Some managements requires the photographer/video recorder to do some paper work because it only allows selected activities on filming and photography. Some managements doesn' t allow video recording and photography all together.

When I was filming elevators in 2 stores over the course of a few months, security came up to me and asked me why I was video recording. I told them that I am an elevator enthusiast and they said that I couldn't record in the store. On one of those times, they said it was just a rule....a dumb rule in my perspective lol. They were nice and calm towards me and I like it that way. :) As long they are nice to me, I'll respect them, leave the store, and just move on. :)

I know it would have caused more of a scene, but if you didn't show your ID to the police officer, what do you think would have happened? You aren't required to, since you did nothing against any law. They would need to state which law you broke before you would have to comply to their demands. Trespassing in a hospital open to the public isn't enough justification to detain you. You probably did the right thing though. You were with a friend, and wanted to keep trouble to a minimum.

Wow Security sounded like he was also making stuff up about photography like no filming airport elevators and train station elevators. Both train stations and airports are both places that would usually let you take pictures. Honestly I thought security was either poorly trained or over trained. Besides I can't even imagine being kicked out of A train station just for taking pictures of trains and elevators

I have never heard of the 9/11 law. That's why when I film an elevator and its an employee or security. I pretend I'm texting since my camera looks like a cell phone.

"9/11 Law". What's that? Obviously, he thinks you're dumb enough to believe that one. No such thing. HOWEVER, it is a risk to record on private property, and we assume that risk. At Clinton Hospital, I NEVER had issues there. They were very nice, and know they have rare elevators. Holy Family, on the other hand, are nothing but rude, and arrogant. At least they didn't call Security. We all know Saint Vincent in Worcester is a crap shoot. Usually can get away with it. Most are friendly about it.

Glad to see you had fun on the elevators. A Hospital is a private facility, therefore, they can legally refrain you from using photography. There are H.I.P.P.A concerns when in a hospital that they also have to consider. You film, it goes on your tube, they get sued because somebody did'nt want to be filmed while in the hospital for whatever reason. Use some common sense dude.

HIPPA concerns MEDICAL records, Not photography, It is not like I am running around the building taking photos/videos of people. I try my best to use courtesy in getting my videos as I have been for years. I have filmed in MANY hospitals without issue, Like you said, common sense, I make SURE i do not get patients on video. and you are RIGHT about PRIVATE property they CAN stop u from filming but they can NOT detain you as you are not breaking any laws.

@@DieselDucy I have a local hospital that has tons of no photo signs up in the rooms themselves, but the employees do not care if I film the elevator as I am not getting anyone else/private info on camera. In fact, they actually have let me ride some of the restricted elevators at their locations!

Some places like immigration area( between country borders) , I got escort because I film there and tell me some IC or passport and tell reason why I film there. Then, they tell me to delete and can go. They don't stick something and say 'No photo' or 'No video ' filming is legal.

Next time they try to pull that trick on you ask to see a copy of said law and if they cannot produce it tell them they cannot not hold you with out due evidence

That doesn't matter... a housekeeper for example cant give you permission to be there unless you have a legitimate reason to be and you don't...private property is private property and they can ask you to leave or not to film at any time...simple law

Sorry folks. Your antiquated laws concerning privacy and photography need some serious looking at. As well as gun ownership. Fact is technology has made information easier than ever for private citizens to publicize and obtain. You cannot fight this fact. So adapt, and don't be evil about it. Knowledge brings power. Some don't like this. However society will be improved if government can get over their petty jealousies about private citizens becoming stronger at defending themselves, and gathering information to make smarter decisions.

Actually HIPPA is not just files and records! If you would have accidentally got a patient on your goofy video then yes that is illegal and the patient and the hospital can sue you at that point. When they are receiving service from a private facility such as Mercy that means everything is private including being photographed or video recorded. Maybe you should look a little further into it before you run around doing stupid stuff like this.
