My husband and I are 56 years apart, we both draw social security and SSI I get 15 dollars in food stamps, and we live in a small 25 foot camper . Yearly income on both sides is 28,000 and I'm 22 he's 76 we got married when we were both homeless and we been together for 5 years and 6 months. Not every body who is married or with a older person is a gold digger. I'm not saying there is none out there but really it's a sterotype. We both pay bills together and we are trying to get back on our feet. And we been homeless several times we were lucky for a friend to help us with a camper .

No, the majority of relationships do NOT have a 50 year age gap. Plenty of minimum wage earners are married, just look around. The 24 year old's after one thing and one thing only. pamperedgurl there was a will and there also was a trust. Problem is the parents weren't all clear about their desires and those desires weren't properly expressed to the children. I would guess the trust was created for the children and in it was put everything that the children had coming to them. The husband probably was the sole owner of the property and that's why it was only in his name. Had it been a joint asset it would have been listed in both names.

Marriage supersedes wills , so they should be fine

My Dad did that for me for the most part. He was so sweet, he saw that I needed a car and at the time, I was heavily in debt trying to get out so he purchased me a car as a surprise for my birthday and he took care of all servicing and repairs needed along the way. He called it a "living will". After I had that car for 5 years +, he surprised me again with a new car 😅. Unfortnately this newer car has had more repairs to do than my previous car which barely needed any repairs at all. But I'm so grateful to my Dad for all he's done for me and my Mom 😁. He mentioned leaving me some money as well when he died but didn't mention how much. I can understand where this caller is coming from because she's thinking that this outsider (the wife) is going to just collect what her mother was supposed to leave for the children. I used to feel that way about my stepmother as well. Because my parents built certain things together when they were married and if he dies before her, she, her daughter and grandson are going to benefit from it. I also nag him to update his will because if he doesn't then whatever money he was planning to leave for me, she may take it all.

That's what I've been doing w/my kids and grandkids.

My parents were quite open about who was being included in their will. I personally never brought the subject up as I didn't think it was my right to do so. Wills can be changed at any point so I think if you do get anything it should be treated as a bonus in life not a right and you won't be disappointed.

Yes, kids always should come first, not a new "spouse", particularly not one that could be the grandchild of the other "spouse". This scenario happens to so many people. So sad. However, one can make special arrangements via trusts, etc. No late-coming outsider should ever be able to put his/her hands on something that should go to the kids.

Monica Haehl why does that matter? I’m currently not married to my children’s father and everything in the trust goes to my current husband unless we both die, then the kids. Most of what we have accumulated has been together with my kids “step dad” (even though they were older when we married so he didn’t raise them)

Not necessarily. Some states (or maybe all states) have a couple of ways to own property. If you’re on title as tenants in common then it’s like a 50-50 split (if you’re a couple) and can be broken down even smaller if there are more investors. If they took title in joint tenancy, then there is a right of survivorship and the living partner or partners are entitled to the deceased persons interests automatically. You can Google these terms for more clarity on how they work.

Texas is a fuckdd up state, when it comes to wills. In almost ALL states, the surviving spouse inherits everything (which is a joke because it was there's to begin with). My family is from Texas and my grandma was so afraid that my grandpa would die and her drug addicts sons would try to take everything she owned. She spent a shitlload of money for attorneys to ensure their will was written PERFECTLY so if she died or her husband, that their children wouldn't leave them homeless. Only in Texas can a couple buy a home, husband works while the wife cares for the children. Wife ends up dying and the children go to their father and say "We want half of everything you own because its ours." And Texas will give it to them if a proper will is not in place. Its so jacked. His money. His wife is gone. If this dude wants to spend every penny on hookers, that's his prerogative. Only in America do people truly believe they are entitled to money they didn't earn. 😒

It is entirely proper that the children inherit their parent's estate unless specifically disinherited in a will/trust. In the case presented here, the Mom with 3 children marries a man. For 30 years they grow their assets. Mom dies. Children collect what Mom has just as if Mom and step-Dad were getting a divorce. It is so much simpler when the children are of both parents.
