It is required by law that when you purchase real property, that a title/background records check is performed by an attorney’s office so that confirmation can be obtained as to the rightful owner of the property and that there are no liens/outstanding judgments

Hey Christie, This nightmare happens very often it's just not something people go around talking about. Finding the right piece of land takes a lot of research and patience. You don't want to inherit someone elses debt.Thankfully you had a great team behind you that did a diligent job. Glad it all worked out.

Can you say ANXIETY, that’s AWFUL!!! Glad things worked out for you’ll. It’s because of you that I want to share my experience. I’m at the beginning stage. I close next week and today we went by the property to put a play card for the septic tank. I purchased my home from a company called Lumbee Homes in Sumter SC and they’ve really been spot on and everything seems to be moving quicker than I thought. I just can’t imagine having to go through that situation. I enjoy listening to your story time cause I learn so much! Thanks for sharing 💕

@@keithbates598 awesome young man you have! Some of the friendliest folks are out of Sumter county. I’m actually from a little town called Chapin, about 2 hours away from Sumter. I did some traveling outside, but decided to settle down in a small town called Gaston. Home is where the ❤️is.

When I went to sell my parents home and a title search was done they found there was a lien on the property by a doctors office. Being familiar with my parents doctors I didn’t recognize the name. I called the doctors office and gave them my parents name and even mine and my daughters name just to be sure. None of our names came up. After doing the research the doctor was kind enough to pull back the lien. The amount owed wasn’t very much but still I didn’t want to pay it unless I absolutely had to. Very frustrating when something like that prolongs the buying and selling aspect.

That was very important to clear that lien off the property before you brought it. Otherwise they could have taken the property after you owned it and they could force a sale. He was rushing to close so he didn't have to pay it, you would get that bill- you wouldn't have the property.This has happened to other people and they winded up with nothing.

I know this is old, but I just watched it and I had to respond. I am a loan officer in Oregon. In this state the first two items that are checked is the flood level and prior liens, so the buyer and lender are not stuck with a property that is not insurable or has prior debt. As far as the taxes go, property taxes are County debts. There are no cases where they are federal. The amount owed was too high for that anyway. The federal debt could have been something else, but most likely was income taxes.

This was quite a thing for you to have to go through when buying land. I am sure that someone will read this and learn from it as I did. Sometimes, Life Happens, doesn't it? I am glad everything worked out for you because you certainly have been patient waiting on everything to smooth out. So glad you are working with a good attorney that looked out for you. That's a real blessing!

I ran across your RU-vid videos a couple of weeks ago. I think I ran across it because I had been looking online at Clayton Homes trying to get information on Modular Homes. I called one in North Georgia and talked to them 4-5 times. Each time I was told conflicting information. So I told my husband that we needed to go there in person to talk to them. I figured in person they would take us a little bit more serious. We went last Tuesday. We walked up to the porch of the office and there was a sign that said to wait there and no go inside. ( Due to COVID-19). So a salesman came out and I told him that we were wanting to find out about a modular home. He said they did not have any displays on the lot that could be made into a modular home. I told him I was told that every manufactured home they had could be made as a modular home. He said no. So I told him we waisted our time coming and it took 2 hours one way. He did not care. He never really stepped out in the porch to talk to us. So I turned to leave and he went back inside. We still looked at the inventory they had which was not much. I am thinking that we went to the same Clayton homes that you did and had a bad experience. If you are on Facebook I could private message you and tell you which one because there are 2 in North Georgia. I wanted to let you know I don’t think that you had a bad experience because of race because we also was treated bad. I just think that location needs some customer service training. We have pretty much decided to go with a builder now. What is a coincidence is that you live in Locust Grove and we live in Jackson. So we are pretty much neighbors. Lol. We are wanting to move to Ellijay or somewhere in that area. Like your videos I have learned something with each one I have watched. As for this video your real estate attorney did their job catching that lien on the property. That could have turned out really bad for you. God was watching and taking care of you. So glad everything went so well for you and y’all are so happy with your new home.

Hey There! I went to the one in Dalton GA and I’m not surprised. I think it’s the culture in that area really. It’s sad. They are in the business of making people’s dreams come true and they have terrible customer service. @@HomesNThingsbyChristie that is a beautiful house. We went to the one in Dalton. I just had a feeling it was the same place. We were going to go to the Clayton Homes in RINGGOLD, but did not get around to it. It is a shame that they treat customers badly. They have, no doubt, lost a lot of customers. We will probably end up having a house built. Which I’m not to excited about. It will all work out though.

Been watching a few of your videos. We are current home owners in Oklahoma (slab home) and are looking to do a land/home package. Your info is so helpful and you seem to be the only one out there sharing the process and all of its issues. When we purchased our current home we had issues as well but there are a lot more wheels turning in a land home package then in a suburban slab home. I know it will be slightly different in our state but you have given me so much to look out for. Thank you, thank you, thank you!

First of all, I love your hair. Wow, you all had an ordeal. That was very sneaky of the owner to try to sell the property knowing that there was a lien. At least you got more info on the $7000 property before you purchased it. If it sounds too good to be true, then it usually is.

I think if you all would have purchased the land and he still owed IRS that you all would have to then pay for it. I am so glad you all were working with legit people because some companies would have not told you all.

Hi Christie. Alot of anxiety! Glad you got your home. Keith and I can't afford down payment for the home. I could make the payments but not the down payment. I told you we have been running around living at Motel 6 now Residence Inn.Plus our Van was stolen and had to get another car. Twenty families right now are living at Residence Inn. It's been a total nightmare for us when Keith retired. Make sure your finances are in order when you retire. Fixed-income is not a whole lot of money. They should make the Congress live only on a fixed-income. And Senate as well! Anyway I hope you had a nice Christmas and New Years. I really like your hair. I agree. Congress Senate and any one else should have to live on the same retirement as the rest of us and I bet SS and Medicare and everything else would be fixed real quick. We should have a way to make their raises etc voted on by the people at elections. Now they vote themselves raises whenever they feel like it.

It would not have mattered when they requested the closing because it is automatic public records when there is a lien, and when doing a property search it comes up, my seller had just a 45.00 lien just for an old water bill.

That happened with some property we brought for Habitat and i made a big stink about searching the title and they over rode me and did it anyway. after we brought it- habitat had to pay that lien in order to keep the land, It cost over 75,000 for the land along with the lien, we had to pay the lien.

These things are important to know! Soil tests are important.Some land in certain areas is contaminated. Alabama has whole countys that you can't grow food or use the soil for anything. Chemicals were dumped decades before that had also contaminated the underground water. Some areas there is only maybe 6 inches of soil and the rest of the land was rock, couldnt grow a garden on it.

I don't think you'd be responsible...the title company would have been on the hook...it's their job to make certain there is a clean title and besides the bank certainly doesn't want to be left holding that bag...

@Yaya 38103 I agree...it probably was income tax and they'll attach themselves to whatever assets you have to collect...freeze your bank accounts and so on...it's not a sin to owe the IRS but if you ignore them that's when the drama starts...

You are wrong, the person who brought the property with a lien on it, would be responsible for the bill. I know of many people who this happened to and 5 years later house was taken and sold on the court house steps for a lien from the previous owner.

@@lovenotes5299 Title insurance protects real estate owners and lenders against any property loss or damage they might experience because of liens, encumbrances or defects in the title to the property. Each title insurance policy is subject to specific terms, conditions and exclusions. This is said to be a mandatory part of the home buying process bcz technically it's the bank's asset until the mortgage is paid off and they'd want to protect that asset and be the first line for payoff if the property is sold with a owing balance...

@@lizz741 once you take possession it's yours. You aren't protected- because when it's seized- the bank will get the rest after the lien is paid off from the sale. There have been many people even in NY whom this has happened to. A lot of people and companys aren't honest either.

@@lizz741 Another thing, Land brought on monthly payments by owner- bank approved the mortage, mobile home was set up on that land. One day the lady saw a man on the property, he said he brought the land from the original owner. No one told her, man said everything on the land belonged to him- she contacted the bank, they were in a bad situation. This small town, word travels fast, she had to find land fast to get that mobile home moved. Mayor owned some land and agreeed to sell it to her and the bank and mobile home company moved and set up for her.
