Um the other parents took care of both the children for about a month if iam correct. Therefore, they had feelings for the other child who they thought were also their child . So of course they hesitated to give the child back at first because they had thought he was their own and also had started loving him. People should also understand that . This is the problem when women who are surrogates are also having sex. You should not be having sex when you are carrying a baby for another couple. That is risky to the surrogate fetus and quit discusting. What happens if the man you are sleeping with has a disease like HIV, Hep, STDs or is abusing drugs while ejaculating in you without protection. It could affect you and the baby. These ppl are paying you to provide a healthy environment for their child. Even if there was very little chance for her to become pregnant twice like this... If you are going to committ to a healthy lifestyle for the sake of another couple then you should also committ to celibacy during the 9 months. Its not that hard.
It was the surrogate agency that did them dirty, not the couple who couldn't have children on their own. They gave the child back immediately once the DNA results came in---the agency held the baby for an extra week or so demanding financial compensation or the baby would be put up for adoption. The biological parents are now suing the agency, as well as the lawyers that represented them.
Did them a favor? Surrogacy isn’t for free. She got paid A LOT of money, and the couple gave her twice the amount because they thought they were getting two babies. After it was revealed that the girl was the biological mother, the couple was willing to give the child back but she refused to give the other half of the money back. That’s what the court case was about. There’s always two sides to the story 🙄
I was a surrogate. In my contract I wasnt allowed to have sex. 6 weeks before until pregnancy confirmation via ultrasound. The baby was given back in a reasonable amount of time. She said they were Asian, most likely Chinese. Her baby was probably in China already. If it was a normal surrogate delivery then yes he would have been. There was obviously no fight for the baby. just going through actual legal contracts with a lawyer and a translator and the baby being in another country. They would have to rewrite the contracts and reissue a birth certificate and legal citizenship. It's all time consuming. Dont bash someone before you know the whole story. For everyone getting this in their recommended in Feb 2021 a) The hold up was because of the surrogate agency, not the couple themselves. The couple gave up the baby right away, but things got held up when discussions of compensation came up. In a surrogacy you have to pay extra for twins, so they were asking for the extra money back. The agency threatened to put the child up for adoption if the surrogate mother didn’t pay. b) Some surrogate contracts say “no sex during the surrogacy” some don’t. There’s no way to know if she was breaking her contract or not. ADDENDUM: Her contract said "not [to] have sexual intercourse from the first day of her menstrual cycle before the embryo transfer until the date that pregnancy has been confirmed by the IVF Physician." [source in replies] However, there is still no way to know whether or not she broke her contract, since the gestational ages of the babies are ambiguous enough to suggest it could have been either before OR after the doctor told her it was okay. She said it was after, the agency insists it could have been before, but no one knows for sure.

A continuation A) she was paid an extra $8000 for the twins, the agency refunded the Asian parents and now wants Jessica to reimburse them for her own child (she didn’t even pay hospital bills mind you). B) she lied that she didn’t have sex, she did have sex and by so doing broke their agreement. Now she wants to keep her child for free, after her mistakes. If you were to run an agency like that, would you just let her go after all the money her lies and mistake caused.

I had twins like this. Both to my husband and 1 month apart. My daughter was 2 weeks premature but doctors estimated my son was born 6 weeks early. which meant they were conceived 4 weeks apart.My son always reached his milestones around 4 weeks after his "twin" growing up and was originally in special care for 3 weeks after his birth. They are both 32 now.

She shouldn't have had a battle at all. One embryo was implanted and she conceived on her own as well. The parents and their own baby spent months apart and it shouldn't have ever happened. The other parents should have done the right thing and made sure the surrogate's baby was given back to her asap. That is a very important time for mother to child bonding and they missed it. So sad, especially since she gave these other parents the gift if a child. There should have been NO battle.

They didn't try to claim the child. They thought it was theirs so they took custody, signed the birth certificate, all that. Then they learned he wasn't theirs. It took some time to legally turn over their rights. I feel really bad for the Asian parents. They prepared for him, took him home and bonded for several weeks before they realized it.

I didn't know this was so rare. I am a superfetation fraternal twin, conceived long after my twin. She was born full term & went home, while I had five weeks in an incubator. This story tops them all. I am glad they got their child back.
Like everyone, I never knew it was possible. IMHO, I think it occurs more than they say, and it would not be looked into, just like in this situation. Seems only because of their surrogacy and physical characteristic differences, it even came to light. Thank goodness my sister & I were conceived by same parents. Only due to my health complications was the unusual pregnancy ovulation figured out. BTW, look into the frequency spontaneous abortions occur, and most of the time go unrecognized. I only know this because I had one very early on, and wasn't explained until many years later. I'm glad I found out when I was more mature, because I could handle the self-blame & guilt better. It means the pregnancy wasn't viable, and there was nothing I could have done. Thank you.

The government only had a fault in that because they refuse to pass sensible and ethical legislation to properly regulate, and ideally ban, the surrogacy industry. The main fault here, however, lies with the Chinese couple who refused to give the mother her baby back unless she refunded them what they had paid for him, and with the surrogacy agency that tried to push the real parents of that baby into letting him be adopted out (which would give the agency additional income) in exchange for not getting sued to refund the money that the Chinese couple had paid. There is a reason that many countries ban surrogacy. The ethical issues aside, this kind of corruption is common even in the supposedly "altruistic" surrogacy situations where no money is exchanged. Surrogates being exploited and betrayed is far from an exception.
because at first it just looked like the embryo had split and both babies would have belonged to the prospective parents. Not until DNA was run did they determine that the second baby was the product of the surrogate and therefore not legally or biologically the product of the prospective parents. It just took a legal process to figure it all out and now everyone is ok.
It was more a battle over the fact that she broke her contract by having sex right after the procedure, which put their child's health at risk. It wasn't really a "custody" battle. They didn't want to pay the money for the contract that the surrogate broke putting the child she was carrying at serious risk

I think they meant the other definition of foreign, as in a "strange" or "not belonging to" implantation that perhaps her body didn't recognize so it still released an egg.

I don’t understand how it was a legal battle at all. That baby was hers true and true. It had nothing to do with the other couple or their baby. They can be called “twins” but the two babies had no biological connection whatsoever. The surrogates baby had no biological connection to the couples baby or the couple. They weren’t the child’s biological parent. I get having to refund the money given to pay for extra medical costs due to there being two babies but they had no relations or rights over the surrogates child. And how awful of the family to threaten to put the baby up for adoption instead of just giving the baby to its rightful parents. They had the baby for two months so I’m sure they fell in love with the baby and I’m sure it was emotionally painful to find out that one baby wasn’t yours and you had to all of a sudden give up the child you believed was yours that you loved as your own, but if you really loved that child you would do the right thing and return it to its family. Legal documents were signed. The surrogate agreed to the terms and conditions of the contract, there for she had no rights. You are required to go to court to break the contractual agreement. Even though that was her biological child the family can't just give the baby back immediately even with the childs DNA, the court needs to sign off, the parents are required to sign over their rights.

+Michele Davis i don't think that's entirely fair. they didn't know in the hospital, it said in the video that they found out later on with a dna test. by that point the new parents had bonded with both infants and some reluctance should be expected. just as it should be expected that the surrogate might have regrets about giving the child away, whether blood relation or not. they also didn't explicitly say in the video that there was a fight. they said after a legal battle. that could have been just with the legal system and not with the other family. it's an odd circumstance, and getting birth certificates changed as well as changing custody is a lengthy and tedious process under normal circumstances.

If the couple paid her extra to because she was carrying twins it would be okay for them to ask for that extra back (after all, the second one wasn't really their child), but threatening to put the baby for adoption is really mean. And that agency's lack of support seems to be uncanny.
I don't think she should because regardless they had to pay for the pregnancy it so happen she got pregnant after it was implanted...and per the agreement she was suppose to have an hour with them after birth...and she didn't get that.... if was allowed then she would have known right then and there

They were putting the baby up for adoption and also suing this woman and her husband. The Chinese couple were considered as the baby's legal parents, so they had more on their side with decisions. Legally, the biological parents had no say over much of anything, so they had to fight for him.
The asian couple also paid the woman extra for twins and, upon finding out that one of the kids wasn't theirs, they wanted a refund. The woman wasn't able to compensate them and so they decided to put the kid up for adoption

Relentlessly Rell thats shitty of them..this should have been handled by court..they had no legal right to put him up for adoption as only the birth parents(both) have that right..once the DNA came back stating she was the biological mother the childs custody should have gone to her..but the other couple should have gone to court for the additional money they paid her for the second child...the judge would have ruled in their favor and it would be a win win for both.

The minute you stop trying it happens. Just an fyi the only way I could get pregnant was in a "bent over position" and not trying to lay down afterwards. I thought I was completely infertile for years but after a few crazy nights one being at a country club wedding in an upstairs room, omg sorry this is gonna be a bit tmi I'm so sorry, but one new years eve, and an event in a car I was surprised 3 times with my children and each time was completely spontaneous, no planning and I think the endorphins of the spontaneity of the moment worked some magic. So say out loud that you are no longer trying and go get wild with your man, go on vacation, do some crazy things. It works, good luck!

It was her own fault for breaking the agreement and still trying to take full compensation for twins. She refused to give back the money they paid her for receiving two babies. They were totally fine with giving the baby back, but the mother made it a legal issue by not returning the money they paid for the twins clause agreement

I am glad that this family got their child back. However, as a surrogate, you don't supposed to continue to have sex; especially unprotected sex. If those rules were followed, this problem would have never occurred.
She agreed to give them their own baby, not one of hers. And either way the parents wanted to put one of the kids in adoption 😐 what kind of parents would do that. Instead of putting them in adoption why not just give the child to its real BIOLOGICAL PARENTS. Tbh their should not be any fights between them. And if you know that it’s not your child then give it back to its real parents instead of putting in adoption.
EisaIMVU MSP due to surrogacy laws, the only way to legally gain the child back is through adoption. She legally signed over her rights as "mother" when the children were born.

Lindsey Green when you are a surrogate, there are legalities that you sign your rights away to any embryo growing in your womb. Ive been a surrogate. Its not just squishing out humans and handing them to someone else.

There was a court case because the other parents paid extra once it was found to be twins -they wanted their money back, understandably. This woman won, and didn't have to pay them back while also getting her kid.

The family gave the baby over to the surrogate agency immediately after finding out he wasn't biologically theirs. The surrogate agency is the one who kept the baby from the biological parents and demanded financial compensation, otherwise they would put the baby up for adoption. The biological parents are now suing the agency and the lawyers that represented them at the time.

*For new people watching this video...* The Asian couple gave the baby back to the agency as soon as the DNA results came in. The battle each couple had, was ONLY with the agency. *No with each other.* And it was obviously about the money. The Asian couple had to pay extra thinking it was 2 kids. They gave back the baby after DNA and is only fair they wanted the extra money back. The baby was already in China, so please understand it takes time for this back and forth of things. The agency, who also runs an adoption center, wanted the mother to pay for her own child birth, the certificate and the extra money that was already paid to her for the "extra" baby. Or her child would be put for adoption. Tl;Dr Both set of couples were battling the agency. No each other.
Dragon heart I really don’t remember the content of this video much but if this was through a private type agency then yes I stand that they are greedy bc I’ve been in the system. However if this was state or other type of agency then I don’t have a comment on it bc I don’t have experience with it nor know anyone that does. Thank goodness they got their baby back! So sorry to the other parents who thought it was their child, loved the child and had to give him back. Really sad but I'm glad he's with his real momma.
TheLatestCrazE actually the people didn't lose the child, they gave it right back to the agency and even tried to have the baby adopted for money! Instead of just giving him back to the birth parents!
Oh my God that happened to a co-worker of mine and Stacy. She got pregnant within her pregnancy so her children are considered twins however one was like 8 weeks further along than the other. Crazy

The Asian couple were not fighting for him. The adoption agency stole him and wanted to adopt him to yet another couple to make money off him. They were using a framework that said the bio parents only wanted one of the babies, they rejected the other, so the other was now the property of the agency so could be sold on like a cat to someone else. The natural parents had to fight the adoption agency, the Asian couple had nothing to do with it.
I am really appalled at the parents. Why would they not immediately contact the surrogate after discovering one baby wasn't theirs, especially since they did not want the other child? I am appalled because it seems like they were trying to sell the baby to the highest bidder in order to get some of their money back.
Legally the other parents had to go through the agency to give back the baby to the biological parents. It was the agency that decided to demand financial compensation passed the $5,000 the other parents paid to the surrogate for the extra baby. The agency demanded $3,000 for the birth certificate to be changed, and over $9,000 for the care they provided for the baby while holding him for a week or two before handing him over. On top of that, they demanded $18,000 for the other parents. From my understanding, the other parents weren't involved in keeping the baby from the biological parents.

bc according to the legal contract between her and the Chinese couple the baby legally was theirs. She broke that contract by having sex when she was legally not allowed to and became pregnant w her own child.
1. The biological parent of the surrogate baby is Asian, we don't know if they are Chinese. There are 48 countries in Asia so that's why we use the term Asian. :) 2. It is not illegal to have sex while pregnant as a surrogate. In fact, most surrogacy centers obstetrician gynecologists encourage healthy sex as long as there isn't any risk to the surrogate or fetus. After the first two weeks it's pretty much a green light.
What a beautiful family. So glad they got their son back. Sure it was tough for the other parents, loosing one of their twins. But it wasn't twins. Bless you for giving a child to a couple who otherwise may not be able to.
She likely wouldn't qualify to be a surrogate again, since she is one of the rare few women that ovulates while pregnant. And, as said, it's unlikely any prospective parents would choose her to be a surrogate.

Goodness, this is the problem with only posting part of a story. The amount of negative comments towards the parents who contracted the surrogate, is totally unfair. It was NOT the other parents who held onto the baby. It was the surrogate agency that basically held the baby hostage. You are bashing the wrong people. This is the information super highway, research before you rant.
@Wigs In Space umm they don't volunteer. They're paid thousands of dollars. There's reasons why doctors tell you to obtain from sex especially when you're being paid to volunteer to do something. It's not her body atm. She sold it to incubate someone else's child.
@@Asianan6el exactly, at the planned time of conception surrogates are told to abstain. Clearly she became pregnant with her child and theirs at the same time. She obviously had sex right around the time they implanted her embryo. Not a smart thing to do. Especially because of all the hormones they gave her.
