I think he means the actual contract signed when agreeing to be a surrogate. The people paying all her bills pretty much have the say as if it was theirs. Meaning, usually the parents adopting can choose an abortion if there are medical issues.

We don't know their situation and there are many factors you have to consider. They obviously wanted to have a child and there was no guarantee she would even be able to carry the child full-term give birth to a living baby. These were heartbroken people who had to make a devastating decision and the surrogate doesn't have a say in that. What was she going to do? Give birth, hand the baby over to the parents, and then say 'bye bye' and never see the child or the parents again? Never have to deal with the decision SHE chose to make?

The Biological parents had no intention of keeping a child with physical health defects in the first place. The bio-parents offered her 10k to end the pregnancy and she countered with 15k to end it but she couldn't do it. She took steps to protect this baby from being aborted or being lost in the foster care system. She went to a state where she was legally called the baby's mother. She gave this baby to a couple who genuinely wanted her. Not to some shallow couple who would leave her in the foster care system. If anything she did more to protect this little girl than anybody else did. In her contract it says the family holds the right to abort. She didn't have to sign it or carry their baby but she took that risk and had no objections. I half agree. The baby is born now and the parents don't have to have anything to do with her. The baby also has a chance at a life now. Whether to get an abortion or not WAS her choice to make. It's her body and still her right to decide what to do with it. No surrogacy contracts can force a woman to have an abortion if she doesn't want to, or to keep a pregnancy when she wants to get an abortion. I don't feel too comfortable about the choice she made to give the baby up for adoption. It was probably necessary due to the baby's medical needs and she obviously doesn't have the money to cover that. But perhaps she could have let the intended parents meet the baby and see if they'd change their mind, and give her up if they didn't.

Anything I've read about Surrogacy is that if your considering being a surrogate you must understand that the baby your carrying is not yours and that the couple whos baby your carrying may have different moral standards than yours. Surrogates need to be carefully vetted, not just before the pregnancy but throughout the gestation. Facial deformities occur in the first trimester, with drug use being a possible cause. I am not saying this woman wad a drug user, but I am advocating for stringent background checks and vigilant health monitoring throughout the pregnancy.

I believe that life is a precious experience and taking that away from someone is just despicable. Plus, you don’t know for certain that she will be bullied or not married(like family.) And sure, she may have to struggle more due to her medical conditions, but that doesn’t mean that her life is going to be totally messed up the whole time. Perhaps she thought about it during the rest of her pregnancy and ended up deciding that it was for the best that way? With the baby's medical needs, she probably did it because she couldn't afford to pay for the baby's medical procedures, whereas she might have found a loving pre-adoptive home that could. I think the biological parents should have been given consideration, though, to get her. Who knows, maybe they would have decided against giving her up if they had met her as a baby.

The biological parents never wanted their child to be suffering her whole life, so they tried as early as they could to abort. She even tried to make the biological parents pay a lot more money for the procedure, who showed that the surrogate didn’t put much value into her birthed child.

Because she choose to relocate to Michigan she was the child's mother at the time of the birth. Krystal Kelly as a single mother was unable to care for the child's expensive medical needs but she did find an adoptive family who wanted to. The original intended parents had said they did not wish to have this child. The baby was featured in the video while she has abnormalities and certainly by now has had many surgeries to correct them the baby was not suffering.

Even so, I would’ve agreed with what she did if she hadn’t bargained the baby’s life. If she was a true hero, she wouldn’t have even _thought_ about aborting it, even for 10k.
And this is why you have lawyers and a very detailed contract with situations like this. While I don’t necessarily agree with the biological parents to abort, it should be their right to state what they want in the best interest of their child. The surrogate is only the person giving birth to that child by contract.

The ethical choice in this situation would have been to follow the contract that she agreed to, but I think people that are using surrogates need to be mindful of the fact that the surrogate is carrying the baby & she will be susceptible to the hormonal changes & the bonding that comes from carrying a child. I don't think this happened in this situation, since the surrogate had no problem aborting for a higher price, but again, the state can't force her to abort & people hiring surrogates need to be cognizant of this fact & understand that a clause forcing the mother to abort in certain situations would not be enforced in the U.S.
I know that people have strong opinions about abortion, but I think that pregnancy, life, death, and illness are extremely complicated. And it's a choice of who will suffer. A child with severe defects or a woman with guilt.

I dont see it that way. I see it as not bringing a child into this world to only make it a few months in. I believe in happieness witha disabled child, but I also believe in your life being over when you have a child thats as disabled as this little girl. The child cant help it, but the parents cant either. People may not have to time/room/money to provide for a disabled child. A lot of care and time goes in to children like her. Certainly everyone doesn't have the time/room/money to provide for a disabled child. For some reason, however, there are thousands of people who adopt these children and don't think of them on a level of dogs or cats to be terminated at will, for health reasons. I realize that even completely normal human babies are terminated for any reason though. Doctors recommend the abortion because it was an option so the baby wouldn't suffer. It really was luck that she managed to live for 8 years. Idk if the kid was made from either of the parents but when the woman left that is basically "kidnapping", it wasn't her child, she was only the surrogate. The only reason she didn't go to jail was because she fled from the police and the parents dropped the charges. Not only did she go against the parents, she also denied them the opportunity to raise their child, because she gave it up for adoption as her own (when it wasn't)
The problem with this story is that once they heard that the baby was being given up for adoption the biological parents wanted parental rights to the child, but they were denied because they used an egg from a donor instead of the 'mother'.
Also this baby had organs growing in the wrong places, two malfuntioning spleens, and NUMEROUS heart-problems TO NAME A FEW of the things that was wrong with her including a problem with her BRAIN. I can't say I blame the biological parents for wanting an abortion so the child wouldn't SUFFER. The surrogate is a bitch who breached the contract with the parents, ran away, refused to accept 10 000 dollars for taking the abortion (saying it was against her reliogon yet that she'd do it for 15 000 before changing her mind again) and then she gave the baby up for adoption because she couldn't afford to raise the child herself (money was the reason she became a surrogate in the first place). I am happy the baby is with someone who'll actually care for her, but the baby COULD have gone back to the biological parents, but for STUPID reasons they can't have her back. Despite the donor-egg the biological father is still the biological father! And they WANTED her back too!
MovieManiac33 I meant that it's better to abort a child before they're capable of feeling pain, rather than forcing them to live with it after birth. Can you honestly imagine what kind of life this child now has? And still say the surragate did the right thing? I honestly can't. Also, I'm not going to pretend to know what went through the surragate's mind during all of this and i'm not going to re-watch the video just for that. At the time i did however get the impression that she only kept the baby for money. I admit now that i may have been overly judgemental, but that doesn't change the fact that i don't agree with her decition not to have an abortion. That baby has so many medical-problems that i can't imagine he/her still being alive, or what kind of life he/she lives through if they are. And honestly, since you sort of brought it up, i'm uncertain about topics such as people who order aid to die because they can't live with whatever medical problems they have, but those people at the very least make that decition for themselves. I don't know how old this child would be by now, if their alive at all, but if the adoptive parents are keeping him/her alive UNNECESSARILY just for their own sake then maybe they should start thinking about what they would've wanted if they were in this child's situation.
MovieManiac33 I do believe i admitted that i may have been wrong and overly judgemental at the time, or did you just ignore that so you could argue with me? Besides it's been i-dont'-know-how-long since i watched this and i honestly can't remember what i thought or felt at the time so i'm not going to continue this discussion any further. I stand by what i said, but i admit that i might not be logical about something i wrote on an angry whim a long time ago. I still stand by what i said, but i know it might not have come across the way i wanted to so if it's easy to misunderstand i apologize for that. I'm not going to change my mind about disagreeing with the surragate's final decition about not aborting the child, but i doubt you're going to change yours either so i won 't waste my time. I feel like i should explain that i wrote what i did based on my habit of expecting the worst which in this case is that the child is dead or in a vegetative state only kept alive by artificial life-support or something. It's not logical, i know, but that's what i'm expecting.
Aly A The biological parents wanted to end the suffering BEFORE it could even begin. In my eyes that child was used as a personal game to gain more money. Now, the poor little thing has been put up for adoption. Unwanted by her surrogate and denied parental rights from her biological parent. not only that but with heart and brain problems! The odds are endless for little tot but now that it's set and done I only wish the best for the kid...
Linda Christiansen so you are saying that your parents could kill you without your consent if you faced severe compliactions like this. after all the only difference between a fetus and the people in the comment section is that it cant voice out what is its decision.
