The plaintiff says the defendant is her nasty neighbor, who she claims trespassed and butchered a tree she had planted on her property in honor of her dad, so she’s suing. The defendant claims the tree was on the property line and was overgrown. He says when the plaintiff refused to trim it, he took matters into his own hands.

The only thing that guy is legally allowed to do is trim the branches that are overhanging onto his property. Trim the branches, don't destroy the entire tree!

In the beginning I was on the defendant's side until they showed the pictures of what he (or his gardener) did to that tree. Everyone should understand their rights as far as trees coming over property lines, but he went way too far. I'm glad I don't live next door to him- that has to be awkward now.

It's better to cut a tree like that all the way back. It comes back healthy and beautiful where select cutting will do the opposite. The arborist was probably doing her a favor but if you don't know that what can you do.

Obviously the tree will eventually grow back but the bulk of the judgement was for him trespassing. Hopefully he learns the law and lesson that the $500 cost him and doesn’t do it again

The Floridian and P&C Insurance agent in me appreciates this case 😁 I have a tree in my yard that I wish my neighbors would cut. It’s a pain to maintain and scratches up my car. The previous owners were landscapers 😩

@@SpiffyPenguin No, they do not. You have the right to cut any limbs or overhang that is on your property, and if you fail to do so, then the fault for any damages resulting therefrom lies with you. The owner of the tree not only doesn't have a responsibility to cut down part of their tree that encroaches into your yard, they actually don't have the right to do so without your permission. Anything on your property is your responsibility, and you have the right to cut back only that portion of something that overhangs onto your own property. It's just not that difficult a concept to grasp.

Full size dwarf orchid trees are extremely rare and very expensive. I saw one about 3 years ago at a nursery and the plaintiff was right--it was $700. You can find starters(18-24inches) occasionally for 35-120 dollars, but those are also rare and hard to establish. Very interesting case, for a moment I thought the plaintiff was going to over talk her way out of a ruling in her favor.

I found dwarf orchid trees online for $35-$100. Wasn’t hard and they don’t seem all that rare. They must have made a comeback since the taping of this show 🤔

I feel like the plaintiff should have just cut it. ESPECIALLY since the tree meant so much to her and it was so “rare”. I feel like they both were being petty and passive aggressive and look what it cost at the end! Smh really sad…

Sure it's wrong for that guy to go in her yard and cut the tree but if you have a tree and it is growing over your neighbor's property, then you should be courteous and get it under control. Why should it be his job to trim his neighbor's tree.

And the defendant is willfully ignorant. He completely admitted to accessing her property in trimming the tree. It was also revealed that Florida law states you can only trim something that encroaches on your property line as it extends from the ground to the heavens. He literally admitted he trespassed to cut the tree whether it was him himself or his gardener. As much as I love the United States and being an American, we are chock full of people unwilling to take responsibility for their own actions. Even when you show them directly to their face what they did was wrong, they still deny responsibility or say that they are being unfairly punished. Accountability is not a common virtue anymore in this country. I'm starting to feel like they should change the beginning of the Constitution from "We the people" to "We the victims"😂😂😂😂

I am going through the SAME issue with my new neighbor of 3 months in Western , Florida. I have resided there 12 years & only once he spoke to me. I go out of town & my lservice provider sends me photos of the tree ( 4 large branches) cut back to the CENTER of my side yard PLUS he trespassed more into my yard to illegally dump the branches behind my Florida room. First time homeowner thinking he’s big man on campus. Guess what- I was a realtor for 7 years & I Know the LAW. Taking steps to cease & desist but maybe we will end up on the Peoples Court.

So much sentiment for one tree 🌴. It's now grown back to what it originally was. I can tell these cases are for TV purposes. Should have sued the gardener too. 😂

I Loved the plaintiff's accent. Delightful woman, and she was right. We have the same law here in Michigan, and we helped my sister by trimming a few weed trees growing in the backyard of her neighbor. He came out, brought a ladder, checked the trees upside and back, and couldn't catch us going over his property line. We were careful.

That they must be stoic at all times? The qualities that make a man a man come from within - integrity, accountability, responsibility, following through on one’s word, taking care of business, and taking care of those he is obligated to. Some of the comments here are so ignorant, if you cut a tree down and trailers grow out from it, there will NEVER be a leading branch to turn this back into a tree, it can now only ever be a bush, which is NOT what the owner wanted. It just seems that all too often the defendant is the true winner, as he got what he wanted (no tree) to the small fee of $500...

If it were my tree with branches overhanging on my neighbors property i would cut it myself, especially since she said its soo rare..i wouldnt want someone messing up my tree. She coulr have just been a goof neighbor and gotten the tree trimmed.

That tree is fine. Though it was a harsh pruning, it will grow strong. She's a whiny plaintiff who is right about the trespassing but not about the tree. Glad neither of them are my neighbors.

Studying the technical pruning in various countries including the most pruned tree country in the world....Japan...her tree is fine and she is a baby.

I know he’s wrong, but that was also kinda crappy of her to tell him he was responsible for trimming HER tree. If one of my trees is over my neighbor’s property and causing a problem, I’m going to cut it because it’s my tree. It shouldn’t have to be my neighbor’s responsibility. When our huge tree blew over in a storm, it broke two neighbor’s fences (the fence wasn’t connected to our yard). We went and cleaned up the tree in their yard and fixed their fence.

I didn’t catch what year this case was, but it’s 2024 now, the cost of one of those trees now is about $220.

Omg!! The things the guy is saying to Doug are ridiculous, and illogical! First: he said that’s not how the tree looked after he cut it when clearly it is. Second he complained that the first time he gets to meet his new neighbor is in the courtroom, but whose fault is that? He was even saying that that he should’ve been welcomed to the neighborhood with a card, or something. 😳

The defendant was so ignorant, at the very end his advice is 'it's a shame that the first time you meet your neighbor is in court, you should knock on their door, or send a card', how about NOT trespass onto their property and cut their tree down without permission, does he not listen to himself?...

I just found a dwarf orchid tree online for $165. Plaintiff is lucky JM amended her lawsuit to include trespassing. The defendant's arrogance is off-putting. I can't imagine having him as a neighbor, and would probably be inclined to install cameras.

This law need to be challenged. He should submit to Florida Supreme Court. It's not fair or justed to force the neighbor to spend his hard earned money to cut back a tree year after year just for her enjoyment. It was challenged in VA and that person won. Not condoning the trespassing but I understand why he did it. Honestly, had I been in that situation I would have cut it down to a stump..

Dear Judge.....we had a HUGE tree in our pompano beach front yard.....covered w pink flowers during bloom season.......we had some dumbos on the property to cut down a DEAD TREE.......I specifically said, " do not come on the property until Sunday when I'll be here all day. Your only job is the dead tree. DO NOT TOUCH That flowering tree!!! Don't Touch it........they cane on a day we were not home..... They cut down the dead tree and butchered......... BUTCHERED the large flowering tree. It's just now beginning to bloom again After FOUR YEARS !!!! I wanted to HURT someone !!!

Seems like all these "good citizens" are the ones who make life miserable for neighbors. I have one that has decided to try an experiment - his words - with free ranging his two bulls on our property because it will make the meat better. Also poached a deer on our property. Troopers have warned them twice now to knock it off.

People mistakenly think that you can trim a tree overhanging your property 'from the ground to the heavens. Not true. You can trim the part that interferes with your ability to use your property, but not enough to damage or kill the tree.

This isn’t accurate. Your property line extends “from the ground to the heavens.” However, now that we have commercial aviation and you obviously can’t control planes flying over your property, you basically just have the right to control the space above your property that you need in order to reasonably enjoy access to your property. It’s up to a judge to determine what’s reasonable. There have been cases where people have successfully sued for low flying helicopters and such (which are obviously still flying more 100 feet above the ground). In instances of trees, you can cut off anything that hangs over your property line, regardless of how high it is. Anything over your property line has the potential to fall onto your property and cause damages, and unless the tree is ill or dead, the owner of the actual tree is not responsible if an “act of God” causes branches to fall. Cutting anything over your property line is a preventative measure to protect your own property.

Maybe where you are, but this is not true in Rhode Island. Had tree on our property line which my neighbor had a tree service clear cut vertically from base to top. It's trunk was two feet on mine so after the butchery it literally looked from between our houses as if it were 1/2 a tree (which it was). I sued. Not only did I lose my lawsuit, but my insurance company declared the remainder to be "a clear and obvious hazzard" and forced me to remove the rest @ $4,700 out of pocket. Suing the tree service she used for the $4,700 as my attny states they should have obtained my permission first.
