My agency is saying I can’t serve section 8 and 21 after 2 months because there is still 1 year left on the fixed contract. Is this correct?

Section 21 No! But Section 8 (Of course you can if they miss 2 months worth of rent if it is a Monthly paying AST. I would speak to a solicitor, your agent doesn't know what they're talking about.

Hi nice video. If the tenant refuses to pay a rental increse, does the same principled apply and can I serve the section 8/21's. Thank you in advance.

@rabj2834 thank you for your comment. There are a few options, if you are legally serving the rent increase (either anniversary of fixed term or periodic tenancy agreement) then you have to give your tenants a clear 2 months notice. If they don't to pay the increase (which after the 2 months would actually be not paying enough rent), then you can serve a Section 8 notice (once they do not pay the increase) or an easier way is a Section 21 or Section 21(b) notice as they cannot defend it but then you cannot claim for arrears using a S21. However, seek correct legal advice and be aware that the courts are taking their time at the moment. I would always advise trying to finding a way with the tenants first via good communication and negotiation.

There are some greedy landlords out there, but I think it goes back to Supply vs Demand in the main areas of work such as London, Birmingham, Liverpool and Manchester, etc... If there was a larger supply, then they wouldnt be able to charge such high rents. The government has taxed landlords meaning a lot have left the market, there has been a lot of immigration over the years and people are living longer too, therefore, there is not a lot of housing available in these areas meaning rents increase due to supply.

@@scottjay1465 yes I understand supply and demand very well. Landlords don’t have to rent it up to the max that’s the point. If I rented out If be reasonable not the highest bidder. I certainly wouldn’t want people struggling and stressed about paying the rent every month. The rental sector is everywhere, not just the cities. It’s worldwide also. I’m about to be homeless at 58 as used to care for mum full time and she died. I live in a small village in Kent. There are multiple factors contributing. The main one is the Airbnb scenario, yes they make people more money but it’s taken away millions of rentals in a world where people can’t afford to buy their own house so there’s less rentals for an ever growing number of people. There’s no social housing or very little and like me it’s impossible to get one. Utilities have shot up. The buy to rent places if they’re still paying off the mortgage the interest rates have rocketed and I was informed the government changed the way this is taxed which is a loss to the landlord and the costs passed down to the renter. Just because there is a lack of supply as said they don’t have to charge the max possible somebody is willing to pay. As a professional carer who is single, not being able to buy or afford even a room in a house share is frightening. Single people are having the worse time because people with children they ensure you at least get a house over your head but for singletons they don’t. There’s now loads of single working people living and working from dorms or working from a tent. No wonder there’s no carers and they’re struggling to fill low paid workers in this country as obviously they need somewhere to live.
