Foreigners are allowed to buy any type of real estate in Brazil without any type of visa. The challenge is that there is no escrow, meaning there is no absolutely safe and secure way to make a payment and still ensure that contracts are signed and legal title is transferred after the payment has been made.
I explain more details in the video about how the process works locally and some of the challenges a foreigner buyer of Brazilian real estate faces.

You haven't been correctly informed or assessed when you bought your property. A safe real estate transaction in Brazil starts with a preliminary contract, called "Promessa de compra e venda", or "Compromisso de Compra e Venda". This is document by which the seller promises to sell and the buyer promises to buy the property. This contract usually says the buyer pays 5% of the price for down payment, and gives the seller a period of about 30 days do get all documents. Is there's any problem with documents, the transcation is cancelled and the down payment is given back do buyer. This document can be registered in the real state office (cartório de imóveis) and, once registered, guarantee to the buyer that, if he pays the price agreed, the seller, or any other person who is in the property, in obliged to transfer it to the buyer. With this preliminary contract signed and registered, the risk of paying the remaining 95% of the price is much lower, because will you have a right called "erga omnes". Buying properties is a complex operation, and specially for foreigners, I recommend paying a real estate lawyer to analise your operation and help you making a good transaction, with low risk. This professional should charge 2% ou 3% of the operation, it's a good precaution.

Wow! I didn't know that kind of behaviour in Brazil against foreigners. As a Brazilian I never had problems buying and selling a house or apartment by my own. I'm so sorry for you guys. It should not happen to anyone. Besides that you foreigners have the language barrier, I mean it can be frustating, sad and suffocating as well. I'm really sorry. As I said before it shouldn't happen to anyone. By the way, welcome all of you to Brazil, feel at home and I'm sure we have lots of better things to compensate that disgusting behaviour of our realtors and correlates.

I just happen to come across your channel and found it interesting. I’m in the process of moving down to Florianópolis after almost a lifetime in the US. Im going down end of next month to see some “sítios”. But first thing is getting my CPF and open a bank account down there. I’ve been working with a realtor from down there and I believe he’s an honest one. I dread the politics down there but love the country. Maybe I’ll see you down there?

Great vid! On your comment that the seller may sell the same real estate to multiple buyers is absolutely true! This was done to my wife (Brazilian) many years ago, but fortunately my father-in-law (a Senador) intervened, or she would have never gotten a dime back. Things, however, have changed a bit with the process, thus safeguarding the buyer. But, as in life, caveat emptor!

Your wife should have made a preliminary contract, called "Promessa de compra e venda", and registered it in the real estate office. This prevents this multiple selling problem, as it gives the buyer an "erga omnes" (everybody is subject to it) right to have the property transfered to her, if she pays the price agreed. This works even if the property has been sold for other person.

One of the things I recently learned is that each Brazilian realtor can only sale his own listing (unlike in the US that they can split commissions). Also like mentioned in this video, no escrow.

Be careful, don't buy properties in foreigner countries. rent first. Even Brazilian has to be careful. Check the documentation, check if there is no HEIRS, Check if there is no lein, check if there is no debts. You don't need speak the language to negotiate, just write the numbers in the paper.

That situation just happens in small cities and/or rural land. Florianopolis especially, because it's a island there's issues related with the army forces, as the law says, in case of war they can take your land if you don't have the paper ("escritura") saying it's yours. But most of all, foreigners and especially those who act on a snob manner, will be charged more.

For brazilians, anyone who doesn't knee down and beg for your mercy is judged as "snob" xDDD Scammy people. Better off spending your money in Paraguay if you're looking for land. Beach is attractive and all, but it's kind of a trap too.

But I agree to some extent, Florianopolis is a very peculiar land because it's an island with limited expansion permits, people there want to keep the island the way it is, without too much expansion.

Almost built in Floripa a couple years ago. Plan on doing it in a couple years from now. Is Floripa a little safer to buy than other parts of Brasil ? BTW it's real-tor not real-A-tor... very common mistake.

to me it seems brazilian housing is way way overpriced , i've seen some beat up nasty looking 3 bed places going for 190k and i'm talking the inside of these places wouldn't even be considered a 2 star hotel type furnishings just disgusting ,. on the other hand a 2 - 3 bedroom condo with 4 - 5 star furnishings brand new everything for 150k in playa del carmen mexico and really you could find these type of luxury condos at the same price all over mexico and if you get away from the beaches your price can drop 30% ,. brazil is just one messed up country that has no idea what its doing

Matthew, Price of real estate has the largest monthly decline in 5 years, says FipeZap. Brazil is not a reagion from Mexico, is way different. Brazilian's economy is almost twice bigger than Mexico, the actual material production of Brazil is almost DOUBLE of material production of Mexico. Brazil's experiencing political instability, in consequence of that health, safety and education get compromised. But it does not compare to the problems of safety, health and education in Mexico, which are bigger than Brazil's, even Mexico having a smaller area and population Among many other factors that show's that the higher is justified.

Good luck if you're going to judge a country by these "economy indicators", which in the end don't mean anything really. I've seen people having better lifes with a lower cost in Mexico, more freedom. (a third of the cost to be exact) Look at the difference in both countries when it comes to getting a driver's license. Around US$800 in Brazil right now if you want to drive car and bike. Truck license, even more. And again: the people who conduct the final tests can deny your license just because they're having a bad day. Welcome to scam land.

how do you get internet where you live? can you get access anywhere? how dose the temporary visa process work to be able to open up an account in brazil?

Presently, the fastest internet access in the countryside is via a cell phone modem connected to an antenna to amplify the sound, but it's 2G speed, or about 256kbs, so I don't use it. 4G towers are being installed in Florianópolis and São José, and I'm not sure when they'll bring them out into the countryside. There's always a time lag. For quick use, I drive 12km into Angelina to use a 2Mbs fiber optic connection at an internet cafe (I can connect my laptop there) and usually combine it with lunch and shopping in town. I keep an apartment in Florianópolis where I spend two days each week online at 20Mbs fiber optic for the heavier work such as uploading/downloading videos. There are companies beginning to install private radio towers throughout the countryside and then selling speeds of 1Mbs to maybe 10Mbs via radio. They haven't reached my area. It's all a matter of time and when that final stretch of road is paved and there's high speed internet available at these properties prices of everything will more than double. People will realize they can live out there and commute 30-40 minutes to work, or even better, simply live there and work online. Send me your visa questions at the contact page at brazilforlife.com. I'm not sure what you mean by "temporary visa". Bank accounts in someone's personal name can only be opened by foreigners who have a visa with a term of one year or greater (eg. any permanent visa, a 1yr work visa, a 1yr student visa). Foreigners who open a Brazilian business can open a bank account for that business right away and use it to conduct business.

Yeah, this region in the Santa Catarina state is a very peculiar region, because the capital (Florianopolis) is an island, housing permits there are a pain because they want the island the way it is (which I agree). And to the west of the state, the countryside, there's this huge mountaineous area of land, which makes difficult for cellphone towers to work properly, signal there is very hard to get and slow, but is an exception in the brazilian territory. The main problem is price and bureaucracy, high costs for mediocre speeds (you can watch youtube at 720p if you're the only person using the router for example) and the contract usually lock you down for a year.

I’m in Minas trying to buy and it’s beyond ridiculous trying to navigate. Now my biggest question is can I wire transfer money directly to a seller or developer? Is there a tax to bringing rather transferring say, 200,000 usd to Brazil?

there is a tax of buyng a house in brazil called ITBI. sometimes the seller says is alredy included. Still, it needs to be paid, maybe is included in the full price of it, but is a bill. It goes to the city hall, where you should also see if your house has any debt before buyng it

Martin, it's possible, but not easy. You'd first need to qualify for one of the permanent resident visas and keep it active for five years. After that, you can qualify for what's called the "naturalization" process, or establishing citizenship and getting a Brazilian passport.

200k a year? No fucking way, wow... Totally false. In hotels I think you would be able to land a job, but I would not know if the companies would hire someone "without papers", to put it like that. The majority of companies here in Brazil only hire within the law with the fear of legal implications, and that's a bummer because there are a lot of qualified people who would prefer to work informally in their own terms.

Taco, Brazil is pretty big, and he's talking about an area of it. The real estates is different in each region of Brazil. For exemple here in Rio de Janeiro we don't have that much of problem cus' we have more contact with foreign, we work with consolidated builders that cares with your client don't metter there nationality, etc.

Sorry, that is not a common solution in Brazil. You may get something like that in huge cities, like São Paulo. But it is rare to find some one who would do business that way. But great idea, anyway.

Thanks for exposing the truth that no one ever talks about and going beyond the false myth of "wonderful and friendly people". One of the biggest problems at the moment is this mentality of grandiose coming from the public sector workers, just because they went through an exam and got their precious govt job they think as themselves as the elite (and in some ways they are, with huge benefits, taxless loans, etc etc) If these people just took the decision to do their fucking jobs as it has to be done, things would flow. But no, you have these people that feel for the first time in their lives this addicting feeling of power, the feeling of being the gatekeeper into other people's lives, and that's very dangerous when you give anyone such power without any consequences. And you can see this inside people's homes, brothers stealing bigger parts of inheritance from their brothers, parents who privilege one son over the other (more often than not the "problematic but charismatic" kid will win over the one who's right), etc etc. This whole place is a mess. Sad because it had so much potential.

It's not exclusive to Brazil either. The other day I was reading one story of a guy who had to deal with real estate offices in California, they would offer false claims that land was not for sale just for the sake of it, or they would inform higher prices than the real one. The guy had to argue with them that they were offering false information on top of acting as a group, which would turn it a conspiracy. Then, the guys backed off. One can't even buy land anymore in this "free" world we live.
