Hi Sir, I did work in a company for 4 years as permanent employe and due to taking leave for 10 days when I join the same company they put me on temporary basis and overall I worked for more than 8 years in company. So want to know that, am I eligible for gratuity?
I worked in a company, I joined on 1:10:2015 ..they keep me in training for 2 years and from 1.09.2017 they given me permanent employment letter on roll and on 15/12/2021 I resigned.. My total experience is of 6 years.. But HR saying your training period will not be counted for gratuity you're not eligible for gratuity... Is training period not considered for gratuity eligibility?

If employee is working for 8 year till 8th year there were non applicability of gratuity act and after 8 year employee strength increased to 25 then after 7 year from the date of applicability of gratuity act that employee leaving that organization so what is the effective date(year) of calculation of gratuity act? 15 year or 7 year?

My name is Ravi Kumar Bansal and I am from Punjab, I was joined Finehope Allied engineering(India) Pvt. Ltd. on 05-Augest -2012 and I was deputed to work for Chinese company SEPCO 1 in the field to power plant construction and I am a full-time employee. Later on, onwards November 2015 dispute occurred between our organization and our Client(Power Plant Owner) so all work was stopped and all employees were ideal after that our employer released me on 17, March 2016, but after some days dispute was settled and our employer call me for rejoining so again I have joined the same company after 1 month of gap as on 18, April 2016. But this time our employer discontinuous our old employment they gave me new joining letter and they generate my new PF no. so my overall employment for the same company under same management on the same project is 05, Aug 2012 to Till date Approximate 6 years, Now I want to change my job, but our HR said you're not eligible for Gratuity because of new joining. So I want to know that is I am eligible to claim my gratuity or not. So sir Please suggest me what can I do and if I am eligible to claim gratuity please send me details as per India labor Act.
