My gratuity was supposed to be credited by April 30. But its still Not credited and HR gave the reason that its not processed by theLIC ad they are busy closing Fy 2021-22 !! Is this acceptable?

Sudhir Sir, thank you very much for your kind information sharing. Sir in my condition I worked for 5.7 yrs in a company. In that 1 yr as a contract employee and 4.7yrs as a permanent employee. In this period my PF amount is deducted from a single account I.e., PF is deducted continuously for 5.7yrs. My employer is now telling that for 4.7yrs we are not able give gratuity n not given also. But he terminated me on exact 4.7yrs.. where as rules of gratuity act is telling that 4.8 yrs is okay to claim the amount and please suggest me weather I am eligible or not.. pls reply me..

Bhai ager aap prove kr sko ki apke papa ki id use krke fraud kiya gya h to unko gratuity ka paisa jrur milega ya aap application dalo Appellate Authority ko to vo khud inspection kregi or apko apke paise dilayegi with interest.

Sir my brother expired due to heart attack he was unmarried I have raised the concern for payment of gratuity from his employer where he continuously served for 13 years now his employer intimated us that he had not made any nomination during his service as such the payment of gratuity will be paid through Succession certificate from court since getting a succession certificate is a long term process please advice another possible ways for claim settlement myself his unmarried elder brother and my mother are only two family member who are alive to raise the claim can gratuity be paid through a notarised legal heir certificate please comment your opinion in this case.

Court case Kare Zarur milegi …. Actually gratuity means payment I respect of your service to employer so when it’s applicable on private employee then why not applicable on govt employees whereas he did more than 5 year of service ….. clear case of breach of natural justice ….. Supreme Court mein case karo zarur milegi gratuity ….

If your organisation is covered under gratuity act then Yes (since 6+ months = 1 year in roundoff) if not then you need 5years+ service

there is a formula to calculate->( Last drawn salary x Number of years served x 15)/26

Salary last drawn (basic +D.A)*15/26*No. Of years employed ( excess of 6 months taken as full year) If it is a seasonal work than 15 will be replaced by 7 days, this is the right way of calculation if anyone wants to know more pls subscribe my channel and msg me peronally so, i can solve your problem , Thanks🙏
