I’m a fairly pro consumer guy. But this is blatantly piracy of current games. By going to court and inevitably losing he’s going to help Nintendo establish precedent that will hurt us all.
The only reason that I can think of as to why Nintendo would do this is because they are planning on adding more virtual consoles to the Nintendo online membership in the future. GameCube, Wii, Wii-U, etc.
The original case that establish emulation as legal(but not ROMS) was brought by Sony; they lost yet the other company went bankrupt despite their victory due to monetary loses brought by the lawsuit.

Nintendo has a legal department and lawyers gonna lawyer. Even so, they don't have unlimited resources so a lot of what they do will be focused on supporting Nintendo's business strategy. Switch 1 => Switch 2 is likely going to be forwards and backwards compatible. That means a Switch 2 selling point may be it plays Switch 1 games better. It also means for the first time ever physical and digital library will carry forward. This is why for this generation Nintendo is cracking down on modders and emulators so late in the generation; controlling the way software is run between the two generations is particularly important to them this time around.
We call this....A LOST CAUSE !! Nintendo owns the rights and PATENTS to all their systems and all their games. If you don't have Nintendo's approval to use any of them no matter how you use them or when they we're released, if Nintendo decides to go after you,......your just digging a bigger hole for yourself bro !! And please don't get me wrong, I am an avid emulator user, but certain lines should never be crossed, like emulating games from a system that is still on the current market. Not mentionning this could attract negative attention to older Nintendo emulators and punish everyone in the process. Really not a good idea !!
Yes, it is because you accept the license agreement. If you read the license agreement that you accept, it's actually worded in there, and if u don't accept the license agreement, then u can't install the game. But who the he'll is going to read over 10,000 pages
I live in a third world country and all I can say is bootlegging switches and PS4 and PS5 it's all they do here and they know how to get away with it because it's a cash business The rest is history
those are not really PS4 and PS5 consoles, this guy is taking nintendo switch consoles that you can still buy, modding them so you can play downloaded roms (and sometimes even pre-loading them) and then selling them. the switch is still being sold

This isn't a good one to take to court. Also if emulation goes to court and is deemed illegal there will be precedence and every emulator can be taken down due to the new case law.
Many WiiU titles are available on switch, so uploading WiiU roms and playing them on emulators is still wrong in Nintendo‘s view and quite frankly, the law is on their side.
One thing we can all agree with is- The switch eshop is awful! Really would love to see the eshop like the Wii U. Shopping on switch is like scrolling a pdf. Shopping on the wii u was like shopping in a mall with better music
This makes a precedent set legally and is likely negative for the entire emulation scene. This will make it harder for any future pro emulation litigation going forward.
I think Nintendo knows the Switch 2 is going up against other handhelds that are already out there that might be equal or better than the Switch 2 when it comes to specs. So they're doing all this because they know that the exclusives will be the only reason people will pick a Switch 2 over one of the others so that want to protect those at all cost.

He's selling items to unlock the Switch's potential. This calls into question the right to repair. If you buy a Switch there is no law, and should be no law, that forbids the user from modifying it, fixing it, breaking it, etc. In fact, legislation has been made to nullify any and all laws forbidding such things. But providing the games? Nah, that ain't gonna work. His answers are bad. He's f'd.
the laws allow you to fix your system (thanks to the lovely lawsuit that Apple lost for that one) but you can't modify the hardware that you own. currently only three states allow the Right to Repair law, California, New York and Minnesota
I really don't like how this drags everything regarding mods and emulation into the mud. If I buy a Nintendo Switch and Nintendo games and then dump a rom of these games and get the product key and firmware of my Switch to play on my PC or Steamdeck with an emulator to get better performance and install mods or run randomizers (especially Pokemon really profits from that), then that should be fine. I bought everything legally so there is no harm for Nintendo and it shouldn't matter to them how and where I play these games I bought from them (although I'm sure Nintendo would disagree but that's on them for not thinking logically). But what this guy is doing with preinstalled pirated games drags all of us down as well. This just sets another precedent for Nintendo as justification to ruin emulation and go after all of us who still buy their products legally.
