@@alexanderm8975 He didn't, he bragged on the internet that he could do it. You probably already know by now, but Talarico Studios are the ones that used the sound without paying for it, it was never his to begin with. Tommy Talarico is just an "entrepreneur" in the worst sense of the word.
I also want to point out that Tommy was more than happy to tell everyone he was the guy that did the "oof" sound for Roblox when he was tooting his horn in the Amico's E3 presentation in 2021. How we got from that to this I'm not entirely sure, but he was definitely willing to list it as one of his great accomplishments when he was telling us how awesome he was.
Honestly thats why he did it in the first place, he got jealous seeing how three fucking letters were on a game and took issue to it, it might be under copyright law but for once this is copyright i can't agree with
I fully believe those Roblox numbers. My 3 kids have been playing it for years. Their cousins play it, it seems like every kid plays it. Yesterday they were joking about this sound effect because it changed and apparently in the game they were playing the new death sound effect was being spammed.

Also, currently developers CANNOT buy soundpacks yet. It's an announced upcoming feature but it's not officially available yet.

I’ve seen so many influencers praise him without knowing the full context behind the situation. The situation really does not blend well with the Roblox communities position on Roblox’s recent decisions and general opinions. I want to do my best to be on neutral ground but the more I learn about him the harder it becomes. It’s crazy.
if they got it from a sound effects library on CD, high chance that the person Tommy hired originally to do the sound for a game also got it from a copyright free Library too and conned Tommy.
The original file has the correct information on it, making it come from the development of messiah. It is common for sound compilations to just dump sound files from games.

Yeah, this is another salient point, copyright law includes the caveat that you actively enforce your ownership rather than selectively to maintain it.

@Dan Smith well it's mostly fun playing with online friends or couch co-op. Even better if you are playing with someone who can suggest which game to play based on your interests. Many of the games are open world building and role playing where you can be a chicken, dragon, or other creatures. I usually log on because my kids want me to show me what they built. The micro transactions are everywhere and some games require buying a game pass to play.

I have kids & the "half of US kids are active users" sounds absolutely accurate. It's more like 90% from my anecdotal sphere, but I do understand there are a lot of families that keep their kids off online games & games in general, so it balances out. I personally don't get it, but the kids love it.
He is probably a bit skint from the Intellivision and this is his method of making bank again. It was seen with the office being stripped down, and he's not been fulfilling anything he promised with the Amico, as well as the bad press, so he likely just saw a golden opportunity in Roblox to dry them of some of their money.

According to Dot Esports it cost about $1 in game for the sound, now I’m curious if either Roblox was just fed up or if Tommy was asking for something ridiculous like $5-10 per user. Given what we’ve seen with Tommy, I wouldn’t be surprised by either one.
Everyone seems to be taking Tommy at his word that the sound effect was produced for Messiah. It's not outside the realm of possibility that they utilized a sfx cd for that game as well. Even a reasonable person could misremember something from the development of a game they worked 22 years ago, so I don't know why anyone would ever concede any point to a slimy character like Tommy without proof. Dude has no credibility.

I have a few cds from when I was younger that are 100s of sound effects and voices/noises per album (I use to do tons of prank calls with them in the day lol) but I specifically remember sounds loops and beats being included on all the albums by the band Pitchshifter which I have sampled many times b4

Whilst in cases of a freelancer developing a piece of work for a company in lieu of any other guidance it is the accepted precedent that the company owns the rights to it that's far from an absolute and that's just counting the USA. There are other issues like if the work is, in fact, copyrightable too. Other than its simplicity it sounds like there are good odds the creator had already produced the sound somewhere else for a sound effects library and reused that asset which would mean Tommy has the right to use it but does not own it. This is my best guess as to what the truth of the situation is but who knows? Tangentially, there are two interesting examples from the nerd world here: Joel Hodgson produced MST3K as an employee of Best Brains and didn't sign any contracts to the contrary so what he made was legally theirs, a dispute which was a large part of the reason he left the show when he did. However, Terry Nation wrote The Daleks (aka The Mutants) for the BBC under similar circumstances but British law works differently and BBC contracts didn't specify ownership at the time thus Terry Nation's estate still owns the Daleks to this day and they have to be licensed for use on Doctor Who. Basically the law is unbelievably soupy and ill-defined and that's why cases like fair use claims are almost always lengthy considerations made on a case-by-case basis. (Also even before the Amico fiasco Tommy had a lengthy track record of not respecting the copyright of others, so there's that too.)

Mario's "Wahoo" sound clip is a part of Super Mario 64's copyright like the textures and music and level models. Now who owns the copyright? Depends on the contracts, Messiah was developed by Shiny Entertainment and and published by Interplay and those company's rights have bounced around since 2000 (including to "Atari" in 2002-2006 lmao) and Shiny was shut down to be merged into Double Helix Games, who was later merged into Amazon Game Studios. It would be weird for Shiny to not own the sounds to Messiah, but SEGA does not own the music to Sonic 1 and 2, the composers do, so it depends on the contrast. There are also some protections for the voice actors themselves, but that's another rabbit hole. There is nothing in copyright law saying you are allowed to use X percent of a copyrighted work and it's free game, but fair use and factoring if it's a core element of the work or not do factor in. Like cutting out Paul's face from Abbey Road might be more in favor of infringement the a small section from the trees in the top left corner. But that's what you argue in court. I do wonder how getting it from a SFX CD would effect this, I think copyright infringement is one of those "Does not matter if you were aware or not that it was infringement, you are liable" but that does not seem right to me. But there is a lot I wish would be better about copyright laws, but my opinion is irreverent on the legality of it lol. I don't really blame Tommy for wanting the oof sound effect back, after all that oof is revolutionary. It's the greatest oof sound effect anyone has ever heard before. That oof will be the centerpiece of your sound board.

When you think Tommy couldn't get any more unlikable... things like this just keep popping up over time making it far easier to not root for the guy. as a parent I can definitely say that Roblox is bigger with gen alpha than Minecraft. Probably the most obvious reason is Roblox is free to play, Minecraft is not. Also Roblox is fully online and multiplayer in an easier and more accessible way than Minecraft. My kids enjoy Minecraft but no where near as much as they enjoy Roblox.
