@@shyguywearingtie5491 Oh I am not trying to state that this was a blatant hate crime on the contrary it’s more likely that it was not, however by his own statement he had those thoughts in the past, and there is the chance that it had some sway In his decision making in that tense instant, consciously or subconsciously, plus his seeming complete lack of empathy over the death of the person he shot could be argued to agree with that point but it is more likely that he simply didn’t care, he did walk into that situation expecting a confrontation and so in all likelihood he would have still shot even if the person who had shoved him was white, all I am saying is that for some reason, this person who was known to have aggressive tendencies and had used it’s presence to end verbal disagreements in the past was allowed to maintain legal ownership of the gun, he stated multiple times that if he did not have the gun on him at the time he would t have even considered starting the disagreement, I personally believe that he could be easily agitated, and in a sudden moment of violence directed at him from an unexpected angle placing him in a position of sudden weakness made him act suddenly and violently, even after it was clear the situation was dying down, was race the defining factor? No probably not, could it have contributed? Sure, of course it could have. But it is far more likely that he was simply a person who was easily angered and in that fit of rage made the decision to kill that person, because there is no doubt he shot to kill in that instant.

As a disabled person myself, I normally don’t care if someone is parked in a disabled parking spot if it seems like they won’t be there for a long time, especially a gas station where someone is waiting inside the car (usually a sign they are waiting for someone inside that is only grabbing a couple of things). There was no reason this guy had to escalate the situation like he did. I would have just been like “hey, I’m sorry ma’am, but I have a wheelchair and I was wondering if we could trade parking spots so that I could get to the sidewalk more easily?” It’s that simple.

Same. I have trouble finding parking at least once a week and I just have to go park at the back of the lot where there’s enough room or I drive around until a spot opens up. @lucycollins4879

I honestly really don't agree with that. My sister has an handicap ( mental handicap and not in a wheelchair) and we have the permit to go park in handicap spots She recently had an operation (she has big minimum 1 per year) and this time it was to her stomach and her ears, 2 different operation at the same time basically and idk the exact name of what she had to her stomach (she had it before tho and had an operation but it either didn't work or it simply came back) but yeah if she puts to much pressure on her stomach (example : by walking since she is overweight and pretty small) her stomach could burst and she would probably die. And maybe 2 minutes of walk don't seem much, but it was enough to kill her so I find it really selfish when people park in handicap spot since they're there for a reason). So for that, I think he was in his right to go check to see if they where well parked and go confront the woman to ask (politely) if she had a permit of some sort. Also when she actually got mad about him asking and threaten to get your husband ( insinuating to beat him up) was also not okay. However wtf was that shit?! like I get it, you where scared but bitch you took so damn long to shoot and in his heart??? the foot was in you face are your seriously aiming at that persons heart. Also the fact that it took about 3/4 seconds to shoot shows that he was aiming, and apparently in the heart which should be the lass place you want in an act of self defense against someone who push you ( veen if it was brutally). That man was far from you, yall where in public, you never fkg talk to that man he wasn't even the one scream at you, he was just a worried husband who push you since he just heard you ( a White 4 something dude) and his girlfriend ( a BLACK woman) arguing while his BLACK kids where actually in the back of the car watching all of it, and also being in probable danger. so yeah fuck that dude hopes he gets what he deserved.

I have a placard and a license to use disabled parking spots half the time I don’t even use it cuz it’s not that deep so I agree with you. Completely agree with how the prosecutor sums it up: "was he justified in brandishing his firearm to protect himself? Yes! Was he justified in shooting after the victim backs up? No!". Only in the US though are these situations lethal, in my country only hardcore criminals and people competing in gun ranges have guns and there's rarely any shootings. Even if want to own a gun for competing in gun clubs, you'd have to store your gun in a safe and have your ammo elsewhere. Lots of people are arguing the “who started it” thing. That he was pushed aggressively, so his reaction can’t be totally villainized. It’s true, the push seemed to be very aggressive; but we can’t know exactly how intensely he was arguing with the wife and children, it could have seemed very aggressive. BUT HERE IS WHAT IS IMPORTANT: Michael admits in this interrogation, and in fact says very clearly, that he would not have even approached the vehicle had he not been armed. This was not an act of good citizenship. This was not even self-righteousness. He approached and confronted a woman and her children in a car, fully expecting the possibility that it would end with him shooting someone. He’s a coward, and he’s far too unstable to have ever owned a gun.

@Oakest
@Oakest 3 года назад
I think saying he wouldn't approach the car without a gun is a terrible argument. Would you be more likely to say your mind if you're a 7 foot MMA fighter or if you're a 5 foot asthmatic? Americans state they need their guns to feel safe, and if you feel safe you don't worry as much. I bet you would much rather say no to a 6-year old than a drugged out methhead with a knife. If the kid lashes out, you're safe. If the methhead lashes out, you might die. He had a history of threatening with his gun, thus used to ending "altercations" by the mere presence of his gun. He knew his gun could end fights without there being a fight. There is no evidence which points to him expecting to actually use his gun, until he's attacked. I think it's possible he was terrified as he usually feels safe because of his gun, which allowed him to feel even more threatened by the initial attack. If he panicked a step backwards could seem like a step forward and 2.5 seconds could feel like 0.3 seconds. Now, I'm not saying he's a great guy by any means, but try to look at this from a different point of view.
@rosyrue6400
@rosyrue6400 3 года назад
@@Oakest I definitely see your perspective here. Especially with the provided footage, it’s easy to see him being terrified and disoriented for sure. I guess what really rubs me the wrong way, is how absolutely not remorseful he seems. He doesn’t seem traumatized or shaken up in any way, he’s absolutely confident that he won’t get in any trouble. If you shot someone out of total panic and fear of your life, would you not, after knowing the full context (being that he was actually backing away) be horrified at the reality that the man didn’t need to die?
@sithassassinstl7864
@sithassassinstl7864 2 года назад
@@rosyrue6400 He actually believed what his version of the events. There is not 1 second of remorse because he doesn't think he did anything wrong. Where is argument falls through and it became murder is when he drew his weapon and his "attacker" backed away. At that point the threat was neutralized with out pulling the trigger. And people who live in cities like Jacksonville understand the I would never have said anything if I wasn't armed argument. Then pulls his other hand out of "sling" acting like it hurts to move yet no visible signs of pain. Its also important to note in the law, that drawing a weapon and firing a weapon are considered separate self defense actions. Drawing a weapon is a nonlethal defense and would be exeptable response to being agressively pushed to the ground. In this case you'll notice that drawing the weapon worked therefore there is no longer a threat. There are so many problems with the "why didn't they just shoot them in the legs?" mentality. 1.) It isn't even safer for who is shot. Being shot in the legs is actually a very lethal location due to the probability of hitting major arteries/bleeding out. 2.) If you are actually in a life or death self defense scenario, you're every intention should rightfully be to stop the attacker whatever the cost. That typically means killing the person. There are countless examples of attackers/whatever eating non lethal shots and going on to kill others. That being said, if the attacker is stopped without being killed, that's the best case scenario. 3.) In a split second decision where you are shooting to save your life, you should not be attempting to hit smaller, moving targets. If you try that and miss your shots, it could cost you your life. 4.) For the same reason above, attempting to hit a more difficult target increases the possibility of people or property not involved being hurt/killed/damaged as a result.

Secondly, obviously you can survive being shot in the chest...I don't see at all how that is a counterargument to what I said above. I mean, he literally said it himself, in his initial interview...if the victim was backing away, there was no reason to shoot. He knew that, he shot anyway. As demonstrated by the previous incidents, where he threatened others with his gun, and of course, by this tragic killing, Michael Drejka is a man who had carried a gun most of his life, as he says, and was increasingly determined to use it.

As a gun owner, it's important to understand that circumstances change when a firearm is introduced to the equation. Someone trying to kill you will have a change in motivation the second they see you're armed, meaning they'll no longer be a reasonable threat to your life by retreating. However, a firearm can also have the opposite effect, and increase the motivation of your attacker to hurt/kill you, so you have to act fast. In this case, it's not the latter, he had too much opportunity to comprehend that the threat was no longer active. It's also important to not overlook the assault itself, because the man initially was not backing away, he continued to approach the grounded man. Of course we'll never truly know what would have happened if no gun was involved, but the behaviour in the footage greatly insinuates the assault would have carried on. Regardless of the intent or what could have happened, firing the gun wasn't necessary in that moment, which is why he was found guilty. Do not assault people, and do not carry a firearm if you are incapable of evaluating threats.

"Why didn't he shoot him in the leg or something? Why did he shoot to kill?" The reason is 3-fold: First, in an actual self-defense scenario, successfully hitting a 4-inch target while it is moving would be nearly impossible. You will miss, and you will be dead. Second, even if you did hit the assailant in the leg, it would not stop them from attacking you. Unless you managed to shatter their kneecap, they would not even feel the bullet until a few seconds later. They will still get to you, and you will be dead. Third is the legal argument: a prosecution can easily argue that if you had time to shoot for the leg, your life must not have really been in danger. Similarly, they could argue that since you only sought to hurt the target, not kill them, the perceived threat was not great enough to justify shooting at all. The bottom line is, ONLY shoot if your life or someone else's life is in IMMEDIATE danger, and ONLY shoot to kill. This guy neglected the first part of that equation.

Kind of, the consensus required to amend the US Constitution is colossal effort so all existing amendments might aswell be chiseled into stone. Admittedly, while some of the founding fathers dueling fanatics, the whole "well regulated militia" bit was more along the lines that said firearms would be properly stored and managed, rather than perpetually strapped to your back like modern interpretations. Gun ownership in the United States tends to drive a lot of these confrontations over the edge of an argument to Judge Dredd scenarios.
@Ilicet

@@nm2358 Washington and many others believed an individual should be trained and armed from childhood on. There are very few gun homicides in the US vs crimes prevented, and considering how many fire arms we have, there are very few firearm homicides at all. Especially if you remove the gang shootings from the stats. 80% of all gun violence in the US is attributed to gang violence. The CDC estimated 300,000 - 5,000,000 violent crimes are prevented do the brandishing of a firearm. And as far as your uneducated 2nd Amendment remark, it's sole intention was for the People to be armed against their government. They had just won their freedom from a tyrant, and wanted to make sure that would never happen here. That was the intent, and that is the purpose of the 2nd Amendment. A well regulated militia = well armed, and trained populace. The people are the militia, not the National Guard.

Ben James is that why, of all first-world countries, the US has the leading number of annual firearm-related deaths by far? Many of those being school and mass shootings? (Only third-world countries, especially countries that are in constant civil war or have high poverty/crime rates, are higher on the list than the US). It's gotten so bad that many, if not most, schools have security guards and school shooting drills now. Unless you think it's great that so many Americans (about 40,000 people per year) are dying to guns, saying nothing should change is foolish. People do have a right to bear arms and should be able to, but thousands of people abuse this right every year in order to take innocent lives, and without government intervention, the lives lost per year is only going to increase. Guns should only be in the hands of responsible gun owners; that's the point of gun control, not to "ban guns" as opponents of gun control make it out to be.

I hate the argument of "why didn't he just shoot him in the leg" it's such an uneducated and ignorant argument. Lethal force is lethal force if you are going to use it, it is implied to use it to eliminate the threat as swiftly as possible. Shooting a leg would not only fail to stop him from potentially attacking but also has a chance to leave him to just bleed out or if he survives he can likely never recover the same. There is no nonlethal way to shoot someone, and shooting extremities is difficult especially when moving.
