The family of Maya Kowalski, the subject of Netflix’s “Take Care of Maya,” allege that a report of child abuse from Johns Hopkins All Children’s Hospital led to Beata Kowalski taking her own life. The Kowalski’s are suing doctors, the Department of Children and Families, and Johns Hopkins All Children’s Hospital for $200 million dollars in connection to Beata’s death. According to court documents, the child abuse case against Beata was pushed forward after Maya’s physician confirmed her condition, complex regional pain syndrome, was not the fault of her parents. During the time Beata was separated from Maya, she took her own life.

my story is nearly exactly like maya’s. i have crps, went to the same exact hospital just a year or 2 later than her, and still had to fight really hard to get them to prescribe me ketamine to get me out of my quadriplegic state. thank god they didn’t seperate me from my family (likely bc they were already battling maya’s family) but i heard them talk negatively about me and my family. they also told me it was all in my head, and told me to get up and walk while i was paralyzed in a wheelchair, bc they didn’t believe me. i had to fight to get my meds. i then saw dr. hanna like maya and he saved my life. maya’s situation saved my families lives, but i wish none of her family had to go thru that. i thank maya so much for raising awareness about crps and for fighting so so bravely for the justice they deserve.

This is a teacher who teaches because she loves children. She is a teacher with heart and passion who will be remembered by MANY of her students for many, many years! The world needs more teachers like this one. ❤

*Maya's teacher* 💜💜 For a time this woman was Maya's one and only lifeline she had (was allowed to have). She was her friend, teacher, advocate, mother-figure, all of it. Driving 3 hours a day to braid her hair and paint her nails, console her when she needed it, whatever she could do, she did. I'm sure Maya's parents were so incredibly grateful that their daughter could at least have one person there for her, when they were prevented from doing so. What a saint ✨

Absolutely HORRIFIC that the hospital refused Uncle Bobby visitation rights, even though he had been approved to visit Maya, if only to give her the comfort of family and a familiar face. How dare they!! 😡 Their lawyers frantic objections speak volumes.

@biglil711 If he wasn’t an approved visitor, that aids the hospitals defense that they were just following the law and the situation was out of their control. I don’t understand why they would object because it seems like it would help them? It makes me think they didn’t want to allow this line of questioning to lead to something else but I don’t know what. Any ideas?

I pray that the Kowalski family finally gets the justice they deserve after all these years of battling John Hopkins All Children’s Hospital. Beata was not only Maya’s mother, but her number one advocate. This is truly a mother’s love for her child who tried so hard to keep her daughter out of pain. Thank god Beata documented everything Maya did, from doctors appointments to every single ailment she suffered. I can’t imagine how many other families have been affected by this hospital. I truly hope this hospital is found negligent, and the jury finds in favor for the Kowaski family. The correct care for Maya should have started immediately when she was hospitalized. RIP Beata. 🕊️

Do you know anybody who has Munchausen's by Proxy. I saw it up close and personal in a friend and her mother. I had to distance myself from that family because they were so dysfunctional. Do you know what That mother's background was? Nursing !

I feel so proud of Maya for doing this for her mom, and her family. At the same time my heart breaks for her, to have to sit through this and have to endure through the absurdity of the red tape that happens during trials. Praying for you Maya and your family. Rest easy Beata.🙏

The closeness of this family is truly incredible... to see the smiles of the brother and friend are so heart felt. My heart breaks for Maya, her family, and everybody involved. This NEVER should've happened. I don't think I have ever wanted a family to win a suit, so badly before. 😢

The tenacity, perseverance, courage & absolute dedication of the Kowalski family to finally get to this trial is truly remarkable & inspirational. They are the face of thousands of families who have been decimated by ‘the system.’ Beata’s spirit is so strong in this courtroom. She was an incredible woman who was guilty of being a wonderful mother & doing whatever she possibly could to care for her family. Justice must be served. Beata needs to be vindicated & RIP & this family to finally be free of being f-ked over. They’ve suffered enough. As a chronic pain sufferer who has been through the mill with Dr’s & hospitals I’m angry & sad as this case hits close to home.

As much as the chat boards are filled with posts from adults who have chronic pain issues and feel they have had awful experiences with the medical system, I'm surprised that I have not seen anything from the parent of a child with CRPS. It's all adults. Not one parent talking about their experience with their child. Strange

It's a teaching hospital that means your not necessarily getting the teacher sometimes you windup with the student. All hospitals are a business they cover there butts first and foremost.

The hospital has been fighting to keep this out of court, delaying this as long as possible, using the appeal courts to delay it. This to me shows the hospital knew it was negligent.

They delay and appeal on every case I would imagine. Most people give up because they can’t afford the fight. That is what the hospital hopes for.

The teacher’s testimony is really off putting. The workers aren’t their to be her friend. They are busy and she is mad that they didn’t have a chipper personality towards her? Also maybe some of them didn’t want to interrupt their time. I’ve had very sweet nurses who were more matter of fact in and out when I had visitors. Not everyone is Rose Nylund, that doesn’t mean they aren’t good and caring people.

The hospital definitely had cause for concern. What CPS did after the hospital raised the red flag is on them not the hospital. The hospital was responsible for Maya not Beata’s mental health.

@@margaretkoziel1643 I would hope anyone with true reason for concern would speak to protect all kids. I haven’t seen all the evidence so I can’t say if her mother was right. She obviously didn’t continue the treatment her mother was demanding and yet she had gotten better so maybe she wasn’t right. Even the best doctors aren’t allowed to treat their own family. Her judgment on the medicine she was demanding should have been questioned. Really I just hope Maya and her family find peace regardless how all this turns out.

As a nurse, what I want to know is how you don’t believe she has CRPS but yet you used the ICD code for CRPS to charge the insurance company. That’s what I want to know! That’s criminal in itself. Not to mention what you did to this child and her family.

OMG! I was thinking the same and the lawyer made a comment about how the family paid nothing and the insurance didn’t have a problem. Medicare will have a problem with this and hopefully the insurance sees this! Also, he made it sound like there were many diagnoses on the chart, of course there is but what matters is the billing DRG and CRPS is the one they chose!

I think the real culprit was Dr Sally Smith and DCSF more than the actual hospital. She and her organization should be on trial, not just for this case, but the dozens of other cases where she wrongly accused parents without even reviewing all of their previous medical records. The hospital in question almost had their funding stripped a few years ago for egregious violations for endangering patients including leaving a needle in a small childs heart after surgery and 1 in 10 of their heart surgeries ended in fatalities. In this case though, while they had very unprofessional and unkind medical staff, they had to follow the court orders based on Dr Smiths report. Very complicated case. Further, NHS has conducted studies proving that ketamine treatments for CPRS works extremely well for a lot of patients. Beata didnt just pluck this treatment out of thin air.

All of this is true!! And I’m so glad to finally see someone comment who has researched this hospital’s history too! With one exception, the hospital also deserves to have this lawsuit against them. The hospitals legal team and all the ones in charge controlling what goes on in that hospitals walls knew this was happening. I think that every last person who’s name is on Maya’s hospital chart would be included with this lawsuit Eh! I hope they go after DCSF when they’re done with the hospital.

Smith and her employer sun-something settled out of court for 2.1 million I believe. I definitely agree that her part in it was large and that’s likely why they settled. The hospital may have felt that due to her exclusion they may have a better case but I do not believe that other hospital staff were not culpable in some way and that deserves to be decided.

It’s hard to listen to some of this testimony made worse the shuffling of papers. They had a lot of time to prepare for this case the plaintiff lawyer seems a little unprepared. I wasn’t going to watch the Netflix documentary until after the trial but I did. That thing Dr Smith is the real culprit. I think the hospital was right in make the DCF report but unfortunately DCF screwed it up. I say DCF although they had the services they are responsible. DCF is always in the crosshairs. They get blasted if they do something or blasted if they don’t do something. It’s one of the saddest stories I’ve ever heard. The poor mother was right which makes it all the sadder because as she took herself out of the equation Maya’s journey home didn’t take long. I bet the judicial system only let this case forward because they knew Netflix was to throw this case into the limelight big time. So far I like this judge.

The fact that Maya’s mother had to end her life to save her daughter life is beyond heartbreaking and terrifying at the same time. This hospital is disgusting and Sally Smith needs to be taken to jail and should face criminal charges for her actions which ultimately led to this tragedy.

That public defender commentator is nuts. John’s Hopkins should have picked up on Maya’s dystonia, as well as, other pertinent clinical signs. That hospital, DHS and all offenders stomped on that girls rights. I’m a retired RN and RCPD is horrific. I hope they get a judgement of more than they asked for.

The documentary about Maya was the most horrifying thing I have ever seen. What an amazing mother to sacrifice herself for her daughter but it should never have been necessary. I hope this family gets the justice they deserve. The trauma Maya especially has gone through cannot be undone and that social worker needs to not only lose her job but be locked up.

It’s also noteable that punitives were allowed to be asked for, the judge saw something worth punishing, hope the jury sees that evidence to the burden of proof and understands the judges instructions of the law.

The judge didn’t start the case until it was taken to a higher court to decide if punitive damages could be used. I don’t think this judge understood everything at the beginning because he didn’t seem to want to move it forward. But once the case began he saw clearly and was an excellent judge!

I have noticed how the guy who I presume is the leading lawyer on Maya's side is all the time leaving sentences unfinished, saying "Strike that" and re-starting again. A lawyer should have a certain degree of oratory prowess, I would say.

I mean calling her ketamine girl, predicting beata was going to kill herself.. this shows the nasty streak that runs through those doctors. Justice for beata!

Yes also it could be said the hospital method took 9 months of further pain and time consuming therapies versus the drug treatment which gave much quicker results meaning less pain for the patient . Having your child in less pain is always going to be a option that any parent would at the very least consider and many would go opt for.

In the US we are supposed to be innocent until proven guilty. In this case, Beata was deemed guilty by those who are not even professionals in that field and yet DFS and the Court System upheld their 'opinion' that decimated an entire family without an inch of proof. This is so sad and unfair. I intend to watch this entire case through its end and conclusion. Its sad that families who are never proven guilty are marred for life and have to nearly bankrupt theirselves to fight to prove their innocence. This is what happens when family welfare systems are privatized....cases are manufactured. This whole thing wreaks of money.

I’m not comfortable with the doctors being witnesses and “corporate representatives” that are allowed in court. I believe the plaintiff’s counsel made a great point about bringing their own doctors in on a rotation is the same thing. I wish I could say I believe the judge is impartial but I can’t so far

Yes. During the time Maya was in the hospital, her father was interviewed and they posed the question something to the effect like, If your daughter was released tomorrow and the court ordered that there was to be no contact with the mother, would you agree? And he said yes because that’s what you do, whatever is in the best interest of the child. He never in a million years thought his wife would take that to heart and she became deeply depressed. She ultimately took herself out of the equation. I hope the Kowalski’s win this case.

John Hopkins should have saved face and paid this poor family for all the bs and trauma they put them through, this trial, no matter how it ends, does not show them in a good light, I don't even live in FL but would NEVER take anyone I love to this hospital, or any hospital related to them! They should have settled out of court and paid for the mistakes made by their staff or whoever made the awful mistake of putting this family through this tragic situation, especially on top of what they were going through with their daughter's illness. This is a clear example of a hospital thinking a parent's rights and beliefs are not important and that they know better than a parent who is invested and truly loves and wants what is best for their children.

There were several doctors and nurses who disagreed with Dr Smith from social services, but not one of them stepped up to help this family. I remember being a child and getting extremely homesick at camp and at a relative's house. I can't imagine how Maya felt in the hospital completely cut off from her family, and especially her mom. Three months is like an eternity at that age.

I completely understand when the teach said “ She really needed academics. No matter what was going on with her medically, she loved school. “ My son is the same. He was in treatment, last year, for high risk acute myeloid leukemia. He fought and advocated for himself to have access to his Honors and AP classes. We all worried it would be too strenuous especially when the effects of the chemotherapy were at the worst. But it was that academic focus that helped him not slip into a depression. Now he’s 9 months post bone marrow transplant, back in school for his junior year doing AP and Dual Enrollment.

The reason they are fighting it is because 200 million would decimate their reserves. Hospitals aren't charities but they also don't function like normal businesses. I've worked in hospitals and Healthcare for 10+ years and have been in senior mgmt positions. Hospitals are disingenuous and most only care about profits, not people.

So many have watched the documentary so have no interest in actually paying attention to the defense. So far everyone is mad at the hospital for taking Maya off ketamin and the child protection officers for preventing her Mum from seeking more ketamin for the child. Many are so caught up in the documentary, that they don't care that Maya was not getting better with ketamin but was in a worse condition. Severe Constipation from painkillers is harmful. So most apparently have ignored that. Including her Mum. That is one reason they weaned her off the ketamine and trying a different kind of treatment. Nothing abnormal about that. Wanting to put the child back on the same course of painkillers, which did nothing for her is abnormal.

This case reminds me of the oil of life, Lorenzo's Oil. I understand the family's need to try any treatment, accepted by the medical profession or otherwise. But on the other hand that desperation only leads to scams and unproven theories that won't have the same great effect on everybody else. With Lorenzo's Oil there ended up being loads of scams, and then it didn't work as well in other patients. And in fact it ended up not working in Lorenzo's either.

I know ppl are gonna come for me in the comments but this is jmo after watching the 2 days in court so far..Im glad this trial is gonna show and tell us BOTH SIDES! Netflix (their documentaries are known for this) only showed the Kowalski’s story. Im not saying Maya was making all this up, and Im def not saying Jon Hopkins wasnt in the wrong but Im listening to Kyle on the stand and his lawyer is asking him “Were there days Maya felt great and got up and went to the beach?” Yes.. “Were there days she just didnt feel like getting out of bed?” Yes..To me if I was a juror I would be sitting there thinking well she did just lose her mother, she is a teenager and teenagers go thru a lot of moods and emotions every single day, she has been thru so much as a child Im sure its taking a toll on her mentally and physically, So basically what Im saying is I dont think their lawyers are making a great case for the Kowalski’s so far! I dunno, maybe its just the lawyer (i think he is horrible if Im being honest). This family has been thru so much hurt I wish them luck and love for their future whatever the outcome of this trial!

I was disappointed in Maya's lawyer's opening statement. He should have come out swinging and been organized and concise. This case makes me infuriated for Maya and her family. It's devastating. I don't feel like the lawyer conveyed what happened to them very well. If I was a lawyer and had this case, I would have practiced my opening statement over and over. I sometimes wonder if lawyers get stage fright knowing that it's on TV. The younger lawyer seems to be doing better than the older man. I also think a female attorney may have been able to convey the emotional distress that Beata suffered better.

Why rule out the argument between the parents as evidence? The jury needs to see the divide the hospital and parties caused between this loving family. They tried to turn husband against wife when they needed eachother most! Disgusting and something the poor husband will regret for the rest of his life. Fight for it all Maya!!! ❤

This poor family. The hospital & team should be absolutely ashamed & ashamed they are making them relive it all in the court. Ashamed that they tried to turn Maya against her own mother saying she was in a mental hospital when she was at home, not letting the uncle going to see Maya in hospital. That they billed for an illness they were convinced Maya didn’t have but happy to take the money!!! Disgraceful disgusting makes me so so mad 😡😡😡😡😡

I feel the conspiracy and corruption that the judges are showing to protect these Doctors is disgraceful. Maya and her family are awe inspiring and inspirational. The way they and other families have been torn apart is beyond vile and disgusting. These Doctors and judges are all about protecting themselves and furthering their own careers as they tear apart innocent peoples lives. I hope Maya and her family get the justice they deserve but it will never bring back a mother back. The professionals have blood on their hands.

The defense attorney’s objection to the video showing Maya riding her bike-she’s not sure why they want to show the video and too many other people in the video?! Lame! They’re really desperate aren’t they! I’ve watched a lot of the videos and am now starting at the beginning and I’ve never seen so many objections in a court hearing in my life! Anderson can’t get through anything without an objection! Even his closing arguments! If I was on the jury I’d be seeing this as they definitely have something to hide and don’t want the truth coming out.
