Maya Forstater, who was platformed by Harry Potter JK Rowling for her anti-transgender "gender critical" views, recently won a court case in the United Kingdom which has many transgender folks concerned. So let's go over why.

I wholly disagree that rejecting intolerance is in any way hypocritical. The only way you can justify that is by reducing the doctrine of tolerance to a universal axiom, rather than what it is; an effort to protect vulnerable groups and ensure equality and equity for as large a number of people as possible. To do that we need to push back against and stamp out horrible ideas like those of TERFs and Christian fundamentalists. It's like the old Libertarian saying; your right to swing your fist ends at my face.

The idea that we should tolerate tolerance is just a stupid one which comes from the same entitled fucks too emotionally unstable to live in actual society without it feeling to them like stalinist russia who probably also cried wolf when a kid they bullied punched them in the face and beat them up for the entire school to see, rightfully soo. I'm not allowed to beat people up who provoke me and attack my human dignity because of white fragility, what else do these people want? At one point, we should come to the conclusion that these kinds of people can't be live with the rest of society and probably should be locked up somewhere in some kind of institution because they are too emotionally fragile to interact with real life. Look at J.K. Rowling. She whines like a fucking child because people on the internet disagree with her and say occasionally mean things to her because it makes her sooo oppressed and persecuted. I'm a trans women who grew up in an environment where you don't get any respect from anyone if you couldn't take being shit talked or handle a punch in the face with a semblance of dignity. What Rowling displays is just white middle class fragility, thats why people of color usually don't take whites serious as functioning adults, because many of them are simply not. And thats why I'm not refering to Rowling as a woman anymore, I call her a girl. To be considered a big woman, she has to toughen up and not act all disturbed and traumatized over some internet critics. And yeah, I even defend people who insulted her: If you shit talk people, you have to take being shit talked back, its as simple in the real life outside of cuddly rich white safe spaces.

From the judgement: "That does not mean, however, that those with gender-critical beliefs can indiscriminately & gratuitously refer to trans persons in terms other than they would wish. Such conduct could [...] amount to harassment of, or discrimination against, a trans person." “This judgment does not mean that those with GC beliefs can ‘misgender’ trans persons with impunity. "Fun" part about the Judgement and the WHRC declaration. The declaration would likely fail the Grainger Criteria (the legal test for protected philosophical beliefs) that led to Forstater winning the appeal in the first place because of that "elimination of transgenderism." Being transgender is recognized as intrinsic similar to homosexuality in UK law. Therefore "elimination of transgenderism" would be comparable to elimination of homosexuality and not be protected by the low bars the Grainger Criteria lists (it doesn't protect beliefs akin to Nazism including elimination groups of people or their general legal standing.) P.S. Protected beliefs aren't protect speech. You have the right to Christian beliefs without the right to evangelize.

Forstater seemed to think that they were free to harass people as part of their beliefs. Paragraph 90 of the original judgement:- "I conclude from this,and the totality of the evidence,that the Claimant is absolutist in her view of sex and it is a core componentof her beliefthat she will refer to a person by the sexshe considered appropriate even if it violates their dignity and/or creates an intimidating, hostile, degrading, humiliating or offensiveenvironment. The approach is not worthy of respect in a democratic society."

I feel like this mirrors other arguments I've heard, such as how people use "freedom of religion" (by which they mean christianity) to push anti-abortion legislation and LGBT discrimination policies. ....to me, I think, are they really about freedom of religion or are they just using that to go after other people?

Yup. I'm an Orthodox Jew. Abortion is not a simple thing to us. Different rabbinic authorities have diverse opinions, pretty much none of which are 100% pro or anti choice. And the conclusion a rabbi comes to about any particular case is totally situation dependent because the religious laws involved get incredibly complex. Are there times when a person seeking rabbinic input will be advised against abortion? Yes. But there are also times when that person might be told by the rabbi that they MUST abort. Anti-abortion laws fly in the face of religious freedom in those cases. Which is why all religious arguments for abortion legislation of any sort should not be considered by secular governing bodies.

There's good reason for you to draw comparisons like that, as TERFs in the UK are closely aligned by American groups (like the Heritage Foundation) that use "freedom of religion" as a bludgeon. They fund each other, use each others' communication channels, help each other coordinate events, and act as speakers at each others' events. You can even see them making it look like their respective groups are bigger if you pay close attention to what transphobes are saying on social media. For example, if you see someone with a MAGA-plastered account saying something like "women's sport" instead of "sports," you know that's a British sockpuppet. Whenever I call it out, suddenly the comments vanish because they know they've been caught.

As someone currently attempting to transition in the UK it is incredibly daunting being bombarded by all these legal declarations and general public statements by ‘GCs’, including from the current equality minister, it just makes me feel unsafe coming out to anyone and even discussing the matter with my GP in order to secure a referral. On the bright side, even with this ruling I doubt Forstater will be able to change the outcome of the previous case, as technically even if her transphobic beliefs are protected and were the sole reason for her being let go (which already ignores that the manner in which she was expressing those beliefs, including misgendering her boss, was creating a hostile work environment), legally all that happened was that her employer did not renew her contract, which they don’t need any reason to do and therefore can’t be contested as unfair, they employed her for as long as they were obliged to.

The transphobic hysteria happening now in many places is insane. And my country has homophobic hysteria too. Imagine feeling threatened by the fact that minority of population wants to live their life normally and not be mistreated. Reactionary people constantly speak about "family values", "traditional values", as if they are forced to changed their lives, while in reality they themselves want to force other into the heteronormative lifestyle, and feel threatened if they are unable to do so

No one's trying to tell them they can't get married or have kids or what to believe or how to dress or etc.? But somehow they still perceive themselves as victims. @@dorianr4770 in my country that is the whole focus of policy by government now. They want to make more homophobic and transphobic laws, and restrict women's access to abortion. Plus some politicians suggested labelling feminists and childfree as hate groups. Seems like someone wants to make people reproduce against their will. Apparently, that is the only way to solve population decline, which is a result of terrible healthcare and ignoring the covid pandemic

I needed to see this video. I'm a trans woman in the UK, and when I heard about the Maya appeal win, I got myself so worked up and scared. And whilst I definitely have reason to be concerned still, it was good to hear a more measured response to settle my panic somewhat. I do still need to remain wary and watchful, but it's good to know that this might not be the life destroying moment I'd worked myself up to believing it was.

I think the worst parts about Terfs, is they are one form of Minority, discriminating against another. Thats worst than just normal discrimination, because you would think and hope they would know from their own possible discrimination that they see in their own social lives. It would allow them to experience empathy and equality for people that arent them, the same way they want empathy and equality from people that arent them.

@Fck Utube eh, black supremacy targets minorities, but it also targets a dominant oppressor group, so it’s not quite as purely bad as TERFs are since TERFs target minorities exclusively, and minorities can’t defend themselves nearly as well as non-minorities c.x That said, I totally agree that hating any people just for existing is bad :) I guess I just wanted to say this: Black supremacy is cringe, and TERFs are super-omega-cringe-af :)

@Fck Utube - I think it's intellectually dishonest for you to place "black supremacists" in the same category as TERFs. Most black supremacist ideas formed in direct response to white supremacy and oppression, in which black people were often not even viewed as fully human. I'm not saying that makes any form of supremacy ok, but one can at least understand how black supremacy could form in response to and as backlash against white supremacy. If one group is constantly and systemically oppressed by another group, then you shouldn't be surprised when the first group fights back, even if you don't like the way they choose to fight. TERFs have no similar equivalent of oppression from the trans community. What are they fighting back against? What exactly have trans women done to them that would warrant their hatred and discrimination? While women are technically considered a minority (despite being 50% of the population) due to not sharing the same power, privileges, opportunities, etc. as men, it is important to keep in mind that many white women have not encountered the level of discrimination that other minority groups have dealt with. The majority of TERFs appear to be cis gender white women who, quite frankly, enjoy a level of privilege second only to cis gender white men.

I do too believe in the Paradox of Tolerance, proposed by Karl Popper, where absolute tolerance would mean tolerating the intolerant, who will be able to use the excuse of "everything is tolerated" to seize power, and eliminate tolerance. Thus, we must not tolerate the intolerant, or else they would destroy tolerance.

The way I always look at it is, all of us have things we believe are intolerable. We are not flipping a switch on and off, where either everything is tolerated or nothing is tolerated. We are all haggling over where the line in the sand should be drawn, at all times. Most of us on the pro-LGBTQ side of things tend to think that the line should be placed between things a person can change, and things a person can't. A black person can't choose not to be black, but a racist person can choose not to hate them. A trans person can't choose to feel comfortable as their assigned gender, but a transphobic person can change how they regard a trans person. The disconnect is that transphobes do not see being transgender as an immutable part of who we are. They see it as an ideology we are pushing. In their minds, it's one belief versus another. But to us, who understand the irreparable damage that repressing gender identity can do to a person's psyche, it is absolutely not the same. It is an ideology asking people to harm themselves.

However, that’s not true for everyone, because there are people out there too stubborn, arrogant, vindictive, willingly ignorant, and/or hypocritical to change their ways, even if those ways are false, directly harmful, and/or incompatible with the rights and freedoms of others. I tried arguing with those people, tell them why they’re wrong and how they can be right and all it did was expose me to more and more of their bile. I try to sympathize with everyone, but eventually you’ll cross a line, if you continue defending your repugnant delusions, and all I can do is expose you. Let the world know how awful you are, now that you’ve revealed it to me. I believe that everyone is free to do whatever they want, as long as they don’t go out of their way to harm others.

@@DrTssha But that's not true, most people still believe and are taught the war was about slavery. Look up the original constitution of the US, it's called the articles of confederation, we were a confederation first. The war was between confederates and federalists whome wanted a federal government, the emancipation of slaves in southern only states was a form of sanctions against the South to hurt their economy, they also sanctioned them to not be able to sell and trade to the British isles and Europe.

Maya Foreskinner has no leg to stand on, legally, against her "dismissal", i.e. her contract not being renewed: She harrassed a co-worker. It was never about her beliefs, it' about her ACTIONS and BEHAVIOUR, which are subject to her employer's code of conduct, no matter how long she holds her breath and stamps her foot and plays the victim in every media outlet that will give her the time of day, which are entirely too many, sadly...

I cannot speak on all aspects but some TERFs only defining women by their reproductive organs and hormones can also be uncomfortable to cis women with hormonal conditions or who struggle with infertility.

tl;dw: Maya Forstater appealed the ruling that her "gender critical" views were unworthy of protection and won. Now they are, in the UK, protected. However, that protection doesn't extend to actions; you still can't harass trans people in the workplace and have that action be protected. I think that's the core of it?

It's probably best not to say "transgenderism". ism /ˈizəm/ noun a distinctive practice, system, or philosophy, typically a political ideology or an artistic movement. Being trans isn't some ideology or whatever. "Transgenderism" is a nonsensical term. Trans people simply identify as something. It's not some system or philosophy.

I'm not sure if "something feeling wrong = it being wrong" is the best way to think about this. A TERF could easily turn around and use the exact same argument against you. Trans people deserve human rights because they are human beings. I wish that felt as intuitive to everyone else as it does to you. If you're getting into these topics, maybe it would be a good idea to look into the reasons why trans people having rights is a good thing, rather than just using "it feels right". That way, if someone tries to argue with you or starts saying transphobic shit, you'll actually have some ammo.

The outcome of this part of the court case seems to be that you can't be fired for having the opinion that trans women aren't women, not that harassing, misgendering or discriminating against trans people at work is legal. That seems to make sense to me. I don't see why people should be fired for having that opinion, if they're making a problem about it in the workplace that's a different issue.

I'm a trans woman living in the UK. I can't count how many times I've been verbally & physically assaulted, over the last 10yrs it's resulted in me having PTSD & agoraphobia. It's getting worse here, much worse. The majority of our media is more than happy to platform anti trans views. In the first 144 days of 2021 the Times printed 233 trans related articles, that's almost 2 per day for 1% of the population & that's just one of our right leaning national newspapers. Our government is is definitely anti trans (Plus racist, abelist & classist). I'm saving for facial surgery but am now considering using that money to run to a safer country. I wouldn't want to be a trans women living in the UK *looks in mirror* "oh crap!"

Forcing people to be in the wrong body and forcing someone to go through a pregnancy is both a traumatic loss of bodily autonomy. Feminists, and likely some terfs, fight for afab people to have access to abortion and therefor ownership of their own autonomy, so why cant terfs see the obvious parallel between the struggles of afab people having access to abortion and the struggles of trans people having access to gender affirming healthcare? There are many parallels between the struggles of afab people and the struggles of trans people, almost like terfs are projecting the struggles their sex have went through onto trans people, or they're just repeating history due to not seeing the obvious. Another similarity is saying gender affirming surgery that can leave someone infertile is mutilation on that basis alone even though most trans people know the risks of gender affirming surgery and still enthusiastically consent to the operations with most experiencing a significant increase in quality of life, as if being fertile and able to have kids is the most important thing about a person, even above their own comfort and happiness. Doesn't that sound similar to when an afab person's capability and expectation to have kids was the most important thing about them, above their own wants and needs, like whether they even wanted to have kids biologically or at all? Yes, the fact of sex is true, kind of like the fact that afab people are technically weaker than amab people. Remember when facts like that were used to deny afab people opportunities, because the belief in them being weaker was exacerbated and put into rule in many fields of life, With the fact of weakness being weaponised in the past just like the fact of sex being weaponised now? I'm gonna try and ignore the comments, because I don't have the energy for a "debate", I just wanted to put my two pence in. This is a belief not maliciously targeting anyone, so if you're abusive in the comments, I will ignore or report you. If you disagree, cool, what's the point of telling me that? We both know it won't go anywhere and will instead turn into a shouting match, so save us both some energy and take your frustration out elsewhere. Thanks!

There is a legal problem with the initial ruling. The first judge found that MF's beliefs INCLUDED a belief that she had a right to misgender people...and it was THAT part of her belief he found not worthy of protection in a decent society. This is a loss for trans rights...but it is a bad case. Of course, the personally held belief that trans women are not women should not get you fired...but believing that you can misgender people or clients at work and acting on that, should. MF did a great job of constantly confusing those issues, leading to this "win"! Hard cases make bad law.

They could claim their views are also protected philosophical beliefs, no matter how bigoted they are? It pretty much has said that anything up to a fairly high bar can be a protected belief. The original case pretty much found that Forstaters belief included harassing people as part of that belief. And based on that ruled that the belief was not protected. The appeal ruled that the harassment was separate from the actual belief (largely because Forstater sometimes chose not to harass trans people) , hence the belief did not reach the bar for being excluded from being a protected belief. While it does mean that she can’t be sacked for those views, there is nothing to say that is what happened. Essentially Forstater original case was about her claiming her employment ended due to her protected beliefs, but was thrown out as it ruled her beliefs were not protected. Never got as far as whether these beliefs were the reason, let alone whether she was harassing people (which she had claimed as part of her belief), or even whether she was actually employed (rather than just being someone on a short term contract they were free to renew).

While this is over-simplifying things, I don't understand why "transgenderism" shouldn't be protected as a religious belief. If I believe god or the universe or my soul or whatever wants me to behave in a way counter to my birth gender, what religious right does somebody else have to tell me that I cannot exercise my beliefs in terms of my dress, my language, my ceremonies, etc.? Maybe none of us can objectively prove that we're really trans or non-binary, but neither can anybody prove that they really are the religion they say they are. Does that mean nobody should be protected from religious discrimination because they can't prove they're really part of that religion? Of course not. Similarly, we shouldn't have to prove that being trans is anything more than a deeply-held belief for us to receive reasonable protections against discrimination.

I find the UK's attitudes to Trans people truly depressing, and I say that as a British person. I'm afraid I find myself somewhat in isolation with my friends and family when I try to discuss Trans issues. Unfortunately my opinion as a (cis) man is often considered not worth listening to on what is largely seen as a 'women's' issue (never mind that I take the trouble to educate myself wherever possible by watching channels such as this). To my eyes and ears, Trans rights are largely viewed in this country as a challenge to feminist dogma, and the whole 'gender critical' nuance appears lost on most people.

Theres a huge split between attitudes i see daily IRL (friends, coworkers, checkout people, random drunk folks in pubs now that those have reopened) all accept or at the very least adopt a 'live and let live' attitude towards trans people. Yet online and in media there are all these TERF bullies, government officials (Liz Truss for example), and court judges all actively going out of their way to harm trans people here.

You know I only read it once but I remember there was a lot of abuse of children. There was a lot of open racism and bigotry. Now I was already an adult and I was reading this thing to my kids so I don't have any real Nostalgia for it and looking back it really looks like she tells us a lot about who she is with that story. And I don't think it's worth saving I left my Harry Potter books behind when I had to abandon my house during transition. Rowling hadn't outed herself as a phobe yet but they just weren't worth taking with me

I'm not Trans but I live in the UK and I couldn't believe when this news was announced, I was very disappointed to hear people like her getting any attention on this matter. I've heard other 'feminist' journalists like her interviewed on this matter and they are so ill informed and they don't even want to learn to understand what Trans people go through and what the laws are. There was one other woman interviewed who went through a similar thing to Maya Forstater, she claimed to be an ally to gay people but then criticised pansexuals getting the word obviously muddled up with non-binary which I only could figure out based on her topic which was about Trans people and not sexuality. These people are being allowed to share their misinformation to people who may know nothing about the Trans community spreading the poor treatment of a minority group that suffer enough as it is. I'll stand by Trans community and hope that no more laws are past taking away your rights

I hope people being publicly vocal against transgender people will also make even more people aware to be supportive. They are, in a way, actively pointing at the discrimination and slander transgender people are facing. They are screaming this loudly *because* they're a minority. Why is it that people who say, "Biological sex is real," always seem to have very limited understanding of the biology and genetics of sex (same for the people who say that there have always been two genders when, for large stretches of human history and a variety of cultures, that simply hasn't been true. Leaving aside the numerous non-human examples of sex fluid organisms, let's address how difficult it is to actually define the biological sexes in humans; Is it the XY genotype? How does that account for people born with either the XYY or XXY genetic conditions? Is it the mere presence of a Y chromosome? How does that account for people with Androgen insensitivity disorders (someone genetically male but physically immune to the male hormone . . . and thus phenotypically "mostly" female)? Is it the presence or absence of certain genitalia or secondary sex characteristics? That would not only start to validate trans people who've gone through surgical or hormonal interventions (something they'd rather not do), but also invalidate the genders/sex of people who've suffered accidents, medical conditions, or simply birth anomalies. The truth is that sex and gender has never been cut and dry in humans. This isn't a new thing, and people who attempt to paint it as such are either impressively ignorant about a subject they're claiming to be able to think critically about, or being significantly disingenuous for the sake of hate. There isn't really a middle-ground here, and I'm just tired of it.

Apologies, this turned into a bit of a rant! Love your videos by the way. I am harassed frequently by TERF's for being transgender... I am not transgender. But many people see pictures of me and assume I am transgender, and then bully and harass me for it. The first time I got harassed was when someone commented on my post with; "Damn, you don't pass very well." Which confused me, as I had no idea what they meant, you know, with me being a cis-gender female. Foolishly I asked them what they where talking about and they proceeded to say; "You look like an un-evolved man." I was confused and shocked. I had never made any post or revealed any information about my gender identity, because I am as I appear to be, or what I thought I appeared to be, a woman and I identify as such. But this individual saw my profile photo, assumed I was born biologically male, and began attacking me based on that assumption... The hatred and vitriol against transgender people on the internet is very real, and I only hope I can be of some help by trying to be an ally and standing up for my fellow human beings, regardless of their gender identity, especially when terrible people such as that mistakenly attack me instead. I struggled ALOT with my gender identity when I was younger. Mainly because everyone around me seemed angry with me and what I liked or how I behaved, because it wasn't feminine enough. It was not that my biological sex did not match my identity, it was that my sex did not match what everyone else believed my identity should of been, and that made me HATE the fact I was female. I came to see being female as the opposite of what my personality was, and rejected everything feminine for the longest time. Only recently have I been able to come to terms with everything and accept that being female doesnt make me any less of myself, it is merely a facet of who I am, and if people don't think I'm feminine enough, they can kiss my ass. While my experience is not the same, I understand the confusion, uncertainty, self-loathing, and fear that comes with your biological sex not matching how you yourself are and see yourself. I was bullied extensively for experimenting with my gender identity... It's NOT the same, and I would never equate my experiences to being the same as those whom are transgender, non-binary, etc (please do tell me if my terminology is incorrect).

The idea that you need to tolerate intolerance or else YOU are intolerant is like punishing bullying victims for defending themselves and expecting bully victims to simply take a beating or else they themselves are a "reverse bully".

bouncing off the hopeful note at the end, this year a lot of indonesian trans women finally get to have their IDs made. unfortunately they're still listed as male and their names are still their birth names, but at least they're recognised as legal citizens who can vote and whatnot. also they didn't need to adhere to the "masculine look" when having their ID photos taken.

I've been so upset to hear the news about Maya's win. I don't even know how any informed person can in good faith claim that Maya was only saying sex was real. Are you actually interested in an answer, or do you think you "got" us here? First of all, only humans have gender. It is entirely a social construct. So there is absolutely no reason not to accept whatever a person tells you about their gender. But biological sex, you say! Okay. Let's start generally. Many species actually have been known to change sex under certain circumstances. But not humans, you're probably saying. Fine, but I still wanted you to know that. As for humans, biologists actually haven't definitively identified what determines a person's sex. Chromosome combinations generally tend to indicate the sex of most people. But there are more than the two combinations. There are people who are intersex. There are many people whose genitals do not match what their chromosomes would lead one to assume. XX XY only really indicates the sex of a person most of the time, and "most" is not everything. You cannot know another person's sex with certainty. Definitely not the sex of a stranger. So when someone tells you who they are, believe them. If you're not a horrible person, that's really all there is to it.

I agree with you completely, I have always believed we should tolerate everything except for hate. I'm so glad you're online. I also agree that you are adorable. I'm a hippie that had four home births, and have very much enjoyed and celebrated my maternal side and reproductive function, but I have never felt that it defines me as a woman, this is so toxic and I see it a lot with hippies my age and keeps me somewhat isolated as I will not tolerate opinions that violate human rights. It causes me empathic pain to think people have the audacity to impose hurtful bias. Ignorance is common and that's why what you are doing is so important, intelligently and also respectfully exposing and dissolving ignorance. One of my babies is now 20 and she was a beautiful baby boy and now she's a beautiful woman, she faces stuff I never had to face and some of the same crap I had to face as a woman. I'm very proud of her, she's still my baby lol. Rambling x

This is an unfortunate step backwards for the UK. This is the second one that is deeply disturbing (the other being the Johnny Depp case). This will have unfortunate repercussions. She was not fired or dismissed from a job. Her contract ended and was not renewed. No employer is required to give a reason for not renewing a contract that has come to its end. You completed the agreed employment for the agreed amount of time. The employer is under no obligation to re-employ you. I don't see how she's even allowed to go to court to argue that she lost her job because of her views. She didn't lose a job. In my opinion, the case about her employment should have been thrown out, as should any further attempts to go to court regarding her employment and the non-renewal of her contract.

Thanks for the video. I have some friends in the UK, some of whom are trans, and I've been keeping an eye on the situation there with some concern. The coordinated attacks in the US, in particular, against trans and other minorities haven't gone unnoticed and I've long suspected a connection. So glad that you've shone a light on this.
