It happens all the time. I got pulled over leaving a bar because "you can't make a right on red there, there's a sign." I had been there countless times before, THERE IS NO SIGN. He was just stalking people leaving the bar trying to get someone with a DUI. He even gave me a field sobriety test (which i passed) even though I only had 2 beers and blew well under the legal limit.
@user-ty5di3ku6o

@@willvr4 I had the EXACT same thing happen to me. But, in my state, you can refuse the field sobriety test. But if you refuse the breathalyzer, you can be arrested and you'll lose your license for 6mo ... and if they want, they can transport you to a hospital for blood tests. I didn't want to go through that, so I took the breathalyzer. 0. I was the DD that night. Instead of letting me go, he said he still suspected that I was drunk, and said I needed to call a ride or I'd be arrested for DUI. I said "After blowing 2 .000's, arrest me then, because I'm driving away right now." I left, he went the other direction...go figure.

Our 4th amendment is the right to travel freely. If a police officer pulls you over and you haven’t committed a traffic violation it will be thrown out in court. Jamestown, North Dakota. A sheriff was driving on a highway and saw a Uhaul truck with Minnesota plates and he deemed it “suspicious” because the driver was on cruise control going 53 in a 55 and the driver of the Uhaul wouldn’t make eye contact while he (the sheriff) paralleled his vehicle with the Uhaul. The sheriff pulled him over even though the Uhaul driver hadn’t committed any traffic violations. Yes, there was 476 pounds of marijuana in the Uhaul but it all got thrown out in court because the sheriff didn’t have a legal reason to pull the driver over.

#2 You don't have to be unsure about this one. 😄 Just because the driver was a jerk doesn't mean he broke the law. The officer did everything wrong by not offering his name, ignoring the driver's rights, trying to entrap him, and assuming that the driver had a weapon and his address was incorrect simply because he was exercising his right not to answer questions. Your hypothetical got kind of Minority Report. No one is responsible for preventing a crime that hasn't happened yet. The cop "checking the mental state" of someone who isn't hurting anyone and hasn't committed a crime was as BS a smelling alcohol fumes behind glass. Freedom of speech in the US absolutely protects behavior like yelling expletives at a cop if it isn't endangering anyone. Being a jerk is not directly correlated with ones mental state. The cop knew it but failed to manage his own ego. Edited to add: Let me be very clear about this: Freedom of Speech in the US means freedom from oppression. It protects harmless jerk behavior, like flipping people off and insulting cops, because it safeguards our right to call out tyrants. It's crucial that we're able to tell law enforcement and orange politicians to eff off; otherwise, we wouldn't be able to talk about their corruption and oppression. This isn't about a power trip, lack of morals, or simple American abrasiveness-though it can be taken advantage of in these ways. It's rooted in the very foundation of protecting our freedom. And these days, it's one of the few things we have left. edited for grammar

Yea, this is why I don't watch Europeans react to American police. We have a constitution and civil liberties that we entrust police to protect and are forced to pay for. They are civil SERVANTS and are to conduct themselves as such. They are to be held to a higher standard than the average citizen. The guy in the second clip is an extremely good and experienced 1st and 2nd amendment auditor with a RU-vid channel of his own, people like him keep police accountable. Europeans don't have rights like we do, they were stripped away a long, long time ago, but if you did, you'd know that rights are like muscles - if you don't use them or work them out, they will go away. If a police officer can't take insulting words or control their own emotions, they are in the wrong line of work. They swore to protect and SERVE the people, not the state, otherwise they are tyrants in a country made from killing tyrants and should be treated as such.

Honestly, maybe you should, but, I may be wrong to imply, the expertise of US citizens about Europe is largely based on knowledge (mostly half-knowledge) about the UK. The UK has the Magna Carta and the Bill of Rights, the latter of which basically governs parliaments and their rights. In Germany, we have the "Basic Law", a complete constitution that regulates such things as freedom of opinion, speech, science, press, travel, the right to a legal hearing etc. and goes back almost verbatim and congruently to the Paulskirch constitution of 1848/49. At that time, the people, namely the "right-wing" fraternities and student unions, were shot down; after the Second World War, it became the German constitution. It strictly regulates (at least theorethically) what the state and civil servants are allowed to do to citizens and what citizens are protected from. The point I like to make is that we have no real equivalent to the 2nd Ammendment, although a right for all Germans to resist anyone who wants to remove this legal order. Unfortunately, a lot has eroded in the past decades. I have experienced bad police work in Germany, but I have never personally experienced situations like the one in this video or know people in my family and circle of acquaintances who have. The training of German police officers takes between 2 and 3 years. For criminal investigators, a at least three years of study is required.

But when an unstable person takes 2x the dose of decka, tren, test etc etc.. (someone that lacks self-reflection) - it’s gonna turn out like that. He should defenitely not be allowed to work as a cop because he can’t handle it even knowing there are cameras among them. Either it’s steroids or he’s just out of his mind with anger issues and a terrible day. Judging by his physique and age, probably steroids. Either way though.

The freedom of speech laws in the US are just so weird. In Germany you have Freedom of Speech as well of course, but different Freedoms come into conflict with each other. In Europe pretty much all countries have a concept of the right of every person to not have their personal honor damaged. And when one persons freedom of speech infringes on another persons right to personal honor being respected, you get a conflict. What this essentially means is that it is usually illegal to insult someone, even verbally or by gesture, as it may violate their right to have their personal honor remaining intact. And then there are hundreds of details and special cases and asterisk's attached. Politicians or people of public interest for example have a much higher hurdle of claiming protection against insults, as freedom of speech and right to protest gain extra weight, when directed at such persons. Then it can also be considered art or satire in some cases etc. Very complex and I'm not a lawyer. But giving anyone the finger (police or not) has resulted in fines of up to 4000€. By the letter of the law, 1 year in prison would be possible, but I don't believe that ever happened.
