When I got arrested It was "Yes Sir" "No Sir" I treated them with respect and they returned the favor. I told them to take me to jail cause I knew I was failing the field sobriety test. I shook the officer's hand who arrested me....stopped me from not only killing myself but taking someone else's. Last time I got arrested my mom said to not even bother calling her cause she wasn't going to bail me out. I had to take a loan out and get a lawyer on my own.

The case Dave is talking about is the Papini case. If I remember correctly, her husband has filed for divorce since learning she made it up. As much as many don't like California, they charged and sentenced her correctly.

If I remember correctly the second girl's father was either a Police captain or was the Police Chief. That's why she thought she was able to do as she wanted because her dad would clean up after her. She definitely learned otherwise.

Yeah but as calm as the dad appeared to be in front of the officers and knowing he was being recorded. She didn't end up that way on her own. She was either raised that way by him or the mom or lack of mother figure, friends or something else. She has a Tesla at 24 and believes her dad "owns the island"

Idk some girls are under the impression that only female officers are allowed to detain and touch them...they're professionals. Most guys will have the women handle situations like this simply to avoid the trouble, but they don't have to.

Yes, you're correct, it's the key in the ignition. I know a guy who only avoided serious jail time because he had taken the keys OUT and had them with him or they were some distance away from the vehicle when he wandered away from the car and passed out.

Depends on the state. Even just sitting in the driver's seat with your keys in your pocket is DUI. Some states take it seriously.

Here's a story for you, a good friend of mine was dating a stripper so he'd often go to the club after work and just hang out and the bartender would slip him free drinks, he had one too many, and was outside in his truck sleeping in the passenger seat waiting for him GF to get done so he could drive them both home. And he locked his keys inside the toolbox in the bed of his truck, and was auto-starting the truck with his MyChevrolet app to keep warm, because it was January in South Dakota. And the cops came by, knocked on the glass, did the whole thing, and he got a lawyer and got his DUI charge knocked down to a reckless driving. Which is unbelievably hilarious because he wasn't driving, and couldn't have even if he wanted because of how the auto-start works. He always says, "You guys wanna hear the time I got charged with Reckless Sleeping?"

@@LancerX916 I should also add he blew 0.08 ON THE NOSE, so if he had just waited another hour like he planned, he would've been legal. He did everything right and they STILL busted him for it. I really dislike all those laws, the spirit of the law and the letter of the law do not jive. All you do is punish people who are trying to do the right thing.

The State of NJ impounds all cars that are involved with a dui driver for 24 hours. This after a drunk driver was released, he got behind the wheel of his car and killed someone. Owners responsible for tow cost and impound fees.

Last year I got a physical control charge. Its because i was drunk in my truck with the keys in reach. Even though I was going to sleep there I got arrested and truck was towed. The penalties are basically DUI level but its not on my driving record or affected insurance.

A friend of mine had a similar thing happened, he got his knocked down to Reckless driving which is ironic considering the truck was stationary and he was asleep, and no keys in the ignition so he couldn't drive away even if he wanted, but anyway..

Depends on the state. Some states will charge you even if you are just sitting in the driver's seat with your keys in your pocket. Those states don't want you near a car while you are drunk.

In 1983 MY wife an I went to a wedding reception. I had to much to drink so she was backing out of the parking lot and backed into the light poke I got pissed. So when she drove out to the street I was still mad about the broken tail light's. So she got of the car and left the keys in the ignition. Right away the police ran over arrested me for drunk driving. I was in the passenger seat. I kept saying I wasn't driving. Needless to say I took one hell of a beating😮 DUI AND NOT DRIVING SUCKS. AND WHY THEY BEAT ME ALL THE PEOPLE WAS YELLING HE WASN'T DRIVING OR RESISTING😮 SHIT HAPPENS😢

In NY State, once you place the keys in the ignition, you are considered guilty of drunk driving even if you never started the engine. My friend found this out when he slept in his car in a bar parking lot with the keys in the ignition. A cop was doing a business check when he spotted my friend sleeping in his car drunk. The cop said that if the keys were not in the ignition, he would not have been arrested for driving while intoxicated. Rule number remove the keys if you are going sleep in your car.

I’ve been pulled over and wondered why. It never dawned on me to act like I could just leave. I just look confused, like and scrunch up my face like idgi. They usually explain a bit more. Like once I was stopped for Not stopping at a stop sign. I thought I stopped, so I made my confused face. He continued, You didn’t stop long enough to see me sitting there. Ah, touché. Ticket warrented. No weird scene.

Daz is correct.... Most states have clear dram shop laws that will hold an alcohol vendor accountable for serving an intoxicated person, when a reasonable vendor would have realized this person should no longer be served. Continuing to serve an intoxicated person increases their chances of hurting themselves or someone else.

It can differs state by state, but you can be arrested for operating any motor vehicle even a ridding lawnmower while on private property for driving while under the influence.

Drunk drivers need to show intent that they plan to drive drunk. Keys in the ignition show that intent. In addition to my experience in law enforcement I was also a bartender. In many, if not all states, bartenders and businesses can be civilly and criminally responsible if they over serve a patron and he/she kills and/or causes damage to property.

The keys have to be in the ignition, they tell you if you're going to go pass out in your car leave your keys outside of the car on a wheel well or under a rock on the side somewhere.

I'm not American but I know there are many Islands in Florida so I checked on Wikipedia. There are actually 4,510 islands in Florida that are ten acres or larger. The only US state with more Islands is Alaska.

The first case, I've seen and police screwed up badly. They let her stay in the bathroom stall and flush the toilet. She ran into that stall. She flushed something down. Normal procedure is to go in after them and get suspect away from toilet ASAP so they can't flush contraband.

As far as private property. I guess it may depend on each state. In Minnesota I heard of a guy who was mowing his lawn on a riding lawn mower on his property while he was obviously drunk to a neighbor . Neighbor called police and the man was arrested for drunk driving.

It entirely depends, because yes it's totally legal here in Minnesota to have like a backyard ATV race where everyone is shitfaced so long as it's on private property and outside city limits. I have attended a party annually where it's basically just a big Redneck bonfire complete with trucks and SXS and 4wheelers and beer and grills and all the whole thing, and so long as I said before, there's nothing they can do.

I think if property is damaged like someone else's car or somoeone was hurt, regardless whether it was on someone's property one can get charged. I know it's legal in California and Colorado to smoke pot in a car but it has to be on private property and not turned on and cant be detected by someone outside the property like a school.

Dealing with Police in the USA totally depends on the severity of what you're accused with. If you genuinely think you've made an honest mistake, like the time I was dead-tired and stopped at a red light, looked both ways, and then went through it, got pulled over, and then just told him sorry on my way home from a long shift and I just got mixed up there for a second. He let me go, but sometimes they've got you in the crosshairs and at that point, your best bet IS actually to stop answering any and all questions and try to use the court system.

Not a chance in hell I'd ever call her for doing some dumb ish. Spend the night, be shocked at and skip the breakfast, and have a buddy pick me up. LEARN THE LESSON.

Sometimes you can be charged for emergency service's time to help you... Example: In Arizona, there is (or was?) a "Stupid Motorists" law that said if you were dumb enough to drive into a flooding dry wash, get stuck, and then have to be rescued, you had to pay for the rescue... it may have applied to other scenarios too, but the getting-stuck-in-a-flooded wash thing is not that uncommon and takes a lot of resources to rescue folk...

The owners of the bars being responsible for drunk drivers came about because some kid killed somebody in a wreck and instead of holding the kid responsible for their actions, they went after the bar for money. It's bullsh*t. The last piece of crap has been telling her mother you can't tell me what to do her whole life and getting away with it. That's why she acts like she does.

in most places to be arrested for DUI/DWI in the US you just need to be in the car with access to the keys. Its mostly up to the discretion of the officer but I know officers who arrested people who where asleep in the back seat with the keys in the front seat. if he wasn't on the side of a major highway though it probably wouldn't have been an issue.

It is a grey area if someone is being responsible by not driving, yet sleeping one off til the person can drive and the keys are in the ignition with car on so the heater can warm them up. Officers can use officer discretion in this case by not arresting. But, the person still can be arrested because the intent with the car on is there. To me this scenario i gave would be a BS arrest.

The bartender should and can refuse service to those they feel have excessively drank, and they can get into trouble for servicing someone clearly drunk. The owner unless there has nothing to do with it. And I will say someone close to me fell asleep at the wheel, with there Foot on the gas and the car running. I broke the window and pulled the Keys out, cut my hand badly, and when the cops arrived they said they couldn't charge them with a DUI because the car wasn't running when they got there. In my opinion that I a load of shite. At least in the state of Wyoming. It should be the same in every state but it is not.

The choice of words and the way they talk they want to escalate and when stupid people like these girls play just like police want then this is a party for officers. So I think police also should try to act more professional, cursing, yelling, using words like spread your legs, you running from me, etc etc is just excuse to escalate. Explain one time if people don’t understand deal with them however you want. I have seen lots of video and police behavior is same

The vast majority of people who ask for "Their attorney " have no attorney. It's a great idea to get one but you don't have a right to an attorney as you are getting arrested. Shut your mouth and tell the lawyer once you get one what happened so they can begin the process of getting the cam footage and reviewing the case. Being asshole won't look good in court. Even if the police are being an asshole you are not going to win that battle of wills.

That last one, they gave her multiple chances. It seemed like if she had been like, "Ok I'm ordering an Uber." They would've genuinely let her off Scott free. Man some of these the cops are totally not even overstepping at ALL and these bitches just INSIST on getting arrested and roughed up!

What really makes me angry is the fact that they shoot black people down for a hell of a lot less than this, they shot an 8yr old black kid for playing with a toy gun in the park and this woman put actual lives at risk
