The higher a veteran's disability rating, the more compensation they will receive each month. However, a rating under 30% does not factor in any dependent children or spouses, so no additional benefits are received for the number of dependents. Travis Studdard explains how a 30% or greater VA disability compensation rating can include dependents while under 30% will not.

I am 80% with an IU rating of 100% disabled. Here is my hard earned advice. Don't hire a lawyer, since the VA must provide an advocate. Immediately appeal ANY decision the VA makes in your case and accept nothing less than what you feel you deserve. My first award was for 20%. Be patient and NEVER GIVE UP THE FIGHT !! The VA will likely farm out responsibility for your exams to a private company. The one I had once sent me to an empty office building for an exam, but I didn't let that discourage me. Lastly, conduct all communications with the VA using certified mail with tracking. Make 'em sign for it. Any phone call you make to the VA never happened. I know, because this cost me 6 months back pay. Best of luck.

After a year and a half of active duty in the Marine Corp infantry I was discharged due to dislocating my knee joint several times while on military exercises. Several months after I was discharged in January of 1979 I filed a VA claim for disability. The VA denied my claim twice saying I had a preexisting condition. This year in February 2018 I was finally seated 10% disability for osteoarthritis. I currently refilled a DBQ for both knees now affected with osteoarthritis and pain.

The denial was based on an growing pain called Osgood slaughters desease that my Orthopedic explained in a letter at age nineteen did not not apply to me through medical proof. Finally after 36 years I was awarded 10% disability now I suffer pain in both knees from osteoarthritis. The VA uses a mobility exam which in my case affects my mobility when my knee swells up from inflammation. My Doctor have given me four cortisone shots in both knees over a period of time and recommend knee replacement if all other treatments fail.

Here is exactly my situation..I am totaling 70% and 30% for depression being the highest..10% for keft knee and 10 % for right knee and 10% for my lumber spine/chronic back pain and 30% for bilateral flat feet..so I put in for increase benefit because all my conditions got worst and I have not worked for almost 2 years now because of my service connected disabilities..but unfortunately my depression got reduced from 50% to 30% making me not qualify for scheduler rating for tdiu...and bilateral flat feet from 10% to 30% two months ago..how can I get to permanent and total .. I already have a pending tdiu claim which I put in after the denial for increase..can you guys please help me appeal that inaccurate reduction and get me the benefits I deserve..I am going through alot right now with no support . . I have been suicidal and still suicidal..this pain is too much so denying me the benefits I deserve is just adding insult to injury. Please help.

If you never filed for disability while active service, but have multiple combat deployments. Can you still file for disability?

cristobal amendoza if u were hurt. Feel like u have ptsd or any other symptoms. I didn't file for 5 years after I was deployed. Started at 10 percent and now at 90 percent. It's always worth your time even if it takes u years. Good luck brother

How do you stay positive when your claim keeps getting denied? While in the military during basic training and tech school I was seen by medical staff and all my claims have been denied bcz of missing or no record of hospital visits. Which is so false!! Headaches, allergies, swelling/ inflammation I’ve learn to take over the counter medicine to just keep going. If you have any resources or knowledge on what should I do it would be greatly appreciated. I been out for years but the issues still are present. Pls help!!! Thx also I enjoy the videos

Thank you Travis. I'm presently at 20%. However I've had a claim for increase in since may 2016. I was finally given C and P for PTSD in November 2016. I have 3 children and spouse. Will I be retroactively paid for the children's increase once my claim is finally settled? E-benefits says between 6/2017 and 9/2017 is time frame my claim should be finished.

+tonygreene113 VA will determine the effective date of your increase to 30+%, and the additional compensation will be paid back to that date. Best of luck to you in getting that increase!

Hey Travis after a medical review board found me unfit for duty I was separated from the military without medical help for hip pain. I eventually had to get a hip replacement with my own money and I've been trying to get any help from the VA but unable to do so. I'm about to get a civilian FCE "Functional capacity evaluation" out of my own money and not sure if this is the right step in the direction I need to go...

Are you rated by VA on the hip? If not give us a call. As far as the FCE, that usually measures all sorts of abilities in a simulated work environment over the course of several hours. Most hip ratings are based on range of motion or at least a minimum rating in the case of a hip replacement that went well (little to no residuals), so an FCE may be overkill. A physical therapist or your doctor could probably assess range of motion. But first you need to make sure you win service connection if you haven't already.

Thank you for getting back to me. I am not rated I do have a case worker from the American legion working on my case. I was told by them to get a doctor to fill out a CP form similar to a FCE but most of the doctors I've found do not evaluate conditions to the extent of whats on the form, so I was sent to a physical therapist to get a FCE. I will definitely give your firm a call if the case worker can't help me.

It’s better to get 10 percent that no percent, might help you in the long run ( relate or increase issues ).

I am currently service connected at 20% for my lower back. Two years ago, I started to have complications and I tried going through the VA red tape with no luck. Ultimately, after months of trying to work with the VA, the pain was so bad that I paid out of pocket to have back surgery at a local hospital. Things have been better, but I am starting to have similar complications. I am considering going back to the VA in an attempt to increase my disability rating and see if I need physical therapy, surgery, or whatever it takes to be relatively pain-free again. Any thoughts on my chances of success on this? Thanks.

Hard to say what your chances of success are, but it sounds like it would be reasonable to consider filing for an increase or for service connection of other related disabilities. Best of luck to you.
