While a number of countries like Taiwan and India have repealed laws criminalizing adultery and concubinage in recent years, the Philippines remains as one of the few countries in Asia that still treats marital infidelity as a crime. The country’s Supreme Court affirmed the 8-year sentence imposed on a man who caused his wife anguish by having an affair and fathering three children with his mistress. To find out why marital infidelity is considered a crime and how Filipinos feel about this, we hit the streets of Manila.

Now I understand the plot of some K-dramas. I was confused with their storylines about mistresses and infidelity. At the back of my mind, I was wondering why characters don't go to lawyers, only to find out that it is not illegal there 🤦‍♀

Not to mention there's no divorce in the Philippines. We only have "Legal separation" in which you're technically still married, and can't remarry; and "Annulment" in which the marriage is null and void to begin with, thus if proven, you can remarry. But in practice, adultery and concubinage is quite common, it just depends on the parties involved whether or not they want to put the law into practice 😔

The tv/media I would really depends on country/culture basis. Philippines is pretty strict on cheating topics (2000/2010-present) & they are still heavily depicted as wrong things in movies. I would not say it was the same as the era of 1970s where porn becomes like a big industry. Normally people of that era cheats a lot & probably created the quote that translates to "Measure of masculinity is based on the number of girls they have sex" (girls has almost same quote but has something to do with the number of jewels they wear). They probably do it because they can hide it, unlike these days that there is social media & cameras everywhere. Ramon Revilla Sr. (actor/senator/dead) was famous in that era & has 80+ children, I can't really verify if he cheated cause his wife died early & he never remarried. These days the issue is more on early pregnancies that end up having lots of single parents

@Lycan marriage vows are not upheld by the government, they only have as much power as the people reciting them. Clearly to people who would cheat they dont hold much power. Breaking vows in the military typically mean the possible endangerment and death of other lives. This danger isnt present in cheating and therefore shouldnt be punished under the law. Marriages are encouraged to support having children, presumably if youre cheating you'll have more children and therefore should actually be rewarded more, right? This would leave me to believe there would be a different reason for criminalizing adultery

Governments want to promote stable families because that is the best way to promote stability across every other aspect of the nation. Therefore they offer incentives such as tax breaks to encourage these unions thereby also encouraging stability.

Ok I’m Filipino but not from the Philippines, but like my parents, relatives and parent’s friends who are married have stayed together and didn’t cheat on their spouse. I thought that it had something to do with Filipino culture or smth. That’s why I kinda want a Filipino boy. Also I find it really cute how Filipino boys will do ‘ligaw’ to show that he really likes you and I think there’s a lesser chance of you getting played with since he made all that effort to show he likes you.

Wait until you hear about the mistress and how we treat them. If people find out about the mistress. Everyone will curse you. Neighbors, friends, colleague. Even the girls family. Like how could you raise your daughter to be a mistress. Shame or your family. And the wife can kill the mistress and not go to jail. Yes. Legal marriage in PI means signing a contract. To cheat is indeed to breach the contract and is a crime. But it should have solid evidence like being cought in the act or having a child with another person other than your spouse after marriage. It is about the law of the land and has nothing to do with religion as some would like to associate it with.

For me, excluding the fact that some always think it’s about “catholism” but for me adultery causes trauma and pain to the wife or husband who are the victim of the adultery especially when they have kids. I support this law not because we value the thought of valuing “family and religion” but it changes a person’s being and the emotional trauma will take too long to heal

Yes, and catholic church will never allowed to make Divorce legalize here in the Philippines because marriage is a vow of two partners, and they promised to god that they will love each other until the death. So in eye of the law, in eye of the god, cheating will be always a SIN.

I think Divorce should still be legal in here because the Philippines is a de jure secular country. Some people are in abusive married relationships, and they deserve to have a new partner they’re comfortable with if they choose to. Not everyone is Catholic, and not everyone who is married are in a loving relationship.

@@crossref233 I agree that cheating is not a crime, but now our constitution is in favor of committing adultery as a crime. Crime and Sin is different in their ways. Crime is about murdering, kidnapping, or any heavy violent activities that may result into crime. While sin is about mistake and wrongdoing activities but it's not too much heavy unlike a crime. And if you're a filipino, you are already accustomed that Philippines is developing country that still along with Religious views and Superstitious Beliefs or what we called “Pamahiin”. @@allyours_j A crime isn't always heavy. Even just stealing a candy bar from a store is a crime. However, sin and crime does overlap. Of course killing is also a sin as it is also a crime. They are fundamentally different, but they can also refer to the same instances sometimes. Crime is governed by a country's laws, while sin is governed by a religion's laws. For example, cheating on a girlfriend can simply be seen as a sin according to the bible. You are only bound to them by supposed love, trust and mutual agreement. I am actually surrounded by cheaters. I was born having them around me treating me like they were the best people and that they almost look like they can’t do such a thing. My mother got cheated, my father is a cheater, my grandfather is a cheater, my uncle’s are cheaters, as well as my other relatives and my cousins too. I witnessed how they cheated the other ladies out there who were so dumb and really inlove. And that gave me a very important lesson in life that I will never ever do such a thing. It’s traumatizing. I hope the best for those woman out there who got cheated.

If you go to jail and spend 8 years of your life there, you lose your freedom, you lose the life you used to live, you lose your job, your reputation is ruined, and you'll forever have a criminal record (which would make it difficult to find a job later on when you get out of prison). @@symeon5518 look, in the Philippines we treat marriage as a responsibility and a long time commitment. We don’t get into a marriage contract if we are not serious about it. Cause a lot of downside of divorce is that kids will be separated from his or her mother or father at a very young age. A family should be a complete family. Not like in the west, they try everyone they like even if they are in a marriage having sex, ends up being broken family, always sad and depressed people. Kids being spoiled and not guided properly because no father figure of mother figure to look up to.

the law does not lessen the cases of adultery but, it leads you to think twice if you are in that situation where you are being drawn to another woman/man while being bind in a marriage contract. It's mandatory to wear face masks or you get fined and you can also stay in jail for continuing to violate it. They'll give you a free face mask and a stay in jail. 😂 We'd rather wear it than get fined. Also, in the office and other establishments you have to wear a faceshield or you can't get in at all, you can continue to act entitled or even say you have a health condition they won't budge at all. You'll be asked to go back home if you so mentioned you have a health condition, also people with pre-existing illness are not allowed to go out. Lol. Some of us still do go out, can't help it if you live alone.

This law makes perfect sense to me! Infidelity is a selfish act that causes destruction in families, social and mental harm to not only the spouse "who are mostly women" but the children too! I 100% support this law to be implemented everywhere, but at the same time divorce should be legal as well, it's unfair for unhappy couples to be forced to stay in a disfunctional relationship.

@@lurkerran There's actually another side to that narrative which makes banning divorce good. I won't say something long but it has got do with forcing people to solve their problem. Most countries with divorce tend to just file a divorce if things such as cheating happened. Remember cheating doesn't always mean that the partner who cheated wanted that to happen. If this happened to other countries with divorce people just tend to divorce.

Just like in the law of Obligations and Contracts, once there is a breach of contract, a party may file for the rescission of the contract yet at the same time file for damages. I think it should be the same for marriage.

Besides, you generally don’t go to jail or get criminal records for most breaches of contracts in the world, but that doesn’t mean you can’t lose out.

You got it a bit wrong, although YES your charge will be less than an actual murder crime, but you will still get charge. The law I think is Crime of Passion -it's not just spouse too I think. It's something about killing someone and not realizing it as you feel too much emotion.

Finding out that your husband or wife cheated on you is a devastating experience, no doubt about it. Still, I find the law too harsh and outdated, does it deter? I somehow doubt it, people will become more cautious and the risk of getting caught an extra thrill. A divorce is from my point of view a simpler remedy, a little less painful than endless court appearances. Imprisoning the offender will not deter anyone, it makes people more cautious not to get caught and the law does not consider the children. The legal and illegitimate offspring suffer financial difficulties and the stigma of an imprisoned parent. The illegitimate children could have an even harder stand within society and in a way are being punished harsher than their parents.

Cheating cannot be used as a ground for annulment and in my case I can never love again since anytime it can be used against me. My plan b is go to US and bring my family there, save up and divorce. Still not simple. I know a lot of pastors who cheated and their wives are seems to still be traumatized because they cry at random times. I hope you got my point since based on this video it’s just easy to say “file a case” or “why marry when you will only cheat”.

As someone who was in love with a Filipina at one time, I have to admit, your cultural attitude is backwards and so old fashioned it is out of step with more developed countries. It should tell you something that even the more conservative Asian countries have moved past this imposition of morality. To say nothing of the first world nations (western countries like my Canada) Do you honestly think that things that hurt your feelings should even compare to actual crimes, crimes against life and liberty and property like violent crime, theft, sexual crimes, fraud, amongst others. That is what criminal court is for.

In the USA right now there is a push for traditional wives. Also what is interesting less people marrying in the USA could be related to increased adultury which means less population growth which comes with all sorts of social problems.@@brutustantheiii8477

The Philippine Constitution has a provision that protects the family. It is the only Constitution in the world that does so. It is essentially protecting the defenseless children of a family. The Filipino culture loves children. Family is life.👨‍👩‍👧‍👦
