Thats so disgusting of the mother to do. Put all the labor of her care on her daughter's shoulders and then turn around and give all her money to her son when she dies. I could understand if they had a bad relationship or something but that wasn't the case here... I would have told her to go live with him when I found out that's what she planned to do. Why would she want to introduce such turmoil into her children's relationship after she died smh bad parenting

I always find that interesting. The woman should sacrifice everything to take care of people. The man does nothing but gains everything. Women who know this should act like men and do nothing. Of course, family guilt women if they don't do the caregiving as if it's only women who can do it.

Just not to be honored after your death because someone can decide what your intentions were. Jenny could have been a financial drain for her parents while they were a life and wanted to give the brother a little bit more.

That isnt what happened.. Chinese favour sons… so they get everything. Even during their life: her brother received more education and everything.. Having the daughter was simply to have a caregiver so the son wouldn’t have to do it. This was unfair!!! Totally gender favourism that are completely outdated. She deserved a fair inheritance.

I was at a presentation by a lawyer and the court can intervene thank goodness. I was surprised. In this case, the sexism involved, even though the daughter did all the work, is ridiculously unfair. I know of another case where one of the 3 daughters who had not had contact with the parents for 10 years was suing for part of the inheritance. Nervy eh? Don't know what happened.

@@sadee1287 Why should courts get involved? What is the point of writing a will if it can be overturned by courts just because the judges think you should have divided your assets differently? If a person is certified to be of sound mind, then they have the legal right to leave their assets to whomever or whatever they chose!

Selfish, selfish brother. As a retired Social Worker I saw this many, many times and with Caucasians families too. I worked across the country. Who does all the work for the elderly parents?? I had one son who was excellent and his sister as cold as heck to the parents and did nothing. All the rest of my cases-99 % the daughter or daughter-in-law did all the work and for very little to no thanks from the adult children who did nothing. I had one family that divided all the chores for the parents equally between the 3 adult children. ONE FAMILY out of hundreds!! You go Ginny!!!

perhaps the caregivers need to specify the compensation they receive for their work, rather than wait for the parent to die and then complain because their time and effort was not rewarded.

Not saying it was a good choice, but it's her assets and wealth and ultimately her choice, not anyone's business. The fact she got media involved rather than settling civilly or was unable to, is still embarrassing 🤦‍♂️

@@mbergamin16 I don't think she was asking for exact compensation or payment, but after all the work she put in to just be treated equally. I'm glad this went to the media, it should be more commonly recognized that daughters are often pressured to care for their parents but treated as if their labour is either worthless or a due fact. I don't want a weekly wage for cleaning up my dads excrement and keeping my parents house sanitary....but you can bet that if I found out my brother was set to receive a lot more consideration in their will then I'd stop helping out and let my parents either try to pressure him to help or they can live in filth. Depending on her situation fair compensation might not be possible, who knows what the estate is worth or how many hundreds/thousands of hours she gave of free physical and mental labour yearly....but primary caregivers deserve at least an equal inheritance and to deny that is a slap in her face.

Or maybe the mother favoured the son because he treated the mother better than the daughter did? There is no proof that there is "gender bias", only the daughter's claims that the non said so and so about it being part of Chinese culture.

I would think being the primary caregiver, which some strange reason (but not really) often seems to fall on shoulders of the females of a family ...from birth to death ...would seem to indicate otherwise. BTW ... this didn't occur in China and Canada doesn't support or condone gender bias which the mother supposedly didn't deny was her reason for her decision. The son didn't deny it either.

Her being her mother's primary caretaker was proof she cared. She wouldn't have done it if she hadn't. Where was the brother? What was his contribution if any? Glad justice is being served and she's getting her fair share.

She knew her mom planned to leave most of her estate to the brother. Perhaps she should have charged her mom a fair amount for caring for her. Waiting til the mother dies and then challenging the will is disrespectful.

@@lornamackay4069 She was a good , kind , respectful daughter who took care of her elderly Mother until she died . Charging her Mother for that care would have been disrespectful . She took care of her Mother and was there for her until the end . She deserved to have that acknowledged and to be compensated from the estate . The way her Mother and brother treated her was ignorant and disrespectful , she could have refused to care for her Mother and had her put in a home which would have drained the estate and left her brother with far less or even nothing but she didnt .

It doesn't matter who the mom favored. I guarantee if the mom gave the 82 percent to the her , she wouldn't think about giving 50/50 to the brother. All i see is a daughter who took care of the mom, only to change her mom's mind. And obviously it didn't work . Now she wants to ruin the relationship with her brother.

@@ChadChriton .....or they could have dissolved the estate and used the all money to place Mama in a nursing home and no one would have to go to court after Mama died.....all the money would have been gone into paying the nursing home (check the rates). The daughter, by choosing not to put her in a nursing home, enriched the estate.....that's the way the courts look at a situation like this.

Nope. You CAN contest a will, and if the court finds compelling evidence that the claimant wasn't equitably treated, they will and often do find in their favour. Which should be a lesson to those who want to shaft their children, favour one over another and create animosity and division. It's the most un-parent-like act you can commit. What kind of parent creates bad feelings amongst her children. A BAD one.

@@sadee1287 Funny you replied that thinking you're right. I'm a lawyer and I flat out telling you this is not going to win a case. Im not saying you cant contest the will. Im saying you cant contest it and win. Learn how to read. Even if the court finds evidence, a Will still a binding contract, its a Will. The only time a court will ever side with her is if evidence of the mother, made the will in duress or similar sort. Just because she doesn't like her daughter, it doesn't mean her Will is illegal or voided. My parents could choose to give me all their property when they pass or to my siblings and I can't do anything about it unless I can prove to the court that my parents made this will while they suffer some kind of mental/psychological illness, or was forced by me or my siblings to sign it. Next time if you're going to reply, reply with an educated response. Not your feelings. Sure mom was a big "ass" for that, but it ain't anyone's business. Plus the daughter, considering she is chasing after her family's fortune is the most Asian thing I've seen. This is common in Asian culture. In the end, I will be surprised if she ever gets this case pass preliminary. She's wasting her money unless she actually has a case, which this report never stated.

This is unprecedented and it will make a will useless. This is very very normal in religious culture. The daughter will benefit from her husband's inheritance. If he does appeal and it fails, many will pass down their asset before they pass away to protect their wishes from court/government to determine who gets what.

Hardly. Contesting wills has been a thing for years. You don't want your will contested -- don't be a selfish parent and cause division amongst your children.

Lets say a parent was well taken cared of by one child and another child abandons them at a seniors home, more than likely the parent would want to give more of their will to the child who took care of them. The other child should not have been heartless to abandon their parents in a retirement home

I don't think this will have a huge impact on contesting future Wills, but I do think that depending on media coverage it might have a lot of children (mostly daughters) thoughtfully considering what kind of care and how much they are willing to offer their elderly parents.

growing up in east end toronto... I can totally see how this will rip through an asian household... as they are so old school. I remember growing up with asians and irish peeps around.... these type of whole diatribe would destroy them. For sure. But also as a male, I would have thought of giving up a little more. I mean the lady took care of the mother for a while at least give up like 10 percent more. Things between siblings when parents die can get even worse. I know even in the latino community. Since I am latino. People, colombian people and I am not colombian. fighting for a will that was left to brothers and daughters over a household and going on long legal battles over it. This does not surprise me but honestly if I was in his position just to squash all legal battle give up a little more in will in terms of percentage. All that was going to happen anyways was that he was going to spend almost the same amount in legal fees. And plus look at her she is not even Asian asian she so banana and her daughters are probably even worst, so no wonder they won. And the son is probably old school like her mom cause it is convinient for him... as he as been put on a pedestal for just being a boy. But anyways.

No one should have the capacity to change a will for any reason, especially after the person who wrote the will died. The will is the last wishes of the person who worked their entire life for it. At the end of the day, it's their final decision. At the end of the day, no one should be allowed to go against the will of the last wishes of the person who just died

Its her last will and testament. Whether its right or wrong it was her mothers last wishes. They should be honored. Full stop. There shouldnt be a judge in Canada that change final wishes...what ever they are. Her brother could have just as easily split it after the will was honored. This has zero to do with standing up for womens rights. It could have just as easily been the other way around. More liberal bs.

I cared day and night and kept my day job to care for my dying mother. Upon diagnosis of throat cancer , the next day the dining room was made into a bright comfortable room for her. She wanted to leave everything to me but I said no. You have three children and you will divide three ways. I don’t want problems with my brothers.

The mother was mentally competent when drawing up that will and no court should intervene. The mother’s view might have been outdated, but it’s her views and her wealth! Stupid court ruling. It basically nullifies the legitimacy of wills and disrespected the mother’s final wishes.

So she got 85% of the home..that probably is more than a million dollars worth. My parents are giving their assets to my youngest sibling. That's my parents' money and since my dad blew a shitload of their income on stocks, he concluded that the son of my step-mother, who is my half-brother, should get the money..I am not gonna sue my brother over it. I stand on my own two feet. So that daughter disrespected her mother's wishes because she was not the favoured child.. She should have just taken whatever her mother who raised her decided to leave her.. the 18% was probably still hundreds of thousands of dollars. Maybe she was less favoured not just because she was female, and she just played the court system.

When parents decide to play "favourites" their wishes should be "disrespected".....something tells me that this situation also happened while mama was alive, so why didn't she go live with her son when she was infirmed. By doing what she did, mama is striking out from the grave, so don't tell the daughter to "respect her wishes" and not react.

@@sadee1287 No it's not. My sense of justice is all about common sense. Why didn't the daughter sue BEFORE her mother passed away? She knew what her mother's plans were. Any Judge would have spoken to the mother to assess her mental state, and would have ruled in her favour. The Judge would have stated that the law does not force her to give any money to her children, let alone one in particular. But, now that the mother is dead, her values died with her. I hope this case goes in appeal because this is insane.

Imagine, a brother and sister torn apart over the amount of money their mother left them. And the news channel encourages more families to be torn apart in the future. NONE OF THE CHILDREN MADE THAT MONEY, and each should be happy with what they were given. I know beforehand that I'm getting nothing. The news channel is just reporting the news. It doesn't make a judgment call on the proceedings. Contesting wills has been happening for decades. This is nothing new. But it does illuminate the preference that some cultures hold for valuing sons over daughters, which is wrong. This daughter helped and supported her mother into old age, and at least for that, should be compensated. An imbalance corrected, and a message sent --- it's time to value daughters and sons equally.

She said her mother told her "All" of the inheritance goes to the male. So if she got 18%, the mother was already making progress. But all you hear is the daughter 's story, and the son can't tell you his side. My aunt's family is leaving most of their inheritance to the eldest son. (They had 3 girls and 2 boys). Their reasoning is because the others didn't need the money as much, so they are giving it to the poorest child. Is that fair? Some may not think so, but it's the parents' hard earned money, and it's their choice.

The brother had full control of his mother’s finances and already got money from the sale of 2 rental properties and also the family home. The mother initially left nothing for the daughter but changed it in 2018 to give her 18%. The brother reacted negatively said he did not know why his mother did that and saw no reason for her to do it. So he actually wanted 100% of the inheritance. The brother is extremely selfish.

It would seem that she wanted to be valued equally and is shining a light on what she believes to be an archaic and bias tradition. It also appears the Supreme Court of Canada agrees with her. Our family ran into the same scenario with the my step mother leaving her money to my brother who would "carryon the family name". We all treated my step-mother the same , the bias came from the male have the family name. My brother split the inheritance equally between the siblings. It was the decent and logical thing to do.

Take it dry lady, your mother knew what she was doing. My Dad left his money to my siblings who didn't smoke, I was THE smoker. It was what he wanted. They felt weird/guilty and offered me an equal share, but I declined and told them to enjoy the inheritance.

I’m rooting for her 100%. This is an awful and completely unfair situation. Sometimes these decisions can be made while mental health, (memory), declines. It’s a difficult thing to navigate after the fact. What a horrible feeling for her to have to carry.

Do the research of what the cost of caregiving is in a facility is (24x7x365). The son , it seems, never participated in the care of his mother but feels comfortable with his 85% haul. Talk to any estate lawyer, they'll tell you exactly what I'm saying.

First of all, the property belongs to the mother, and she should have the absolute right to decide who to give it to or not, including the right to make unethical decisions. Moreover, the fact that a daughter would go so far as to tarnish her mother's name over a bit of money shows that her care for her mother was purely motivated by inheritance, and had nothing to do with filial piety.
