True to a point. However, sometimes it is a sign that the mental illness needs treatment. The chick called someone a profane name, she (evidently) didn't assault anyone. Knowing she has a mental illness, I would have probably ordered different psychiatric treatment before sending her to prison where alpha females and the guards are going to tear her up. Nothing was accomplished sending her to prison except having her victimized daily for up to three years, making her more likely to re-offend, not less. Group counseling doesn't work for everyone, she should have been sent to her community mental health organization for individual counseling. Prison isn't the solution for everything, especially in America where everyone there gets assaulted at least twice a week.

Far to often defendants are given chance after chance 1. Most of the time this judge is close to correct but I think she was way off with the mentally ill woman. If it was really just calling someone profanities I would have ordered individual mental health treatment, not torture prison (yes, I know Texas doesn't have the harshest prisons in this country). Even inpatient hospitalization would have been more appropriate IMO. If she had seriously assaulted someone at the treatment center I might feel differently.

Retired mental health nurse here. Judge Boyd's reading of MacFarlane's character was spot on. The Judge saw her minimizing of infractions at the program for what it was -- attempted manipulation. Judge Boyd gave her an extra year in jail because of it. "You cannot use your mental illness to be mean to people." is a classic. After experiencing years of abuse from SOME of my patients and witnessing a great deal of verbal abuse of staff, I wish I had known this line back in the day. It's so true!

This is my favorite judge, or at least tied with Judge Alex Manning out of Atlanta. I do take a little bit of umbridge with the comment that one cannot use mental illness as an excuse to be mean to people. This woman is being sent to prison for 3 years for being mean to others during mental health sessions or group therapy. It was hard for me to hear what the prosecutor was saying, exactly. What if being mean is actually a symptom of her mental illness. Unstable mood swings, etc? Isn't it a failing of the mental health professionals to not recognize that? I wish the judge had sentenced her to an inpatient treatment for her mental health, followed by maybe 6 months in jail, after a hearing that would include testimony for her treatment providers. Maybe she wouldn't need jail time at all.
@greydovegardens7688
@greydovegardens7688 8 месяцев назад
No, she didn't go to prison for being mean. She had an adjudicated sentence from a prior felony conviction. That is she would have avoided prison by following the terms and conditions ordered by the court like staying clean and sober, getting mental help and so on. Because she failed to comply, she had to serve her sentence. The court gave her all the resources to better her life and she essentially chose jail.

The assistant prosecutor leaving the proceedings without explanation is extremely unprofessional. Having worked with another state's district attorney's office, this wouldn't be tolerated in my state.
