To me it sounded like she was trying to prevent the guy from killing or hurting others because she thought he was drunk. But she kinda went overboard with it. Also i agree with nate i think the life sentence was a bit much. This was a tragic case where the guy lost his life and the girl maybe was trying to save other peoples lives but she got too extreme i feel sorry for both but of course the guy obviously did not deserve to be killed so i feel for him and his family more. I’ll just leave this here since “Fernando Ortega” blocked me after I replied to his comment that said “this wouldn’t have happened if it wasn’t for the police response time” by saying it had nothing to do with response time. His reply to my comment was “apparently you weren't listening in the beginning of the vid” Here is the reply I tried to post to that comment: I watched the entire trial, not just 1 or 2 min clips. I saw all the video, multiple times. In fact, there were multiple accidents in the area where this happened at that time. It has nothing to do with their response times. She decided she was going to handle it because she had a gun so she was “safe”. Not her job and she acted with no authority. She had many opportunities to prevent this from happening but she chose her actions. She didnt have to chase him down, dodging traffic and almost causing accidents herself. Having done that she could have just gotten his plate and told 911. She chose to cut him off by pulling the front of her car into his lane. Having done that she could have just sat in her car til the cops came. Instead she choose to get out of her car and approach him. She chose to scream at him to get out of the car and then when he didnt she choose to pull out her gun. She chose to scream at him “I will shoot you.” She chose to put herself into his window. This is all on her.

I'd hate for them to cause an accident and no one be around to help. What I did not do was try to stop them and force them out of their vehicle, I don't have authority to do that. They always tell you to not follow because of people like her who get too emotionally involved and make bad decisions. I felt felt obligated to make sure that if they did cause an accident at least I'd be there and could get an ambulance on they way or administer aid to any victims if needed. Her following was fine. I think that you have it exactly right. She would have done better to have pleading guilty of involuntary manslaughter if the prosecution would have taken her plea. Should have would have could have. There are many people who would like to help out, but you can't cross the line and become a vigilante. If you carry a weapon for self-defense, you should be even more cautious about your actions. You should be more willing to step back. You should be more likely to be the peacemaker because when it comes down to it and you have to pull your weapon, you're taking a big gamble. Do you save your life and possibly go to prison? Or do you put yourself in a situation where you have to make that split second decision of who lives and who dies? Once she stepped out of that vehicle with her weapon she made her choice and it was a very bad one. The pistol quit being her protector and became her convector and unfortunately the man's executioner. Like you said, you can't claim self-defense if you're the aggressor. The other issue here is that police more often than not have a poor success rate when it comes to theft. Let alone 20+ minutes after the incident and no cops are to be seen. Even if he was having a medical emergency and was trying to get to the hospital driving while impaired does make you a threat to others. He made a poor decision leaving the scene of a crime, I'm sure someone else there would have taken him to the hospital if needed, but if that medical incident was the cause of the crash he's in no condition to be driving. 1. I don't think there's any reasonable objection to someone just FOLLOWING the perpetrator of a hit and run, as long as the "pursuer" still follows traffic laws and doesn't attempt anything beyond collecting information to pass along to the police. 2. The problem is created when the pursuer attempts to intervene in some way. Which, this woman apparently did...while armed, and attempted to portray herself as an officer (at least in authority). 3. I don't know if her sentence is appropriate for the crime. However, it's undeniable that her punishment is NOT consistent with other criminals who committed WORSE crimes in WORSE ways for WORSE reasons. Perhaps she deserves a lighter sentence or they deserved harsher sentences. The problem is the disparity and inconsistent treatment. For instance: Bernie Madoff received 150 years for a Ponzi Scheme.

Although it's not smart, it's also not illegal for one citizen to follow another so long as they're not breaking any laws. Even if 911 tells you to stop, you don't have to - it's not a lawful order. This is why Zimmerman was found not guilty. Jury instructions (or maybe it was a clarification from the judge during deliberations) said Zimmerman was not breaking any laws when he didn't listen to the 911 operators command to not follow the (then) suspect. If she would have followed him and HE got out of his car and confronted her and attacked her, she would have been justified in using her firearm (assuming she felt her life was in danger in the moment). But because she brandished, she is ultimately at fault. There really wasn't anything criminal about her behavior until she brandished. Now, if she could successfully convince a jury that she didn't brandish until her life was in danger, that is, if he attacked her in some way, then she would probably not be guilty. Sad case.
