It's also not a metric that was ever communicated to her, she wasn't given an opportunity to explain her performance, and she wasn't given an opportunity to improve her performance. The problem is most companies can't quantify what is good performance. That's why sometimes the only thing you can do is to appear to be a good employee but not try to "be a good employee".

I saw so many people ragging on this woman for recording it and posting it. I don’t know why. The company literally wasted her time and left her with nothing because their finance department can’t do basic math and overhired people.

It could be that some were bitter they didn't have the courage to do what she did but others can make the argument that since she posted this online not only would this follow her but future employers may not want to hire her because she could be a liability to the company. This is especially more dangerous if you're in a niche industry because everyone knows everyone and one hair out of line could be the end of your career.

They should just be clear. We are forced to lay you off. Your performance was stellar, unfortunately we are asked by leadership to lower headcount and we decided to let go of people with least amount of experience at the company. We are happy to give you positive review if needed.

@@Venjamin RE unemployment-in the state I live in, that can be challenged with a decent attorney, short of voluntarily resigning or committing a crime on the job, you get unemployment. My employer has laid off several people here, in each case they tried to deny unemployment to each person they cut, they lost, the workers won.

You mean word vomit... In 2023 165,000 tech workers were laid off in the US meanwhile there are 584,000 H1B foreign worker visa holders in the US. Let that sink in. Politicians have been selling the jobs of tech workers to Indians and other H1B workers for over a generation now.

When you interview for a job, assess what problems or events may be there that could pose 🚩 or labor issues, disputes later. A QSR counter job for $12.50/hour or a $46000/yr salary office 🏢 career job. Be realistic & know what you are going to get into. I was fired, 12/2023 private security. I KNEW the contract firm had a bad reputation, was poorly run. It had 60% - reviews 🗣 Indeed. The patrol 🚓 vehicles were trash & the officers were inept, unreliable.

fired because Wilful, intentional poor performance, negligence equals misconduct. You will be denied benefits for that. But not for probationary period poor performance or not a good fit, inability.

What’s so messed up is that random people who she never knew somehow were the ones to let her go and couldn’t even have her boss tell her directly. She was hired to fill a req requirement and then some greedy C-level exec got mad because their bonus wasn’t big enough so they had to get rid of people.

One time when I was laid off they did make my boss attend and they sat there on screen trying not to cry and saying nothing. Any time one of the people fired tried to talk to her they got cut off, she wasn't allowed to speak, she was just there as a sort of muscle behind HR's words.

If it's really on the side of company, they would knew that absence of clear amount of work and performance quota metrics is poor for productivity and company. They are just doing the script they told with no care for company or employees. They on 90% can be replaced by advanced statistics AI software which will do the job better and when that happens and HRs get booted, don't be sorry for them.

That's not HR's responsibility. She *ought* to be having his conversation with her boss or bosses, formerly or not. No doubt she does not have access to *those* people(s). Thus she inflicts this upon the HR personnel - the messenger(s).

Everyone complaining should realize that it is 100% legal to record workplace labor issues under the NLRA. An individual State recording law does not apply, this is federal labor law.

She's also a remote worker in Georgia I believe which is a single consent state. Anyone who's in the conversation can consent to recording the conversation without the other party's consent … Its perfectly legal what she did!

They're supposed to protect the company from lawsuits but they usually can't do that whatsoever so . . . yeah literally useless. My own HR are completely useless, miss meetings on a daily basis, don't show up for their scheduled in person meetings, etc. They're off the walls corrupt, I'm surprised they haven't been sued for time stealing at this point because nobody can contact them and they never show up so I can't imagine they're actually getting anything done.

Idiotic statement. HR people handle new hire paperwork. They process raises, promotions, and org chart changes. Without HR no personnal changes ever occur. Nobody ever transfers or gets promoted or gets a raise. Oh, you think managers can handle all that? Managers can't even complete employee timesheets half the time.

I got laid off last year from a major game company along with many coworkers, all very talented and good workers. We were laid off by being divided into small groups on Microsoft Teams and a PRE-RECORDED VIDEO from HR was played to tell us we were being let go. Pre-recorded video. And what happened afterwards was everyone who was being laid off had 45 minutes to get personal files off our work computers. We spent that time with our coworkers remaining saying goodbye and exchanging contact info. Was honestly one of the saddest things I've had happen at a job. What do my previous coworkers who are still there call that massive lay-off wave that cut the office staff in half? "The Snap".

I know a situation when a person was let go for “low performance” despite all positive feedback from the management across multiple departments/projects the entire year and with absolutely 0 prior warnings. In the end the “employee separation and release “ was sent where there’s no any explanation - just an agreement between a company and employee which confirms a separation… I’m wondering if it’s a legit reason for unemployment in this case…

This is the consequence of not doing layoffs with severance. The whole point of severance and layoff benefits that the company can protect itself from this kind of bad press.

Exactly, most are smart enough to realize that, but apparently CloudFlare wasn’t. When I got laid off from my company last year, they offered severance, not because they wanted to but because they were desperately trying to keep up appearances with their clients and not look like a sinking ship. It’s hush money, and it often works.

Yep, when they pay out a severance they usually make you sign a severance agreement in order to get the money. Severance agreements usually contain a non-disparagement clause. You cheap out on the severance, and you can't buy people's silence. That's how they get bad PR like this. The good news for this girl is she can now claim unemployment. The company may try to counter, saying it was performance based, but then she can appeal. They company WILL then have to prove she was fired for cause to an administrative law judge - the HR word vomit won't work there. In all actuality she'll be able to receive unemployment compensation.

They wouldn’t have allowed this recording if it had been done in person. I’d bet they wanted to get rid of her without severance, hence the “doesn’t meet expectations”, but if they formally fire her for it they’d have to write it up otherwise this is a certain lawsuit.

She had only been there a few months so severance not likely an issue. She was in sales and hadn't sold, and that's the only metric that really matters in the longer term. From what she said it sounds like her manager may not have set expectations and given feedback clearly - I don't know about this case but in general that's fairly common among junior managers (in particular) who want to be positive about everything and to be everyone's friend. Though sometimes people just don't absorb negative feedback when they do get it.

If she can't speak on it, it means she had no idea what the managers position was, when, in fact, if she was being terminated for a valid reason, That conversation would be cited. I would have loved if she would have asked HR, in their own words, what does she do at the company. I would wager they couldn't tell her.

Yeah, that right there is a red flag should this ever see a courtroom. You haven't spoken to the manager and yet, you can definitively, without question, say she isn't meeting her performance goals? Then how do you know? Are you spying on employees and have all the data? But wait - in that case, you should have the metrics she isn't meeting without having to talk to someone else!

This is so the fired employee can't come back and sue for wrongfull termination. The fact that two HR drones are doing widespread firings and can't cite any reasons means that this is coming from the top and not her manager or possibly even her department.

Used to think it was me, and nearly worked myself to death trying to meet expectations that were somehow magically always out of reach. Then one day a manager said to me, I have to be honest with you, this is a thankless job, and even if you meet all those extra KPIs, you still won't get anything more than meets expectations. And that was me stating my intention to meet all of the next level. They will never reward you. Never. They will milk you until you give your last drop of blood then when you collapse, fire you 'for your own good'. I hope Gen Z maintains this fire of rage they have for this treatement because once you're trapped and financially dependent with no parents to fall back on, you have no defences against exploitation.

Circling back, with you in the future, just gives you and the corporation time to make a good reason to tie up loose ends. They may be seeking a way to avoid paying her severance pay based on the b/s reason of "poor performance". If she can obtain admissions and proof this is not the case, she can claim her entitlements, but if she says nothing and accepts it, she may walk away with nothing. It is evident from this conversation that there are no actual "performance metrics" of the kind they claim exist to prove poor performance, and indeed it is b/s.

It depends on employment laws in that state. In certain states they're actually aloud to fire you for no reason. Unless you specifically get fired for having a disability which I was able to get a settlement for when I was fired.

Let's be honest. Companies know that they have to hire many junior sales execs to have one exec who can actually sell something. They have to over hire constantly as they have to fire most of the new execs for the lack of sales. I have talked lately with my old colleagues and bosses. Companies are now trying to avoid these graduates and hire more experienced sales people who have some kind of evidence that they can sell something. It's easier to pay extra for experienced people than play games with these gen Z graduates, who don't even know what it means to work. There is no participation trophies in business. That could be a big surprise for the young people, who have their cupboards full of participation trophies from their early lives. She had five months and didn't close any sales. How they fired her was s*it show but the reason is pretty clear. Great meetings and a lot of activity is nice, but only sales will count as a performance. I have been in sales for a long time. These big companies are sales "factories". If you can't sell instantly, you are out. They will not wait a long time for results. There is always a huge pool of new candidates, who want these positions.

I've been working at my current job as a contractor for the past 6-7 months. my contract was supposed to end 3 months ago. for the past 5 months, they've been telling me they are going to make me a full-time employee because they like me so much, but it hasn't happened yet. whenever I brought it up, they always have an excuse like I have to talk to the middle company then to them so on and so on. now I'm looking for a new job. there is no need to be loyal to these companies.

My daughter was in that situation for like a year and a half. She finally got an offer for a newly invented position. Her pay was cut a little bit since she was on salary with taxes taken out and eligible for benefits. Hopefully, it works out. I don't want her learning to be loyal to, or dependent upon, some 💩 company.

@@keithparker1346 In the U.S., each state administers its own unemployment insurance program. Most of the funds come from payroll taxes paid by employers. If you voluntarily quit or if you are fired for cause, you are not eligible for benefits.

Not all positions are entitled to severance pay. I was laid off in 2020 and received no severance. That's at the companies discretion and employers aren't obligated to offer it. It's usually for high level employees, not lower level ones, from my experience.

@Cerez78 I know, however if they have an established severance procedure already, they can't break that policy, so they often fund loopholes, like firing people "for cause" like not meeting metrics instead of laying them off. If they didn't have a severence policy, then they are not obligated to have one, but if they did, they would have to follow it. I work in quality management systems & compliance.. so I am always looking at procedures my employer has, including HR policies. My employer does have one, and there is provisions of what qualifies for severance and what doesn't. Being fired for cause disqualifies an employee from any severance. Workforce reduction and resignation due to your position relocation does qualify. That is why I speculate they were trying to get around their policy

That’s how my meeting went. My husband had just gotten brain surgery & I had this meeting in my laptop by his bedside 💅🏾 Then when I went to the Unemployment office, they couldn’t find where the company paid for Unemployment stuff. By the time that got figured out, I had been working at the family business temporarily because I needed some kind of check, but since that was now my last place of employment (again, temporary), I could no longer get unemployment from them 😐😐 I’m grateful my husband is back to normal. He was in the hospital for two weeks & had to drop out of school to complete his last semester after being out for 20 years.

Whenever you get fired, just walk right out the door. Don't even say goodbye. Since you no longer work there, what are they going to do? Fire you? Yeah, she was deslt a crappy hand. She only had a solid 3 weeks of being fresh on the market. I work for a large corporaate bank - top 6 in the US. I remember when they did a big layoff in November. They let go of 4000 people out of nowhere. It was Tuesday after Veterans Day. People logged in and were invited to mass meetings where they were told they were being let go. I told my manager that i dont feel secure in my position. I'm always keeping an eye open for other opportunities. Never trust a corp and always do what's best for your career.

I had a company fire me for performance reasons a month after giving me a raise and praising my performance. They gave me a side task in addition to my other duties, and a week before firing me sent me an email and said they needed that side task done sooner and it was taking me too long. They gave me a deadline, (which they had never done before BTW) so I then responded by completing that side task in like 2 days and went back to normal duties. At the end of the week they called me in and said they were letting me go because they didn't think I was a good fit for the company. Before letting me go they fired an intern who hadn't been there very long, an employee who wasn't very reliable, and missed too many days (makes sense) and 2 guys who had been there for a long time. After me they got rid of another guy who was in my same role. Obviously they were downsizing and not firing me for performance or conduct, they just wanted to make it look that way so they could deny unemployment to us lol.

Saying she isn't performing while not giving her even the metrics much less what is behind those metrics should be grounds for an illegal dismissal lawsuit even if the employment is at-will. How is the employer not obligated to give the employee information what is expected of her work even if it is an at-will employment contract if that isthe reason given? If they wanna fire her just because at-will means they can, then that is what they should be required by law to say that specifically. If you make claims about someones performance or lack thereof that is making potentially defamatory claims about that worker, especially if you do not even get the metrics or what they even mean.

When you can just get laid off for no reason, why would any Employee want to go above and beyond for your Business, why would Employees stop looking for better opportunities even though they work for you. There is no loyalty from your end, so don't expect loyalty from the Employee's end either.

I got put on a pip for performance. They milked me dry trying to meet their perfomance metrics and I was so proud i did even tho no one else was being held to these standards. Then on my meeting where i expected to be let off the pip they came up with some other excuse to fire me because they couldnt use performance metrics since i passed them.

We've normalized that "performance" only matters on the lower rungs of the corporate ladder, that we don't even ask the question: if everyone's working according to the plan, and that failed, then how come none of upper management needs to resign? If the employees were off then how come they were not noted about it in a time way before? If in a scrum team, for example, I have to explain every day of mine in a standup, how come these folks have 0 transparency? That's not professional! That's exactly playing games with people who has to make a living.

For even more context, cloudflare has an average sales cycle of 4 months, with bigger deals taking 6-9 months. So she literally had like 2 real months of work after training, or half the average length of a sale.

I've been there and this is 100% accurate. It sounds like if you had only programmed a chat box to have 6 lines so if you press it the bot just keep repeating the same 6 lines over and over The "I understand" and "Your feelings" bulshit is them trying to get you off their back thinking you're stupid. Good on her for pressing them. In my last job I literally laughed in their faces and called them out on their lies to their face and they didn't know what to do

I don't think I've ever heard someone respond to questions with the words "100 Percent" and then proceed to be fully transparent with that person asking the questions. Its often a segway into lying, omission of the truth or some vague language shenanigans.

I got fired once and I was well aware it was going to happen. I had three written warnings for falling below clearly stated metrics, I failed to meet them cause I hated that job, and I was fired on the fourth incident. Yes, it was cause of 84.5% instead of 85% QA, but I still new it was going to happen. This is hugely surprising and I hope the bad press from her tiktok does something

The problem is that they tie "metrics" to it when "at will employment" is at will. They don't need a reason, and you don't need a reason to quit. It just is what it is. They shouldn't have said she didn't meet performance requirements.

Check out the WARN Act, there's a time component to this. You can lay people off for no reason, what you can't do (if you have enough people) is decide tomorrow you're going to lay people off for no reason.

I'm not totally sure of the ins and outs, but I worked for a guy that did seasonal work and he told me to claim unemployment because he had to pay no matter what.

Most "at will" states still have rules. They aren't lawless and workers do have rights. Like a lot of people are saying, they don't want her to get unemployment (which is paid by the firing company) or severance. This video is proof that they are lying aka sue their ass!

They're terminating her for cause, otherwise they'd have to pay unemployment or severance. And instead of laying her off because they overstaffed, they applied a bell curve to everyone in such a way that even great performers didn't meet "performance expectations." This type of thing happened to me back in 2023 in tail end October. Corp I worked with said they thought I had skills that I didn’t. I told them in the interview I didn’t have those skills. Still let me go & wasted my time. I was unemployed from November to January. Happy holidays

I had a similar experience with a US start up, they hired too many agents for customer services, then a year later they automated the whole process and they started to fire people in bulk! No warning, no nothing. Just a videocall with another 6 people in which we were told by a total stranger that they no longer needed our services. It was traumatic, nerve wrecking and absolutely disgusting 😡🤢🤮 The company only lasted for another year then they lost their major investor and the business shut down, they had their own karma.

“You as employees have not met our goalpost moving arbitrarily standards of performances!” Really though they just want to cut jobs down to a skeleton crew that works cheap or for free if they are -slaves- “interns”, just so these executives can buy a new luxury auto, yacht, or another vacation home. Don’t even work hard to meet quotas, or earn high evaluation scores. Your boss will make the money and then decide to be rid of you.
