@@fireoptions You don't need them to arrest you to sue them, the court should have in consideration that he was going to be arrested if he didn't gave his details, just make sure they state that for the record as he did, put yourself in his place....being arrested could mean a couple days in jail even tho that much time wouldn't be reasonable in this case as stated in law.... paying a bail.... who knows how hard they want to make it for you, anyways....
"I'll see you in court. That's fine." Is every police response to an unlawful detainment because it doesn't affect them personally. There are no consequences for their unlawful actions, and that's what's wrong with the system. Police like them can run around making wrongful arrests and detainments all day long and nothing happens to them. The biggest and best change to the system is to fine them personally for things like this and they will learn and pull back and follow the law better. Until then, ignorant, unlawful police like this will carry on.
A recent ruling in Osman v United Kingdom might have opened the floodgates for Civil Liability claims against individuals for not complying with approved practice.
