You and your attorney, the Defense attorney, and the claims adjuster for the Defense insurance company. And the Mediator. The actual Defendant rarely attends mediations.

It could mean a few different things. One is that someone was not prepared. It may have been the insurance company adjuster may not have enough information to be fair and reasonable. Or, maybe the adjuster has been told by the defense attorney that their evaluation of your claim is too low, and they need to bring more money to the mediation, and now they have to go up the chain of authority to get permission to pay you more money. Or, maybe someone had a scheduling conflict such as being called to trial in another case. I suggest you speak to your attorney and ask them why do they think the mediation was canceled? Ask your attorney if they agreed to another date before canceling the mediation? Best of luck and I hope you get a great result. Matt

Did you get your case mediated?

Hi Lara, Your question causes me to ask you a question. Did your attorney get service upon the bad driver with the law suit? And now they can't fine the driver? Or, did your attorney file suit and can't find the driver to serve him with the complaint? Lets assume that your attorney served the bad driver with the law suit, but now the insurance company can't find the driver. In this case, you and your attorney don't have to worry because it is the insurance company's job to find their insured. They should not be able to say at mediation that they can't settle the case because they can't find their driver. They have a duty to settle the case with you even if they can't find the driver. If you and your attorney were unable to serve the at fault driver with a law suit, then your attorney needs to seek "Substitute Service of Process" And in Florida, you can serve the Florida Secretary of State instead of the at fault driver. I am sure there are similar laws in other states, but I am only familiar with Florida law. Good luck with your case.

+MattLaw My Attorney filed the suit, and told me he can't find the other driver. Can this go to mediation asap, if the at fault driver can't be found? Any personal injury case can be settled along the way. Many cases settle before a suit is filed. But if and when you have to file suit, there are still many opportunities to resolve your case. Even if your case does not settle at mediation, it still may settle before or during your trial. This is why selecting a lawyer who is comfortable with a trial is so important. Hi Matt Law, I have a question reguardin the car accident case, there was a motion filed for alternative service and the Insurance company has up to 20 days to respond. my question is What if the Insurance doesnt respond within 20 days.
