I think it's not maximum 7K. It should be , case 1 - minimum 7K or minimum wages whichever is higher and case 2- if minimum wages is lower than basic+DA then bonus wl be on MW. (As per bonus act,as per my opinion)

Plz tell us, what if Bonus act is not applicable to employees though it is applicable to business but still business is paying bonus to those also who are not supposed to get bonus n showing it in it PL A/c.. And also what about employees whose monthly sal. are not fixed i.e, employees getting variable pay.

@labour Law Advisor One labor law consultant told me that Bonus should be paid at Gross salary now. You have mentioned Bonus calculation at "Basic+DA" = Gross. So what should I understand that in your example, gross salary is divided in only two heads? i.e. "Basic + DA"; that means his/her gross salary is 7000 & if there was other heads those also would be included or what? Please clarify.
Are contractual employees or 3rd party pay roll employees eligible for bonus ?? Who is responsible principal employer or Contractor. Please give the Act link.......

For the first 5 years, organizations need not pay bonus if they have made losses. If they have made profits in any year in the first 5-year period, they will have to pay out bonus for that particular year. After the completion of 5 years, organizations are required to pay bonus as per Sec 16-1b, irrespective of whether they are making a profit or loss. Refer to section 16-1b for detailed clarifications on the calculation of bonus in the 6th accounting year and the 10th accounting year. What's your say???
Is it not correct, that there are several Supreme Court's judgments around the payment of bonus even if the organization is not making any profit? Need your comment.
Please re check Excel last workings .limit of government minimum 7k ,so why calculated on 7k ,if basic salary above 7k,bonus is calculated on basic which is more

As per payment of bonus rule only employer earning more than 21k is not eligible for bonus? Why some employer still paying? Can a employee earning more than 21k seek bonus?

If a employee's salary increased in a particular month during thr year which cross the wage limit of Rs 21000, he / she will get bonus for that months ( wages below 21000 )/ whole year ?

Hello sir.. i have one query.. my company h 4 verticals.. one unit is having profit but others are not having profit.. can a company only pay bonus of 20% to profit earning unit and less to other unit. Complete Balance sheet is showing profit
Mere company me 20 se Kam employee hai employer pays bonus to all whose salary is above 21000 or less.company is always in profit and and company' is 15 years old.please tell me if a employee is terminated before a month of Diwali then is he eligible for bonus in his full and final settlement.If company does not pay bonus only that terminated employee then he can claim it to labour commissioner?Though the employer pays bonus for the last 10 years.
