I'm in! I cut my wrist on barbed wire in Colorado because they ran the barbed wire across the river. Not to mention, the number of times I was told this is private property. Water ways should all be free to the public, just like how they do in Florida with the coast line

This is so stupid. You can’t own the fish. There needs to be easements on the banks. Streams and rivers are some of the most peaceful and best places to fish. Thanks to all the Karen’s out there who want to ruin peoples lifestyles.

This has everything to do with money. Private access means they can lease the land or have people pay to access those fish. What needs to happen is the state needs to levy extra taxes on private landowners who own stream beds with vibrant fisheries on it. You can't claim private water and then be angry when you have to pay for that extra support from the state. But watch how fast they scream about it! Our public tax dollars should not be used to unjustly enrich landowners who own portions of the stream, mainly through State and Federal stocking programs.

This has been going on for decades. In the seventies I was canoeing on the upper hooch at smith island when a guy came running down the bank with a German shepherd and waving a big pistol. I was already in the rapid so I couldn’t stop. Part of the problem is the slobs that walk the banks fishing and leave trash on the landowners property. Which pisses the landowners off so they post their land. I can’t really blame them. Walk any of the paths around Lanier at the public parks and you’ll see trash everywhere. Some people are just pigs.

I agree 100% with your statement however, all those park fees the public pays are supposed to cover grounds keeping as well as we were told but it rarely happens. Both are to blame and I feel some 9f the polluter folk believe it should so they test it and leave their garbage behind.

Private ownership of otherwise public waterways is an EXTREMELY dangerous precedent to set. It opens the door to corporate ownership of rivers and streams.

I think a navigable river back in the 1800s would be different than a navigable river in today's standards a boat in the 1800s needed a lot more water to float it nowadays a kayak can float in inches of water so navigable needs to be updated

This keeps coming back up. Two things, a person can own the land in the river on both sides or to the centerline of the river or creek. The water above ground and the fish that swim in it are property of the state of Georgia. Also, It is a law that you cannot disturb or harass someone in the act of hunting or fishing in the state. There are so many incidents in the mountain trout streams about this. Someone buys land on both sides and tries to post the water that runs through it. If you are standing on the bottom, it is trespassing. If you float through fishing, legal.

Hey, I can definitely appreciate Land Patent holders of Land and their Rights to that land, including any waterways that may border or go through the land entirely. That's how this Nation was laid out from the beginning. That is how "Private Property" is to be regarded and respected. However, I do understand how you or anyone else could get confused, especially if it's not clearly marked, and the fact that, it's been over a century that all the land in America was held in Land Patent. Fact is, every American should hold and own their land, period! The bigger problem is Land Rights and how they've been infringed upon by governments. It's not like the entire river is private, but on the flip side, maybe it actually should be all Private? Cause at that point, that means the People own their own land and not some 3rd party or government interest in the land. We should all be Land Patent holders in America! Love your channel! I do a lot of fishing but not from a kayak so accessible for wade fishing is even more difficult but if the state stocks any waterway the public should have access it’s our money stocking those fish so I should be able to wade the waterway and fish and I also understand the land owners issue because way to many people don’t respect the land and water leaving trash behind which doesn’t help those of us who leave nothing behind

In my state, if you can navigate the wayerway in ANY watercraft its navigable! Even it's necessary to drag it over shallow rocks for short periods! As long as you dont trespass to reach the river, or get out and wade fish its legal. If I float I fish! Easy as that!

the just have to include language that at normal water height is public fishing access. if it floods then you cant go up into peoples property but still have to treat it as if was at regular water height. which most states do.

Fortunately, Navigable Waters has already been defined and upheld at the federal level. “those waters subject to the ebb and flow of the tide shoreward to the mean high water mark and/or are presently used, or have been used in the past, or may be susceptible for use to transport interstate or foreign commerce. Not having a solid definition of navigable water is a problem. It would be easy to limit it to water trails that can be navigated by a cargo boat but just like some land can include water or mineral rights, this particular section of land has fishing rights. I have never heard of such a thing but at east they can't stop you from kayaking through. Will be interesting to find out if state laws can over ride these private fishing rights.

Not a chance, Federal Law trumps state law on navigable waterways. There are no such things as private property rights on rivers. That story has been settled since the early 19th century.

State law trumps federal law meaning any state doesn't have to adhere or enforce federal law much like how marijuana is federally illegal but a few states have deemed it legal BUT all of the being said as far as being state owned the people compromise the state meaning it's everyone's river aka public property,public being the residents of said state

The land title going back before 1863 land grant... that's VERY impressive and I hope the family keeps it for generations to come. The guy is just trying to protect what the court has already ruled in their favor... I dont think he is against the fishermen as much as he is just trying to hold onto whats legally theirs before the government takes more away from them.

The state legislature passing that resolution earlier this year didn't do crap for helping fisherman. They need to write a law that defines what navigable Waters is in Georgia. Navigable water should be any water that you can float down in a Kayak/Canoe. You want to claim public water that is stocked with fish with state and federal tax dollars.... Fine, but you can pay Extra Federal and State taxes on that land that'll go to stocking and maintaining that stream. Federal and state tax dollars, as well as the monies used collected from getting fishing licenses should not be used to stock and maintain streams with private water on them!! You can't have it both ways!

Always a way around these people, property records for your state/county can be found. Stand just outside of the property cast into the area, do not let your gear touch the bottom of the river. Problem solved. They dont own the water or fish! I have the same problem in Washington State. Most all public waters are surrounded with private property and some own the ground under the water.

The navigatable water should be defined as the natural water way when in normal full flowing conditions. This would make any flooded lands private and not the natural yearly water way that's public. Anyone caught passing through fences onto private lands would be subject to punishment by law. But all navigatable natural waters would be legal to anyone to fish from a vessel and or wading. I don't think it should be limited to floating vessels only. That would prevent many fly fisherman that choose wading and fishing. I too think that it's upsurd that someone won a law suit to claim public waters as their private fishing spot. Really shouldn't have ever been a issue in the first place of they don't mind people floating through, fisherman float through fish and move on. Just like the fish move in and out of that area and may not even be there during the time anyone is fishing there smh.

What the one land owner wants is akin to old English law where everything is owned by the “lords” of the land by title. Sickening. Now, during high waters and floods, that’s an area of policy that should be well defined to protect land owners and boaters alike.

How can you grant someone ownership of the fish in a public accessible body of water that is owned/ maintained by the state or federal ? If that's the case all the fish that setup in that stretch would be deemed private property ? So most fish downstream of that stretch you are not allowed to catch orrrr ? Wow that's very confusing. I don't understand how a property owner that lives on a river would say, that is my river bed, my water and the fish that are swimming in my water are mine and no one else can have them. Just because you can, common sense tells me I shouldn't. It's like children fighting over the sand in the sand box. This is something the feds not the state should get involved in. All moving waterways belong to everyone. If that river gets polluted, is this land owner going to be held responsible for clean up. Can that land owner dam the river?

The guy who is leasing the property will have his hands full. I would tell that guy to throw in the towel and not try to be the river police, it isn’t worth your aggravation and it will be never ending. An older guy, getting keyed up over it in 100 degree temps is a recouped for a heart attack/stroke. Not worth it brother, not worth it. Plus, you never know when you run into someone crazy

They might own the land under the water but they do not own the fish or the water. If the want to make the claim that they own the water a neighbor upstream can charge them for the use of the water crossing their property.

I could understand if this were still water and the fish had nowhere to go. This is a river with heavy current. Its not like there is a population of fish that live there that need to be protected from outsiders. This is a joke. I pulling for the fishermen. If I owned the both sides and this was the rule. I would ignore it and let people fish as long as they entered in a boat.
