That’s for subpoenas. But you can always just ignore a cease and desist, they don’t have any real legal effect. It’s just an expensive way for one party to threaten a lawsuit, but no one is in any way required to abide by the demands of a cease and desist, regardless of whether it was properly delivered to them or not.

a C&D isnt a legally binding document. Furthermore, the C&D was sent to Ethan after the fact. Thinking like a lawyer, yes, but its not always that simple.

You can ignore a cease and desist. They literally mean nothing. Hit me with the actual lawsuit.

Not only that, but sending a cease and desist for such a minor statement about who copyright-claimed H3 is extremely damning for Colleen. It serves as a kind of unintentional admission of guilt. If the allegations were demonstrably false, she’d be sending cease and desists to the people accusing her - not bs copyright squabbles

"The fact that Colleen searched out for that" That's not a definite fact because it ignores the possibility that the lawyer approached her, or her team, or that her team searched for and/or hired the lawyer. Regardless, it's not a positive association.

Ethan said this in the video and that could be considered slanderous. Colleen’s lawyers may use this comment as evidence that Ethan slandered her and caused damages.

​@@apex7640 defamation/libel- in England at least I'm not familiar with US law but I have to assume its similar - only has grounds where the statement is 1) intended to cause damage to reputation and spread in order to achieve this goal, 2) damage has been sustained to the career or earnings of the person slandered and 3) the information is *false*. so she doesn't have a case for slander because its true that her Attourney reps the accused in high profile SA cases, and there's what any jury would deem as sufficient evidence of wrongdoing for grooming. so tbh I think, unless laws differ greatly in the US, ethan should be alright

I was thinking the same thing while listening and scrolling the comments. I made some cracks myself, but you are right. There is absolutely nothing fun or funny about any of this. She clearly behaved at least immorally and hurt people. This needs to end soon. It's sad that so many people are paying as much or more attention to this than, for instance, the fentanyl crisis, which has gotten worse in the last several months alone. And so much more. We are under siege, but instead of making everyone happy with her considerable talent that I believe she does have, Colleen chose to 'poke a few holes' in this ship we call American society, alongside the bigger ones made by our most damaging issues, such as the aforementioned drug problem. Sad.

I'm in Canada but when I was served papers by someone I missed a court date cause they served me via email lol it's definitely weird you had to establish previous contact with the emails. I would choose registered mail if I was gonna sue tho, I very easily made my case in court because I missed my email so no legal consequences for missed court date. Kinda went off topic but wanted to provide some context for an email serving situation 😅

If she was going to, she would have tried harder to silence them imo and she would also have to *prove* she didn’t do everything she was accused of, which she has pretty much already been convicted in the court of public opinion with very compelling evidence by very sympathetic victims (I.e. CHILDREN at the time) She’s also potentially broke laws so I highly doubt she would want to go anywhere near a court against Adam, Johnny, Becky, all the people she’s hurt and are passionate about telling their truth. Especially with potential witnesses like her ex husband and the writers assistant who wrote an article about working on her Netflix show accusing her of wanting to make the uncle “more rapey”. I mean who knows what else hasn’t even come to light yet. What if there’s more? What if it’s worse? What if it’s illegal? She hasn’t even gone after Adam for him accusing her of being sketchy with her fundraisers. Idk. Time will tell though 🤷🏽‍♀️
