He just did a year for beating a 67 year old woman. If law enforcement and the DA's office refuse to do their jobs, then citizens absolutely have the right to defend themselves. You could not be more wrong if you tried to pass 3rd grade grammer or arithmetic. Just be happy they were embarrassed for you and figured 3 years of the 3rd grade was enough.

there are ways to restrain folks without choking them. and there are many physical illnesses that can cause people to appear to be on drugs. Then, this dude says, "He (Jordan) stepped onto the train and appeared to be on drugs". Penny is not authorized to make that (clinical) assessment. No one is authorized. Also, Jordan was not taller than Penny (See public records). Also, Jordan was hungry and thin as a rail. He needed a meal and lots of help, which help did not require three males gang-bullying against one skinny hungry homeless man. THAT is NOT proper Restraint protocol. Jordan did not have a weapon and he did not touch anyone. If, hypothetically, "restraint" was needed, all males should have used what all Psychiatric Hospitals use, i.e., "Handle With Care" restraint technique, which NEVER ever allows for chokehold. Give all 3 attackers many years of Community Service helping homeless population (all day, all week), in the most dirty parts of NYC.

But I have to admit that I won't do that anymore so easily. Too many people that tried to help have been stabbed. Times have changed since the migrants came.

I guess at the court trial we will all know the facts of what happened. If i were one the jury at trial i'll be wondering can his defence team provide evidence that neely was found in possession of a deadly weapon such as a hand gun or a knife, prior to making those threats and that he was quickly apprended? On those bases, I think that he's only chance i'll be found not guilty. Also i think even if it was for only 5mins ,it seems in this context a chokehold was extremely disproportionate means to apprehend an assaliant.
There were witnesses on a news clip shortly after this happened thanking him. I'm sure they are out there, unless they were removed for whatever reason.

I didn't hear any claim by Penny which, if true, would exonerate him. He should just plead guilty. Why do we have to pay for a whole trial when the facts are really not in dispute? You can't just kill people for the offense of yelling. He could have easily held Neely without cutting off his air supply. He is a marine, trained in combat. He clearly outweighed Neely by a lot and is clearly much stronger. He killed him because he was really upset by his behavior, and that's super illegal and if we are going to have laws this guy needs to be in prison for at least 20 years.
