Marine veteran Daniel Penny has been charged with second-degree manslaughter for the New York City subway chokehold death of homeless man Jordan Neely. Penny decided to restrain Neely after he allegedly started threatening people onboard the train. Now - politicians and celebrities are raising money for Penny’s defense, calling him an American hero, while others are calling for justice. The Law&Crime Network’s Jesse Weber breaks it all down with former Watergate prosecutor, and former assistant United States attorney for the Southern District of New York, Nick Ackerman - who weighs in on the strength of the case.

Use his mugshot from when he kidnapped a 7 year old girl, or from when he punched a 70 year old woman in the face and broke bones in her face, or one of the 40 other times, but no, you chose to use a decade old picture of this psychopath and one of the marine in hand cuff and not one in uniform or with family. You are trying to paint a picture and drive a narrative, and you have the audacity to say "putting politics aside" by the way those 15 months he served were for kidnapping a 7 year old girl

It’s absolutely ridiculous to suggest that there has to be physical contact before self-defence can come into play. Why should I have to wait until the person who is threatening me hits me before I defend myself? Why should somebody who is watching somebody threatening me and approaching me have to wait until I am injured before they are justified in stepping in to stop the assault? That’s not how the law works at all. The law requires that a reasonable person would perceive a risk of imminent harm, *not* that the harm is in progress

The average time between stops for the f- train is 2.111111 minutes. They're really running with 15 minutes, which would mean he held him for multiple stops, without any intervention at the platforms. It's ridiculous on its face.

You can't claim self-defense against an unconscious body. Neely went limp and was incapacitated, but Penny kept choking him for another minute. It's sad all around cause Penny was obviously trying to do the right thing, but legally he's toast.

Someone should ask a jujitsu master on what kind of hold it was. Usually the person being restrained calls down and the problem taken care of at that point. This man was not calming down that's why the restraint was for so long, and he put him in a recovery position after.

There was another incident in NYC like this not too long ago that made it to the news. A homeless man who was clearly off his rocker just walked up to a mother pushing a stroller and tried to literally take the stroller with the baby in it… in broad daylight surrounded by hundreds of people. A civilian put him in some kind of hold on the ground and had to hold him like that for like 15-20 minutes because it took the police so long to respond to all the 911 calls. No one died though. This kind of thing happens ALL the time, but it doesn’t usually end like this. I honestly don’t know what to think about this yet except it’s very sad the victim mentally deteriorated for so long that he was even in that state on the subway in the first place. It’s really out of control and scary. Idk what to think but I can see both sides of the argument. We can’t have people out here acting crazy and scaring the public because you don’t know what a crazy person is gonna do… but at the same time we can’t have people out here ending lives because they don’t know what someone is gonna do. I just can’t say whether or not he took it too far until we can see all the evidence… and the burden of proof is on the prosecution. If he is convicted of anything, I do not think it will be murder.

We have to put things in perspective. This is NY city, where only few months ago and at least a dozen times in the last 3 years, people have been attacked and killed in subway for no reason. Some of these cases have made worldwide news for how violent they were. To be sitting in a moving subway in today's time and a man shouts saying he doesn't care if he dies etc. To say that wouldn't make some feel threatened is not living in today's reality. When you don't have proper enforcement, security and homelessness management, things like this scenario can happen again. Homeless and other individuals can go on as free riders or camp inside, when this continues and goes unmanaged- the city and MTA system is putting riders in the front of the line to fend for themselves. People will always have the need to protect themselves and others if they feel in danger in such settings. Regardless of Neely's arrest record or mental illness, there is also enough context and history given the crimes taken place in the NY subway system to make one have instant reaction of self defense. While I think 911 or emergency services button should have also been called, no knows how the panic sets within a span of minutes. On a side note, the MTA "staff" are almost non existent when this should be the opposite, especially with a such a large subway network and massive number of riders, to manage the entering and exiting of people. I have not once been checked or asked for my ticket on the subway or before stepping in. In the end the question also lies on the system, if they knew he had a violent and criminal record, why would they let Neely roam the subway, why would they not instead help him get treatment and rehabilitation instead?

This case would make an interesting study on philosophy/morality/psychology and justice. There were ppl on that subway scared enough to join him. No one stopped him. Respectfully going to correct you: - The victim did not approach anyone or make threats in anyway. In fact he was yelling about having nothing to eat or drink and being in need of necessities - The 3 people were together on an empty cart and intentionally committed this atrocious act as he was already limp and 2 of the men can be seen purposely moving his wrists and arms to make it appear he was fighting back. I'm getting really sick and tired of the naivety in these comments and lack of any analysis skills.

neely was a criminal who enjoyed seriously injuring others. neely was going to get himself killed one way or another by someone no matter what.

Neally was literally on a top 50 list in New York (suprise surprise it wasn't the honor roll) about 50 criminal charges, he was supposed to be in a mental hospital at the time and had a warrant out for his arrest. Plus there are literal reddit posts that date back 10 years that talk about how dangerous he was. His death was accidental not murder, as soon as he passed out from the chock hold which is used in every martial arts class even for teens, the marine put him in a recovery position and stopped restraining him and waited for police and medical.

Don’t apply chokes if you don’t have this knowledge and don’t let your adrenaline overcome your ability to count seconds and notice the body going limp. When a professional mma fight is won with a rear pull back choke. Why do you think the professional referee stops the fight within seconds. The ref sees the body go limp and the fighter is unconscious. There isn’t going to be a professional ref to tell you to release the choke he’s unconscious in a street altercation. If you don’t have the discipline to count seconds or notice the body going limp under pressure, then don’t use the choke to subdue people. You can’t bring them back once they’re dead. Why do you think most or all states don’t teach choke holds to their police officers anymore? Not all policemen possess the ability for use of choke so none of them are taught the choke anymore. Seems America needs professional mma fighters to host town hall meetings in every state, televised over and over until the public understands the rear pull back choke is broken down so people shouldn’t use it unless you’re in a professional fight with a professional ref.

I take no sides. I have a nephew who is a marine. He says any marine knows that when the carotid artery stops thumping, the person is done. A restrain is a "nelson" , a "rear naked choke", is a submission. Tense moments on a train, violent person spouting off and promising pain just before they defecate in public, yea I see it every day I live in San Francisco, you have to be cautious and ones survival instinct becomes keen. Is this Murder? No. Involuntary manslaughter yes, but you can't refute the fact 2 other strays were also holding dudes arms and legs and who knows what else... so you can't pin it on the leatherkneck. This is a tragedy and a call for some type of security reform to our transit systems in cities that suffer from this ongoing crisis.

Why is there a mentally unstable man with 40+ arrests on a subway unsupervised?

It shouldnt matter he killed the guy from what he did and the bottom line is , if a person is allowed to get away with this then what door opens for future incidents like this to happen. Is it a lot different if he would of had a giun and shot him. He could have the same defence is that he thought he was a threat to people . Lawyers and the law are so corrupt.
