Attorneys have called for a change to the Tennessee sex offender registry. They say it has created an unconstitutional punishment as legislators added more restrictions each year.
Exactly!!!!! Our world is so sexualized and pushed in our faces and all the trafficking of women and children yet the average person is almost crucified for doing much less and even non violent crimes in all intents and purposes for life. Laws must change!!!
Because we haven't been taught to be scared of murderers. We also mistakenly believe that people who commit murder only do it once. Also we've been conditioned to believe that a sex offender is worse than a murderer.
@ JoseRamirez-wv3pl for the same reason sex offenders are made to register - so that we can stay away from you and be safe. don't wanna get murdered so this seems to makes sense. problem is it doesn't work like that.
Agree. My son was so frightened for a non violent non touching offense he took the first plea deal they offered but did not understand he would be on a registry for 15 yrs but turned out to be 25. It’s ruined his chance of decent steady jobs to make a living and places to live. Unfair and wrong!!! Heart goes out to all wrongfully charged or light charges but paying the price of a violent rapist.
Forgiveness is the one thing people want for themselves but not for others.........everyone deserves a second chance and this system is not set up for success but failure..........any other felon would not have these restrictions. Murders, drug dealers, theives and other felons do not have these restrictions on them. Obviously no one is for the harming of anyone under any circumstance, however the registry puts lifetime sentencing on limited sentence rulings, i.e. a 20 year maximum sentence but have lifetime punishment. That is unconstitutional and wrong. The registry does not protect society, it creates a never ending revenue, propaganda, and incarceration cycle.
It puts innocent people at risk too. When vigilantes target people on the registry, sometimes they accidentally claim the life of someone else who lives in the home, or someone else driving the car that's owned by the offender. Murder is never okay. Murderous vigilantes are just as bad as the offender they go after.
The truth is that the nationwide recitavism rate (RE-OFFENDING) rate is lower than 13%. Politicians who lie about statistics and claim 90% recitavism, like to lump technical violations, and future non-sexual offenses as recitavism. Almost ALL sex offenders do not ever commit another crime, not only because the counseling is proven to work and be effective, but because the punishments are so harsh that they cause the appropriate response in the offender - a change in their life. Unfortunately, the laws in place are more and more unconstitutional. I am not defending sex offenders, some of these people have done some heinous things, but what i do know is that in order to truly make amends for what they've done, they must become productive members of society. Pay their fair share of taxes, try to make something productive of themselves and never re-offend. This is how they can make amends. Some of these people have family members that love them very much. Many of them are valued by their families and loved ones. I truly believe in forgiveness. But do not shame anyone that hasn't arrived at a place where they can forgive. (Do not play who's-trauma-is-bigger) this only creates more trauma. What is most important in life is compassion and gratitude. These two things will take you far in life. Bless you all.
ENOUGH IS ENOUGH , PEOPLE DESWRVE TO LIVE , THIS PUTS URDEN ON THE PEOPLE WHO LOVE THESE INDIVIDUALS , SUCH AS FAMILY MEMBERS AND SIGNIFICANT OTHERS. I MEAN AFTER 20 YEARS OF AN OLD CONVICTION THIS IS JUST UNCONSTITUTIONAL .
The fact anyone is hating shows how ignorant you really are . It is a money scheme By our government nothing more. The fact that other human beings don't want other human beings to have basic human rights and be treated like a person is sad and I say f*** you to all y'all that are against people that are on the list having their rights restored and their life had dignity given back to them after they've served their damn sentence
I had a girl lie on me. My dumbass took a plea. And my conditions were that ill take a plea as long as I DID NOT have to register!!!! It was all agreed upon the conditions!! Then they came back to me and said I have to register for life!! AND NOW!! They tell me that's because the "judge"" D.A" AND my so called court appointed attorney. Must not have known the law. I'm now going for a retrial...
I presume that American planning laws now require there to be economic zones with homes but with no schools, parks, or any child related premises, otherwise sex offender laws would be nonsensical.
oh not at all. sex offenders are not afforded the same rights and the gov't so far has been allowed to enact laws which have the negative consequence of rendering a sex offender homeless.
@@user-uc6xi8sv5u does it really tho? When that registry posts a persons name, address, make model of a car, it doesn’t keep his victims or him safe. No, quite the contrary, when that registry constrains them from getting meaningful housing, meaningful employment, and forming meaningful relationships and friendships after their prison and probation sentences, we effectively exile them from society, and give them nothing to lose, therefore they’ve got no further reason to obey the laws, or care about society. So what’s to stop them from re-offending sexually, or returning to commit crimes that will have long term or permanent damage to society, such as becoming a serial predator or killer, burning down businesses or homes? Nothing. Take Darell Brooks, for instance. He was convicted of Statutory Rape in 2006, when he was in his early to mid 20s with someone 1 year or less under the age of consent, which is kinda creepy but shouldn’t be dealt with in the same manner as a serial predator who targets children, and now he’s serving a life sentence in prison for ramming his car through 60+ people in a parade. 6 of them are never coming back. And those that survived, are maybe going to live the rest of their lives with injuries and trauma from the day they got hit by his car. And for what? But, because society who claims to believe in 2nd chances and rehabilitation, thinks a person who’s committed a sex offense, no matter how petty, is unworthy of life, are unworthy to be human. And we persecute them to the point where they’re gonna say, fuck it, and destroy anything and anyone in their paths. And that’s the collateral damage, politicians don’t want their constituents to know about this registry. After all, if the government or the states, take that convicts rights away, why should they be expected to follow the laws, why should they care if they rob a bank, or vandalize homes, or burn a car or a pharmacy? Why should they care when they have nothing to lose? Sure, they’ll go back to prison, but they won’t care because they’ve already got no job, no relationship, no family left to lose, whereas other “law abiding” citizens will have most so much more. So, unless society decides that now is the time to fully reform or abolish the SOR, then they just have to accept the collateral damage that could come with it. As it is, so society is already crumbling with crime, and division. Again, if they cannot be a meaningful member of society in a good way, then they might as well go against society in bad ways. And we will have no choice but watch society crumble in their hands.
As unconstitutional as the registry may appear check out Wisconsin state statute 301.48 enacted October 2018. The attorney general Brad Schimmel was up for re-election as he passed this through legislation. He lost the following month but this statute is still on the books. I believe violating a person's civil rights is also against the law punishable by incarceration. When people make mistakes they are held accountable. Governments should be no different.
We have Biden today in large part because of those George Floyd riots. Donald Trump would have narrowly won but they are Soo sick of all these Republicans and all this law and order crap gone amuck. Biden has caused more damage than everyone in prison combined. Folks we can't all be a bunch of goody two shoes all our lives. People have begun to notice it. It's time to learn how to forgive and forget with SOME of this stuff.
Tennessee needs to understand that these punitive punishments are wrong and unconstitutional in the criminal justice of law .The registration needs to end unless the case involves a child , or unless it is a second or third offense . This needs to stop , these individuals can not obtain work , a job , a place to live , and then changing rules while on this registry is unconstitutional as well. This needs to end. The sixth circuit Court needs to force the state of Tennesee to change this. Tennesee state needs to stop trying to fight the sixth circuit court , which is a federal court, and they rule over state.
@@user-uc6xi8sv5uPut yourself in a person's same shoe's who wás falsely accused of rape by a girl who did this out of vengeance. And then they decided to place you on a sex offender registry. I guarantee you slick you would have a whole totally different perspective on the sex offender registry than you do now. It's easy for you to be a big proponent for the sex offender registry because you haven't been on the sex offender registry yet for false rape accusations. But until you've walked in a man's very same shoe's who was falsely accused of rape and placed on the sex offender registry, you would be more empathetic about this than you are now. Apparently you don't have any empathy yet because you haven't been placed on a sex offender registry for false rape accusations, urinating in public while being drunk or accidental nudity.
@@user-uc6xi8sv5u More innocent men than guilty men have been placed on the sex offender registry because of false rape accusations or drunken urination in public. And with so many inevitable false rape accusations against men, it's not very hard to end up on the sex offender registry. So let's be more empathetic and look at this at a whole totally different perspective. Put yourself in some man's shoe's who ended up on the sex offender registry because some girl decided to make up a story (out of vengeance and money) that you inappropriately touched her. So are you going to say that you're not a human being too as well? Are you going to claim yourself as a feral beast too?? Are you still going to deny yourself your human rights if the shoe were on the other foot idiot?
@@user-uc6xi8sv5u And just so you know moron not everyone who was placed on the sex offender registry list sex crimes are true. Anyone can be placed on the sex offender registry even if they didn't actually raped, molested or kidnapped a child. All it takes is for a woman to make up a lie that you inappropriately touched her daughter during a divorce custody battle, and your ass will be placed on the sex offender registry. Then come back and tell me if you still think that you or other registered sex offender's don't deserve human rights and aren't humans.
That is Sad when you spend half their life IN PRIOSON And Then SPEND THE REST OF THIER LIFE REGERSTERING AND HAVE THEIR PICTURE POSTED ALL OVER THE PLACE. THAT IS LIKE BEING IN PRISON FOR LIFE! @@NORIEGA200is it life long? At some point even the victim must pick up the pieces and live. I was molested at 5 and it messed me up for decades. But I’m good now.
Now that it's hurting black people they'll do something about it. And terminate the registry like they were supposed to after 10 years if nothing else happened you're automatically supposed to be removed from it. He's entitled to 10 years compensation financially in a major way and since he's black they need to threaten to burn all the cities down until they do something about it and give him a big wheelbarrow full of cash and the lawyer will scoop half of it out to put in the trunk of his Bentley
I totally agree with you. Although I am surprised they are even telling this story knowing how the media is and their need to dramatize everything. Until it hurts someone of color then they consider it. Look the registry is Unconstitutional it needs to be abolished or pulled way back. I have three Sex Offenders who live in my area. All three have been on the registry for an offense that happened years ago (All with minors). I know their offense and I do keep an eye out but I dont think he should be restricted from Housing, Food, Job, Medical care, etc based off of something that happened 20 years in the past. By no means would I allow my child to go to one of their houses by his self. There is a difference between simply knowing they are there and restricting someone's movements even after they served their time and have "Paid their Debt, and are held accountable". I dont care if someone actually committed the offense or not. Abolish it for one based on unconstitutionality then it needs to be abolished for all.
My ex-mother's third husband was a child molester. my ex-mother knew of his past, but said nothing because "God had forgiven him." They were "pillars of their church", volunteered in the church nursery, they thumped their Bibles, prayed their prayers, and sang their hymns. At the age or 78, he molested my niece.
That’s an unfortunate and sad story. You can’t say all will do that though. And the registry didn’t help your niece. Again, I’m sorry that happened. It’s a horrible ordeal to experience.
Yes this is crazy, I was convicted of sexual assault in Houston Tx back in 1982 at the age of 17, moved to Nashville in 1993 and been on the registry since it came out in 2004, this is only a money grab
@@JW-uy2on you really think it saves the public??? 94 percent of sex offenders never reoffend. How about drunk drivers???? They are a threat to all safety, maybe a registry for them???
No sympathy from me. He was accused of rape, pled guilty, and this is what he has to deal with. Rape is a horrible crime and something the victim has to deal with mentally and sometimes physically their entire life. That’s why he needs to deal with his punishment his entire life.
He paid his debt to society in prison and if murderers, drug dealers and other criminals can get a second chance then so should he. The law can’t keep punishing him over and over again for the same crime because that’s unconstitutional and immoral. (My original comment got deleted I guess RU-vid didn’t like what I had to say)
"He was accused" He was not found guilty. He "admitted" to the crime to avoid a trial and a 30 year prison sentence. And if you think a black man was going to get a fair trial way back in 1995 you're delusional. Say he did it, was convicted, served his sentence, how does being on a register three decades later help him? How does it help society? These registers just isolate offenders, make it impossible for them to ever live a normal life. They are forced to live on the periphery, and this existence means a much higher chance of re-offending because of the anger and frustration that isolating brings. Can't get a job. Can't see family. Can't go for a walk in a park. Can't live anywhere. It's not helping anyone.
With the words "SEX OFFENDER" printed in red now required on your passport, all English speaking countries do not allow Americans with that designation entry into their country.
Ok if you’re really innocent why take a plea deal that labels you a sex offender I would have said no freaking way am not taking the deal I would rather die than be labeled something am not and to top it off why did he not bring this up while the other person was still alive
Sign a register, tell the police wherw you live, what car you drive, or do 30 years in prison. That's why he signed it. The Internet wasn't a thing back then.
Horrible, what about the victims who were sexually assaulted? They have to suffer and are damaged the remainder of their lives. Many sexually assaulted victims cannot endure the trauma and commit suicide. We reap what we sow in life. And he is lucky he is not in prison for life.
@@petepet234 1. with CP laws its if you own it not view it idiot 2. I don't see why someone who views and gets pleasure from CP shouldn't be arrested 3. "It's nothing but hateful people wanting others to suffer that's all it is." sorry i hate rapist who ruin people
This is not about the few that “might” act again. This is about PROTECTING communities, women and CHILDREN. In this life you are given some time and choices. Use them both wisely, I do not feel sorry for anyone who does not.
@SimplyAmberJean. This is a crime in itself. These people do their crime and do their time and that should be it. Your closest friend and neighbor and relatives are the biggest concern for your kids safety not a stranger.
I get your reasoning but forcing it into the victim's head that they can never recover is just as cruel as the physical violation. Oprah, Drew Carey and Ellen Degeneres were all violated and all went on to stardom. Victims can achieve greatness with enough love, support and faith. And when the U.S. began punishing offenders post-conviction that crossed a line that may have serious consequences. And it may bring down those who are the biggest supporters of these laws, and their consequences may be well earned.
@@RandomUsername010I agree that victims can recover and heal however saying it’s just as bad the physical violation is plain wrong & becoming successful does not mean the person has healed or recovered from the abuse.
why? because you erroneously believe that all sex offenders are pediophiles, can't control themselves and will keep doing it? Unfortunately none of that is true. You have been decieved and your fears are misplaced.
They should be thankful they're not in prison. The sympathy for violent rapists, as if they're somehow the real victims, is absolutely sickening and just another facet of our misogynistic rape culture.
You had me all the way up to "misogynistic rape culture". I'm betting you're a liberal. Hope you understand it's your side and your side only that wants people to feel sorry for rapists.
Sex offender registry is simply a punitive extension to their life that is unnecessary simply because they have already served their term in prisons and paid their debt to society including their victims. While the SOR has no factual basics or research to backup the claims of safety measurement. In fact research shows there a 5.3% chance of recidivism. Making those who are on the SOR true victims of the Federal government that mandates states to run these programs. Human rights and United Nations have called them violation of human rights and only serves the states for federal funding. Sex offender victims already gotten justices by their time in prison why continue punishing juveniles and youth adults for the rest of their life into their elderly? Also there is no "rape culture". That pretty far fetch statement only the far right political extremism would say in my opinion.
