The plaintiff purchased a stove from the defendant. It broke down within a year, so the plaintiff is suing the defendant for repairs. The defendant claims he repaired the stove for the plaintiff at a discount and doesn’t owe her a dime.

As a land lord, I would not buy any tenant a used stove. A nice new stove would have avoided all of these problems.

Lmao you don't know how much the rent is. The tenant may be paying under market value so, they're gonna get an under market value appliance. On top of that, the majority of rentals don't come with appliances nowadays, and certainly not new ones, nor warranties She said the tenant tries anything to get out of paying, I'm betting this is more the tenant messing around with the stove then the stove itself

I agree. We too are Landlords and whenever an appliance goes out that we’re responsible for, we always get a new one. We personally like to buy the “floor model”. It may have a small dent or scratch but if it saves us $50-$200 it’s worth it to us. This way it will have the full warranty. One of our apartments was completely remodeled and needed all new appliances, so we bought the floor models. The stainless steel stove had a small scratch on the broiler drawer at the bottom and the fridge had a small dent (looked like a tiny door ding on a car), but we saved $250 on the stove and microwave and $200 on the fridge. Two years later and the tenant destroyed the carpet in the bedroom, so they’re not getting their deposit back, as the carpet was an upgraded carpet. We’ll have to repaint the entire apartment as he was wheelchair bound and scratched the walls and put a small dent in a wall as well.

He makes it sound like he offered her all sorts of things, but did he really? From her testimony, all he did was charge her $103 and got her nowhere. And he’s even claiming that’s part of her warranty! Glad she won!

Loved, loved, loved the plaintiff. She was articulate, polite, tough & most deserving of the return of a portion of her money. The defendant didn't appear to be a bad individual either & so, unfortunately, something that could have been easily remedied outside of court was not.

A used stove ~$103, service charge and potential repair is a FAIR price. Even back in 2016 $100 for a visit was normal. Add to it "Hotpoint" brand, lol. And she didn't take the offer, pfft. Plaintiff trying to get shizz free. She doesn't understand basic math. She "won", ridiculous. Bad decision.

Dang I ran an appliance repair company and sometimes we had used appliances. If we installed a new part and that didn't fix it we diagnosed whether it was a defective part or a control panel problem etc (no charge). regardless... Hot point is made by GE and they have a warranty on defective parts. It's easy to submit a claim and you can reimburse the customer within 2 weeks. Easy problem to resolve and it's frustrating to see him not take care of her. Even if it was a generic new approved part, they have warranty too! I am disappointed in the defendant

When I first heard the intro I thought the plaintiff was going to lose, but after I heard the case it, I'm glad she won her $53.25. The defendant just lost a good customer over $50. Happy New Year Everyone and Judge Milian!

Hot Point stoves are notoriously faulty! My former landlord loved them because they are fairly inexpensive and inexpensive to repair every time they break down.

Clearly the stove was USED and therefore did not have a HOT POINT warranty at that point. So she GETS NOTHING. Ridiculous case.

The plaintiff buys a used appliance and expects it to perform as a new appliance. I feel just like buying a used vehicle or anything used online, it's at your own risk. The defendant went above and beyond to help her, shows he's a great business owner. But I think the plaintiff needs to understand that buying used appliances, used anything, is like the luck of the draw. It may exceed your expectations and perform great or it may be a piece of junk. And that's the chance you take and should accept when buying anything used. I think the defendant was right not to give the plaintiff anything beyond her warranty. I would just lose a customer in this case after I've already done everything to make this situation right.

She needs to just get a home warranty policy cuz it works just like car insurance. Pay ur 35 deductible and if they can't fix they replace. Electricity, plumbing, appliances, etc

My landord had gotten a Hotpoint stove for me that I've had for years. i scrub because grease is not my friend.I have a hole on the left and right side of the top of my stove. It's in need of a replacement top but I'm still using it because it works so great. I honestly think I would hope for a new hotpoint should the new landlord get a new stove for me. If it's not broke, don't replace it. It's damaged but I really love my stove

LOL - she's supposed to win everything she asked for because she's "beautiful"? I thought the ruling was more than fair. She bought a used, low-end stove and then is surprised it developed issues, and if that was a year after purchase, it was outside the warranty period his store offered. She would have been smarter at least buying her tenant a new low-end stove with a manufacturer's warranty and no history of unknown issues. Things unfortunately break, and you're taking a risk when you buy used, low end stuff with no warranty. Yes, you have to pay people when you have them come out and fix your used, broken stuff that's out of warranty - and many of them charge a trip charge just for diagnosis. $50 for that is actually very reasonable. JM regularly rules against people buy used cars when they have problems because "buyer beware", because they assumed the risk. I can only imagine why her tenant doesn't want to pay rent - I bet there are other things are poorly maintained too, because this landlord is clearly cheap and does the absolute bare minimum to get by, and probably doesn't maintain her property very well. This guy gave her the benefit of the doubt and charged her the reduced service fee since he couldn't prove she was outside the used sale warranty period. I had my old dryer repaired and it was like $240. Nothing is free.

Harvey, to the average person, reading a warranty is like reading the Bible -- in Latin and in one sitting. They're intended to be read and understood by lawyers and judges, not customers who have other things to do.

Warranty’s are meant to be read by everyone. The seller, the insurance companies, the buyers, and then lawyers and judges if it comes to that point. Why would you ever get a warranty and just assume that it makes sense after the first page.

This plantiff was only entitled to 53.25. The other 50 dollars was for them going out there. Why should she get that back? None of us other folks get the service fee back. Has nothing to do with race. This should be common knowledge. But we all know you throw logic out the window when you see black folks on this show. Be better this year Adrian.
