I live in New Mexico I just walked in filled a form gave them my ID and 15 mins later I had my glock 19x which was a great experience, no hoops and no stupid restrictions.

If the gov't can look for, find, and use the 4473 to track the ownership of a firearm...that IS registration.

Pretty sure that the only way they can track it is if the gun was in their possession, like if it was dumped at the crime scene. They look and the serial number on the gun, call the gun manufacturer and ask them which dealer said gun was sent, then they go to the dealer, who will then present the 4473. The 4473 info isn't sent to the feds and I'm pretty sure dealers only have to keep a 4473 for like 10 years so after that then the gun is untraceable what so ever

Not only that but the 4473 is only a piece of paper with the person who bought it from said ffl. Who knows how many hands its gone through since the individual bought it from the original gun shop.

Dec. 2015 , here in the grand state of Tennessee, the Metro Fair board of Davidson county (Nashville) has elected to stop gun show at Nashville's Fairgrounds , for the reason stated in this video, horse hockey , it was sickening seeing the smug smiles of the parties involved, but then it was pointed out the legality of the show ban and the legal costs, not to mention the board had taken or allowed the shows to book up to a year in advance, they are not smiling now.

It took a lot of explaining to un-California-izing to explain what was legal in SC to a friend who I took to buy his first gun the other day. Can my wife use this? I can leave the same day? Thanks Mr Moss, nice to meet you! Here in MA, there is an extensive background check for firearms and you need a license to carry which could take months to even get, and even then it could be restricted for target or hunting. Luckily I got No restrictions but I know plenty of people denied their rights as an American. As Eric says , it's horseshit.

In Michigan, 10 years ago when I bought my first handgun I had to get a purchase permit. Today,i went in...in and out in 30 minutes with background check. I did have to register it though.

Bills of sale aren't required so if you lose it no biggie, you never had to have one in the first place. Just say you handed him the gun and he handed you the money, you didn't break any laws

There is nothing stopping the state police from keeping FFL checks recorded. In fact, they already do. Canada just issued an order to dump those records. And if someone tells you "we don't keep anything," you should take that with a grain of salt (like the NSA, DOJ, or Hilary Clinton).

While I see the point, the only sort of "loop hole" at ANY gun show is for private persons to be able to easily obtain a firearm via private sale without a nics check, (which you guys repeatedly said yourself ) regardless of whether or not the seller was being complaint with such individual state law or not. Some state laws require universal checks for ALL sales, private or gun show included, plenty don't for private sales, gun show or not. By that rationale, Gun shows in states don't require checks for private sales CAN be and ARE a loophole. As for any dealer such as yourselves, you're right they're is no loophole because a 4473 is still done, along with state paperwork if a dealer is in a state that requires state paperwork/registration.

Loophole is a silly term guns are easy made. The idea is to make it less convenient and it certainly is less convenient. Gun shows are only every few months and their aren’t a whole lot of private guns there forsale. If your caught with a illegal gun you’ll be charged. U cannot physically stop someone from gaining possession of a gun. It’s legal to make them privately. The idea of a fool proof law prohibiting possession is nonsense. That mindset is silly also a felon can own blackpowder guns , bows etc Theirs no invisible force that can stop someone intent on possessing a gun. Lately in turkey,( I think that’s the country) where all guns are illegal . Police didn’t even have guns! A man home made a very crude bow very crude Home Depot 4hrs crude and killed 8 ppl and injured 32 . ? First person he skewed Was a policeman. Part of the problem was the crowds couldn’t hear anything bows are silent

Any time I buy from or sell to an individual I insist the gun be Transferred through a licensed Dealer, A person with a clean background never has a problem with this, the one that did "ran like a scared rabbit." This is the best way as it helps confirm the gun is not stolen and a "paper trail" is established to prove legal transfer of ownership. Just because 'Jim Bob" looks like "a good ole boy" is not enough to risk a felony or arm a criminal.

See the thing with that is, if I'm buying a gun from a dude, it's because I didn't want the hassle of dealing with the gun store. It has literally nothing to do with background checks or anything like that, anddd (at least in VA) there is an extra fee that I would have to pay to the dealer for us having to go through them. In my opinion what you do is really unnecessary and kind of douchey. If I want a gun from the store, I'll just ya know, go to the fucking gun store.

The only registry active is for restricted firearms like handguns and ar-15s. Non restricted records have been destroyed.nor do you need to register non restricted firearms anymore

I'm an independent who leans to the left, I own many guns of all kinds. I strongly support our 2nd amendment right. My girlfriends dad is a staunch democrat...who owns many many many guns, and strongly support the second amendment. What I don't understand is how all the far left people's voice is overpowering the people on the common sense left. There aren't many people on the left that hate guns honestly. It's a stigma given by the radicals.

I'm sure inheritances could be regulated in a different way than private sales, but even doing a 4473 through an ffl on inheritance firearms would be no hassle. Allowing private sales to anybody fresh out of the loony bin to anybody with a driver's license is totally insane. Gun owners are by and large fine with universal background checks, and private sales should be no exception.

So you are fine with universal background checks. I don't think you realize what you are saying. I hate to break it to you, but in order to enforce such a thing a national firearms registry would have to be created. All of the firearms would have to be registered with the government, otherwise they wouldn't know about private ownership changes. The current NICS system is already having trouble handling the sheer volume of background checks. If we start requiring background checks for all transactions, the load on the NICS is going to triple. There would be a whole lot more delays under the universal system. Also, because all firearms in the United States would have to be registered under the new system, you can bet that confiscation would be not too far behind. After all, we all see it over and over again, registration leads to confiscation.

Drivers license and a receipt? What? Hand over the cash and give the buyer the gun and that is the deal. It is called a private party sale. The buyer has no obligation to reveal his identity by showing a DL.This is Idaho.

When you phone in the FFL background check, do you give the person at the other end of the phone any information as to the make and modle of the gun being purchased ?

Some states have a form of registration. In WA we have a State Application to Transfer Handgun. This form goes to the FFL, LEO and the State Dept of Licensing. It's only required to be filled out by FFL transfers and isn't required for private sales. Any LEO that does an ID check will get a list of all handguns purchased by that person from FFLs.

I actually didn't believe in the "gun show loophole" until I had the chance at one. A man running a booth offered to sell me a 6 shot .357 magnum for $300 with no background check, as long as I paid cash. I thought about it, then I decided to go tell one of the unmarked detectives at the front door to the gun show. All he wanted was $300 cash and he'd hand me the revolver.

Christopher Cordova Actually it is illegal in the county I was in. Not the sale itself being illegal, but selling privately at a gun show without doing a background check. Florida is weird, only illegal in seven counties to my knowledge. In the seven counties if you fail to pass the check, the dealer has to check on the seller. If the seller fails to the dealer just got a free firearm.

Jared Havens It was at the time (Don't know if it still is) illegal in that county. Sales at gun shows require background checks. Florida only has seven counties that still have that law (Could be less by now). The proposed sale was in Volusia county, which requires background checks on *ALL* firearms transactions at a gun show.

Here in New Mexico buying a gun from a pawn store or an ffl dealership we have to fill out one of those w2 forms then the seller calles someone to perform a background check and it can take anywhere from 10 minutes- 6 months to actually walk out the store with the gun.

one of your best videos yet. soooo many people think filling out the 4473 is actually gun registration. and making up your own bill of sale will save you so much hassle.

THANK YOU guys for posting this, so many people don't understand their rights. Every time someone asks me about private sales and "registration" , they look at me as though I'm crazy when I compare it to buying a set of golf clubs privately. So many people count on the media to explain what's right and wrong or legal and illegal it's disturbing. Hopefully this vid will help some of the people who are ignorant as to their 2nd amendment rights understand what their freedoms really are.

To Mr. Moss, Eric and Barry, Hello from Canada! I watch 2-3 of your videos everyday and I thoroughly enjoy them, and I wanted to express my heartfelt THANK YOU for all you do. Eric, you're doing one heck of a job with these videos. I am a citizen of both Canada and the USA, and I love both of my countries. Like you(and TY for your service), I served in Vietnam in the 3/1 USMC. Here in Canada our gun control laws are ultra-strict. I still love shooting, and my question is, Can I purchase a gun, or gun supplies from you online as long as I have my FAL license in Canada. TY and keep up the great work!
