In this video I explain HGV drivers hours and working time directive basics that will keep you legal. these rules can be very complicated so i try to break them down and hopefully easier to understand. this isn't comprehensive but is enough to get you through a working week as a new driver.
I go through maximum daily driving, daily breaks, daily rest, weekly rest and working time directive including daily and weekly driving, working breaks, holiday and night shift health checks.
I'm a Class 1 articulated lorry driver, after becoming bored with 9-5 office work I started my HGV training in December 2015 and received my HGV licence in February 2016 including the certificate of professional competence (CPC) and I can safely say it was a great decision.
I currently work for The Watercress Company delivering fresh watercress around the country in a refrigerated articulated lorry. Every job is different but in these video's I try to give you an insight into my experience as a HGV driver.

Can you put you vehicle on poa at start of shift ?
@Sugartollo

If you're out driving, will you need to stop and switch your Tacho over to restif you're coming close to your 6 hours on the WTD even if you've only been driving for about an hour or so, or, can you stop and rest (taking note of when you've done it) without the need of having to change over your Tacho? Many thanks in Advance @KevTee :)

Hi Kev, just sitting the CPC at the moment, the 90 hour bit at the start of the vid you say if you do 56 hours one week you can only do 34 the following week, which is correct, but you also would have to do only 34 the week before the 56 hour week, remember it’s no more than 90hours in ANY 2 consecutive weeks. Or did I pick that up wrong?

I'm saving this as a reference. I passed my Class 1 this February but haven't worked my first HGV job yet so all the stuff I had to remember for my theory and CPC exams has almost gone out the window so thank you for this vid. I remember that there are more rules but if this covers me then that's fantastic!

As with all laws they make them overly complicated especially when it comes to driving. It should be a lot clearer and simpler than it currently is.
@irVz
@irVz 5 лет назад
Agreed man, i imagine all the confusing laws will make new drivers especially more nervous and make them very anxious when driving, people rushing about to try and get a rest in as quickly as possible and that, hopefully something changes in the future to make things more simpler.

Makes more sense to me now, thanks for doing this video as this is one of the most puzzling aspects of driver training in my opinion. It is not really designed for people to easily understand, I am sure they could simplify the rules for everyone.
@KevTee
@KevTee 7 лет назад
+Martin Capes hi Martin, glad you found it helpful, it's so complicated because it's got to be applied to so many different aspects of driving and accommodate everyone. You will find that once you start driving only half of them will be applicable to you, you quickly get the hang of it once your out on the road and actually putting it into practice 👍

...and drivers in America think the Hours Of Service are complicated. Ours is fairly simple; coming off a 34 hour rest break, we get a fresh clock. We can work 70hrs (driving and on duty not driving combined). Our dailies are, we can work 14 hours a day, but no more than 11 hours can be driving. We must take a 30 min break within the first 8 hours of starting our clock. If we take it too early, if we want to drive the max amount of hours that day, we might have to take another. We also have a bunch of exceptions for certain types of trucking. So I don’t usually log a rest break until 6 hours so I don’t have to stop again. Thanks for these videos. It’s interesting to see how other countries do it.

To a degree it pretty much depends on what aspect of trucking you do as certain trucking jobs will involve different aspects of the tachograph regs etc but as a rule if you work Monday - Friday etc and finish Fri afternoon and start at say 6am Monday etc and have every weekend off your weekly rest takes care of itself because you will always have had more than your weekly required rest etc Plus it gets easier when a driver knows how to read their day eg knowing before they start their shift how busy their day will be and how long certain deliveries take at certain customers etc eg getting to know which customers get drivers tipped quick and which customers keep drivers waiting etc If you allow extra time for each delivery allowing to be kept waiting etc you can plan your breaks easier instead of expecting every delivery to be a quick tip and getting frustrated when kept waiting which creates pressure and stress behind the wheel when trying to make up time etc which is where mistakes happen and infringements will add up with new drivers etc But combining the working time directive with driving time break etc preferred by most But as long as you keep an eye on both driving time and working time directive time most truck driving jobs will have a couple of deliveries before break and a couple of deliveries after break etc which makes it virtually impossible to have driven 4.5hrs within 5.5hours for working time directive break as you would have been on other work doing your checks etc for 15 mins etc so unless you have over 4.5 hours to drive to your first delivery etc you'll usually only do about 3hrs to 3.5hrs driving before you need to start your working time directive break which in this example makes sense to have a 45 min break which covers both breaks and is easier on the brain lol leaving you to relax and listen to the tunes with arm out window lol but only if you know you'll be back at depot within 4.5 hrs etc to allow for refueling vehicle and or washing vehicle and drivers debrief etc all of which in a large companies etc you will no doubt be in queues etc which you will need to have allowed time for during your day as not allowing for these duties in the yard etc can cause infringements when drivers don't allow extra time for these duties and sit looking like a lemon when having to go on break in yard to allow for other work etc Reading your day before you start your working day saves time during the day which is why you'll see drivers having a natter and a couple of coffees before they leave yard as usually they are thinking their day through eg working out how to miss busy road junctions etc which will save much more time than the 10 mins it cost drinking coffee lol Purely my opinion based on my experience with no infringements for quite some time It is always your responsibility to make your self aware of tachograph regs etc and no one else's

Hi Kev, I have started a new job driving Monday - Friday days trunking and start at 6am-2pm, so I spend a lot of time waiting to be unloaded than driving, so what I do is at around 10-30am have a 45min break, So that will wipe the slate clean till 2pm, Hope this is ok as no one has said as yet,! Cheers,
@KevTee
@KevTee 6 лет назад
Hey Dave, yes what you are doing sounds good, your break would actually wipe the slate until you have done 4 1/2 hours driving. If you don't do over 4 1/2 hours driving you would only need 15 mins break before 6 hours working to cover your WTD. Hope that helps 👍

Another useful video. Ref wheel nuts question. We used split breaks on international work. Allowed us to start daily rest on ferry, drive off at other end, then park up to finish rest off. You needed to increase rest by 1 hour and there was a time limit on the movement. We used it quite a lot as many ferry crossings were shorter than the rest period. All this was a long time ago so don't know if this has changed.
@KevTee
@KevTee 6 лет назад
Glad you found it helpful Paul. Yes, there is a ferry mode on the tacho that allows you to do what you've explained, I've not had to use it myself but I'm sure you can interrupt a daily rest to board and depart the ferry for up to an hour but the time must be paid back, or something along them lines.

I think the statutory minimum of 5.6 weeks holidays pa include the 8 days bank holidays (plus the minimum of 20 days pa).
@jackrambo1999
@jackrambo1999 2 года назад
So if u work up to 6 hours on wtd an u take your 15 min break that counts for a driving break aswel so the wtd break will do for both. In other words which ever time limit comes up first wtd/driving time each does for the other so one break only for both.

When you have 9 hour overnight breaks make sure you do not exceed 10 hours driving in the 24 hour period which you can do if you drive 41/2 hrs previous day next morning 41/2hrs then 45min break and drive again for more than 1 hour you will exceed 10 hrs in 24 so beware of rolling days 2nd morning have longer breaks

+Debbie Lucas Hi Debbie and thank you. You are quite correct but consecutive just means 'following each other' there for in your example week 2 and 3 are still consecutive weeks so the terminology is correct. I hope that makes sense. Cheers

I'd just like to fine tune a couple of points. You said that you can reduce your daily rest to 9hrs 3x per week and then anything after that you must take an 11hr off, whilst that is perfectly correct it can however lead to some confusion with new and even some veteran drivers alike. You shouldn't really say it as "9hrs off or 11hrs off", you should in fact phrase it as "you can work a 15hr shift 3x per week but only 13hr shifts for the rest of that week" this is because there are many drivers out there that think it is ok to work a fourth and even fifth 15hr shift as long as they then take an 11hr daily rest, but that is in fact breaking the law as you cannot fit 15 + 11 into a 24hr period that is why it can only either be a 13hr shift with 11hrs off (13+11=24) or a 15hr shift with 9hrs off (15+9=24). Secondly, Regarding the reduced weekly rest periods, they must be paid back 'within' a three week period not necessarily just at the 'end' of a three week period, the reason i bring that up is because you can in fact add on the pay back hours onto the end of any 9hr or 11 hr rest period, it doesn't have to be solely added onto a weekly rest period. So if you had 15hrs off for example twice in your 6 day working week (remembering that at least 9hrs of those need to be within the 24hr period as described in my first point) then you can remove 2x 6hrs which equals 12hrs off of the amount that you need to pay back of your reduced weekly rest hours.

I am a new class 2 driver, could you clarify something please? If you continuously do your 15hr shift x3 and 13hr the rest of the week, won't you be going over your 48 hours average?

The "pay back" time for the reduced weekly rest cannot be split. You can pay the hours back, but it has to be in one time. Either with the weekly rest, or the daily rest.

Hi, with the uk no longer a part of the EU, why dont they change the hours to a more simpler rule like, 10 hrs driving, 13hr total a day, 1 hr break between the 10 driving. 11 hrs sleep/rest every time. Max of 5 day work week. Sound simpler??

Hi For example if I work as a van driver (under 3.5 tonnes) with a company on one night shift starting at 9:30pm and finishing at 4am, then the same day my shift starts at 4pm as a hgv driver with the same company. Would that be alright according to the daily rest period as I would have had 11 hours of rest? Also would I need to note down the working period as a van driver? I would appreciate if you could shed some light. Thanks

Thank you for video. I have question . If I started my work Monday at 3.00am and finish Friday 4.00pm(5days) my employer sold me I can have in Saturday reduced weekly rest 24h and in Sunday morning will be started next week, this is correct? He want do that because he don't have work for Saturday but for Sunday , I don't want work like that because I must calculate my weekly time like 6 periods but better is calculate from 0000 Monday to 0000 Sunday. Can employer required do weekly rest when he don't have job after 2 worked days?

over here it only counts towards a night shift if you work 4hrs or more during the 22-06 hour period.

have a question. POA... I was stuck in a parking site for over 29 hours. My boss forced me to use 24 rest. Should I have used POA instead.? what i have not told you is that the end of the particular week. My tacko stated that I only had 14 hours and 30 mins of drive and work time. What should i have. I did the maths at the 75.30mins. whilst paused in germany. Had to deliver items in the ECO zone where i needed paperwork but none present in the cab. 500 euro fine if caught. furthermore the final drive home would have taken 14 hours with no chance of pausing for traffic or accidents. 1 leave the truck and go home. 2 finish the jobs x2 delivery and run out of time due to 90 hours marker. I am at a los please reply back.

Hi, thanks for valuable video. Just a question , I came across this question in one of the assessment tests , it's regarding daily rest. Have you ever heard anything about "split daily rest"? I know we can reduce daily rest to to nine hours three times a week but this must be something else which did not ring a bell o me ! If you know anything about this "split daily rest" I like to learn too, thanks.
@KevTee
@KevTee 6 лет назад
Yes, you can do a split rest, the first rest period must be at least 3 hours and the second at least 9 hours, meaning 12 hours minimum rest in a 24 hour period. hope that helps 👍

Hi Kev. Just a quick question. If I were to start work at 3:30am and work throughout the day, would I still be subjected to the 10 night working limit?

Callum Barron Most firms opt out of the 00.00-04.00 night worker restrictions by a collective agreement. Check with your operator mate.

I added this to a comment further down, then I thought it may be better posting it directly. Many people don’t understand how holiday accrues or how pay is calculated or that overtime or night rate applies to holiday pay. Holiday is pro rata this means it is worked out by portions of the full time position: If over an average of 12 weeks (or by common practice) you work 5 days at 9 hours you will be entitled to 5.6 weeks at 9 hours per day (5 days worked x9 hours per day x5 whole weeks =225 hours Plus odd 0.6 week which is 0.6x 45 = 27 hours total yearly holiday is 252 hours. If you work 1 day per week you will have a yearly total of 5.6 days holiday this being the same pro rata as the full time worker, both will still have 5.6 weeks holiday. Many companies will try to avoid the common practice rule, this is because you may well be entitled to more holiday. For example you are contracted to work 40 hours per week at a flat rate (remember holiday taken over enhanced payment hours attracts enhanced payment holiday). So you expect 40 hours per week holiday. Let’s say you work 45 hours every week then you will be entitled to 45 hours holiday per week by common practice. If on the other hand you work 35 hours every week perhaps you may not wish to mention common practice!
