Thats seems hard to do figure out

I'm now on my case studies exam and learning as I go, sounds confusing but it probably isn't so hard. Trying to remember all the details. Love the helpful information job 👍

Hi Pete retired now things were always changing, 10hours driving every day legal and for the rest throw tacho card out window some did? After driving more recent was told had to take the 31min break before the 15min break you might want to check that one.Breaks in the cab law says leave if possible but your right to have break in cab your choice, I was asked if on break in driving seat presented no problem.We used to put the tacho on break at anytime leaving cab, covered if forgot, or distribution centre would not allow back to cab, so all situation of a break then safely covered.Long as paid overall attendance all was fine.Life complicated enough good luck.
great vlog as usual as you said keep it simple work mon -fri only which means you will always have your weekends off which means your weekly rest automatically takes care of itself etc eg you dont have to think about making sure to take your weekly rest because if you dont work your weekends youve taken your weekly rest etc i used to combine my 45 min driving time break with working time directive break eg take both breaks at the same time how to take working time directive break and 4.5 hour driving time break of 45 mins at the same time easy 15 mins at yard vehicle checks eg 15 mins other work drive down the road towards your first delivery and pull over and have 15 mins break whilst you grab a paper or a greggs or breakfast roll etc and a bottle of juice for those that dont take food to work etc that way you will have eaten sone food and have something to drink and something to read if you have to park in a layby for your break that has no facilities etc and unless you are doing 4 and a half hours non stop driving etc the chances are youll jave done a couple of deliveries which will usually take approx 15 mins each eg opening curtains or waiting for a forklift etc so at this point youll have had 15 mins other work (vehicle checks) 15 mins (break) 30 mins (other work) at least doing a 2 or 3 deliveries which gives you 45 mins + of other work +15 mins break +4hrs 25 mins or less driving = parked up on break at 5 hrs 25 mins having driven less than 4 hrs 25 mins which means if you take a 32 mins break you have used your earlier 15 mins break and only need to have a 32 min break which resets your driving time and working time at the same time basically what ever time you start your shift aim to be parked up on break 5 hrs and 25 mins from start of shift for 45 mins and either the 17+32 or 45 min break from 5 hours 25mins from startt of shift the only exception to this principe is if you know you will need to drive 4.5 hours in one go to first delivery etc eg from london to newcastle etc

Pretty sure you not suppose to have a break in a vehicle while being loaded, thats where the POA comes in and if its over 45 minutes you count it as break. I maybe wrong. But when double manning, the person not driving can not take a break in a moving vehicle.
@@leeallen7491 I dont mean that you cant take a break in your vehicle. But you can not take a break while you are being loaded or unloaded as how would you prove you werent on the back strapping or undoing the straps or guiding in the pallets or filling in paperwork. There is no requirement to sit in the passenger seat for a break. You can still work from the passenger seat. Obviously its fine to have a break in your vehicle when your vehicle is not being worked such as in a layby or truck stop or side of the road. But I am sure you are not supposed to do it while being loaded as your break may be interupted.

This is interesting but I have no experience of working with a tacho. What about drivers doing containers? I understand once the doors are open they do nothing to unload and containers are renowned for long unloading times, surely they would be OK to put on break even though they are being unloaded by others?
@@vanontherun2843 You would think that. But there is a lot of unknowns. Such as, you cant continue your break if the RDC is evacuated while being loaded. That counts as other work. Also, pretty sure its an insurance thing too. Not the drivers insurance. I never put it on break while loading or unloading. Main reason being is that it is the drivers responsibility to ensure correct loading no matter who had loaded it. When I was on the wagons running into Tescos and Asdas and such where we were not allowed to remain in the cab and were instructed to wait in the canteen or office and hand your keys in. You're cant have the tacho on break as you are still doing other work as you are directed to wait in a place and are still working when you hand your keys over and paperwork. While you are waiting, you can not just wonder off around the yard or leave the yard for a little walk. When you are on break and or rest. you need to have the ability to freely dispose of your time as you wish without being restricted. I might still be slightly wrong. Only exceptions is if you are on an enforced rest by a police officer or the dvsa. Also, you dont need tacho fitted to be restricted on driving time neither. Do you realise the majority of van drivers on here have to adhere to UK domestic driving and duty time if you do 4 hours or more driving a van per day regardless of the weight limit of the van?
How this for a good one we have a guy that did not use his card for 3 days vosa has picked now it's making its way to the ministry his excuse for not doing manual entry was A I don't know how to. B my daughter nicked it found it in her toy box . The sad thing is he thinks he is gonna get away with it 36hrs driving no card no manual record he is in for a nasty surprise. My company Max's us out every week they do it by the book . personally I've had enough after 29yrs.
