I was told this by a lawyer as he heard this discussed in law school. The Owners owned a large piece of property…around 30 acres. He had a private road that went from a public road to his home & property. The property had belonged to Owners family for many generations. Land behind his property was purchased for a big residential subdivision. It became a HOA. Time passed without issue. Then the HOA approached the Owner. They wished to purchase some of his land to build a road to link to the private driveway which led to a major road. The Owner was astonished & noted the private drive was too narrow for any sort of commercial use. HOA said they were promised that the driveway would be turned into a 2 lane highway. Owner laughed & said no. The the HOA sued under the right of Eminent Domain for their community to have access to the State highway. Owner was able to point out without the new road the HOA community had about a 20 minute drive to reach the highway. Owners attorneys pointed that the planners of the new community knew about the drive time when they purchased the property in the first place. In the end the Court ruled for the Owner. The Owner had scant trust in the HOA. He had multiple trail cameras placed around his property. HOA then built up hiking trails. They began fishing in a river that entirely ran on the Owner’s property and they placed a playground and local park all upon the Owner’s property. Owner sued. The HOA offered excuses & tried to buy the encroached park land from the Owner & the right to continue to hike & fish upon the Owner’s property. This time the Court ruled entirely in favor of the Owner. HOA had to cover all court costs, return the illegal park land to be returned to its previous condition. The Owner received a settlement from the HOA. The Owner donated the entire amount to the County Park system. In the end the County renamed one of their Parks with the Owner’s name. It was also the closest public park to the HOA. Owner continued to support the Park building a public pool, baseball diamonds & basketball courts. With the Owner financial assistance the Park built a multi purpose building used by many groups for many different purposes.
"In matter's of TASTE, the customer is always right." That is the full original saying, meaning you can complain if the chef puts too much salt in your soup, but you can't claim that your whole meal and drinks be comped for the "inconvenience".
The cream story reminded me of another. A woman is working for a Casino in the city where I live. She passes Dunkin Donuts, Tim Horton, and McDonald's, which have a drive-thru. Upon arrival at work, Door-dash delivers her coffee. My father would say, "More money than brains,"
Asking to repeat the last lines of dialogue is a bitch move. Who pays that close of attention to the noise from people who are loud? Why would she bother to memorize the lines when she had no reasonable way to anticipate being quizzed on it. Frankly, buying a home theatre set up like that with a particularly powerful subwoofer is a jerk move. Ive lived in a 3 floor walk up in the middle unit and did a full renovation. I made sure to mitigate the noise disruption to my neighbours, doing the louder jobs while they weren’t home, not working during before 11am on weekends, not starting before 9am weekdays, etc. it really wasn’t too big of a deal, it just took a bit of scheduling.
She's that one who claimed to be able to hear every word and then couldn't even specify what they were watching. There's no noise ordinance in the day time. Get used to it, get over it, or move. Those are your options.
@@johnclaybaugh9536 I may not be able to hear the specifics of a movie dialogue or even an argument through a wall, but it can be really disturbing and annoying when you can hear too much. When you can hear the music, the loud explosions, the yelling- whether it's in a movie or the neighbors. When it's loud enough to that you have to talk over it, turn up the volume to hear your TV uncomfortably so it isn't drowned out by the noise from your neighbor in your own space. Sure it might be allowed by the rules, but considerate neighbors wouldn't do it.
In the first story the OP sounds completely obnoxious. You live in an apartment dude, have some respect for the neighbors. Bass travels through walls more than most people who blast music know.
#1, living in a middle apartment/condo will always be a problem with noise. There are ceiling materials that would muffle sound and reinforcing floors would help. Another suggestion would be to encourage the people on the first floor to also insulate their ceiling with sound proofing. It would sure eliminate a lot of inconvenience and hard feelings.
Regarding taking the child out of state by gf. Per our the courts. Neither my husband nor I could take our kids out of the COUNTY without written permission.
Christmas Gifts: My dad's bother would give us all (4 kids + Mom and Dad) "unusual" gifts....One year we all got a pair of boxing gloves (in the appropriate size for the age). My favorite was when he would buy "junk" (miniature plastic cars, marbles, tiny toys/that came from Cracker Jacks & cereal boxes, super balls, mystic 8-balls, etc..) He would wrap each present and filled brown paper bags with our names on it.
Story 1: The complaints started after you bought that subwoofer. You knew what you were doing. Also, cities have noise ordinances where above a certain desible level noise is illegal. And the laws are written like this for angood reason. Our own military used noise to mentally torture people. So if she gets the noise levels in her condo tested and your subwoofer breaks those noise laws you are in trouble. Some noise in apartment/condo living is expected, but you should try your best not to be a nuisance to your neighbors. Also, I have lived in apartments most of my adult life. I have only moved once because of noise. And my neighbors intentionally drove me out because I complained about noise and they retaliated like you, to drive me out. My walls were vibrating, from 2 neighbors. I took my picture off the walls when they fell from it. Why did I complain? I had a baby and one of my neighbors woke her up with her sterio. When I knocked on her door she had the speakers to her sterio both up against my wall, and she had to turn it down to hear what I was saying it was so loud. When I told her she woke my baby she got angry and told me they took her twins away from her so she didn't care. And she turned her music up even louder. She enlisted the help of my other neighbor in her regime of torture. I went to the apartment manager and they told me they couldn't do anything between day hours. They still didn't care when I told them my walls were vibrating. I even asked them to come to my apartment and stand inside for 5 minutes to see if they could live like that. They refused. I spent a lot of time away from my apartment, got a lawyer and got out of my lease siting the noise levels being inhumane and the managements unwillingness to correct it. It wasn't just inhumane to me, but also to my baby. They were intentionally malicious. After I moved, I found out about noise ordinances. If I had been advised I would have most definitely had them measure the noise and sued for the inhumane noise levels. This type of thing is WRONG to do to others. Don't be that person.
I'm sure crazy Karen will be willing to pay for it... with a court order. which is likely within reason to obtain for deliberate poisoning of the soil.
I hade a neighbourhood didn’t know when to shut the hell up walking loud banging into walls hope he liked my techno on his only weekends off, especially since we dont have a noise ordinance
29:40 Picture-taking private investigator: No bigotry against lesbians here. In the US, this woman cannot marry OR cohabitate and still receive alimony of any kind. She couldn't do this with a boyfriend, either. She is likely trying to have a live-in AND collect alimony/maintenance. Ex has every right to try to nail her for doing it.
The father more likely is trying to get custody of the children. If he were trying to deny her alimony, he would need to prove the women were romantically involved. The private investigator would need to be much more discreet, and "family values" would not be mentioned as his grounds for taking these photos. Because she is already employed as a nurse, the standard of life prior to divorce would have to be significantly different for alimony to ever be considered here. But in regards to custody, he could be trying to argue that the children are being raised in an environment that goes against his cultural or religious practices. It'd be a flimsy and bigoted argument... But if he would go to those lengths to keep them out of a same sex household, he obviously feels strongly and that argument may honestly reflect his motivation. But yeah, as a nurse (near Charleston so tons of work opportunities) there's almost no way alimony was ever a factor. Custody, child support, totally. Alimony, no.
@@twiggygrl84 Nope. An "out" lesbian, cohabitating with another and living like a family? No need to capture pics of them pegging each other. Same as if they were a hetero couple. No chance "gay" would preclude custody. But cohabitating is the same as marriage in ending alimony.
Whatever the father’s reasons are they are irrelevant to the matter of where the investigator was. He was trespassing on private property he needs to find a legal way to prove whatever he is trying to prove.
Actually, the PI is NOT trespassing until an authorized agent of the apartment complex tells him he needs to leave. No, not just a resident. Also, while it's creepy, taking pictures of kids in an open-air park is also 100% legal. If a cop rolls up on him he's not even obligated to give them his name. Confiscation of his camera was a Constitutional violation.
@@twiggygrl84 Looking for bigotry where none is evident. He doesn't have to prove "romantically involved" to end alimony. COHABITATION is the standard and it ends alimony in most jurisdictions, just like remarriage. On the other hand, proving that an ex is in a homosexual relationship does not legally have any effect on custody. The guy has every right to try to prove cohabitation, use of a PI is reasonable...the ex has no right to both cohabitation/remarriage and still collect alimony. Cohabitation or remarriage is NOT by itself grounds to change custody unless the new partner is a molester or druggie, etc
If you knew what kind of weed killer she used then get a picture of her using it on your land. Take a picture of it at the store All Sides of container with caution warnings especially concerning children and pet you could submit it as proof. The caution of "dangerous for children and Pets" prove Deliberate Intent.
The Dad is just looking to dump his 2 younger kids cuz he knows how hard it is to "hook up" with a new woman when he's a single-parent Dad. Selfish AH doesn't deserve anything from his ex or his 2 older kids. Tell the family that if they care so much about the 2 younger kids then they can step in and step up. 2 younger kids need therapy for the emotional manipulation by Dad.
The HOA on private land? Are the land owners a part of the HOA, because why else woul they pay the fines from th HOA? Who was the idiot who signed onto the HOA?
1st story, OP and the 1st floor neighbors are the AH. He blasted his movie and barely turned it down after being asked to. I would be pissed off too if neighbors above me were blasting a movie like its a movie theater and downstairs neighbors blasting music. OP and the 1st floor neighbors don't have any etiquette when it comes ti the noise.
Amy, Hugo, and Ashley need to deal with their problems without involving anyone else in a lie. Hugo should teach his daughter to respect her mom and discipline as necessary. They shouldn't back down either - if Ashley is being unreasonable, then she doesn't deserve to get perks from other family members. It's one thing to think the aunt is cool while mom is regular. It's quite another to be rude to mom. Parents should teach their children manners and personal responsibility. But the aunt could, in fact, help teach Amy by saying that the way she is treating her mom is not acceptable and support the parents in disciplining her. Ashley and her mom may always have tiffs and not agree, but respect of parents and other adults should be required, unless there is a good reason not to - like abuse and such.
Herbicide: since the poison stays in the ground for ages, sue her for the cost to remove the top 2 feet of soil in your backyard to remove the poison. After the soil is replaced you will then have a blank slate to design your backyard to be very pet friendly. Keep in mind that with a clear canvas to design the pet friendly landscape, you will now want to build a new deck and other human friendly renovations. After the soil is replaced, seed it for grass, and leave it dormant for one year as you design and reject, and redesign over and over. Start slow with ideas that can be done in stages and as the budget permits. Good luck.
Hell yes!! I stripped down to my skivvies in Delta in-flight in front of everyone b/c they were trying to force me to wear the purple uniform which i was SEVERELY ALLERGIC TO! I was taken off my trip and given 18 months probation (for my first infraction in 25+ yrs of service) The look on their face was priceless! Totally worth it!
On a bus headed to Ayres rock aka Ularu, 2 texans in front of bus. As we passed thru different cattle stations the driver would name of station, the size. Texans would say for all to hear, they have bigger and better in Texas. Got on everyones nerves. Finally the driver said over the PA. This station was part of the old Victoria Rivers Downs, before the Texans could say anything, he said the VRD, in the 50's was actually bigger than the state of Texas. The silence after that was fantastic and we all smiled.
If family members are going to lie about faux family members, they should tell everyone that they are going to do that. That way, you all can decide if you want to be a party to that or refuse to lie b4 he does. Otherwise, he can go pound sand.
I totally disagree ! the kids are caught in the middle and he's jealous that he might have to share his mom with them , what would he have done if it were his mom who passed ? Mom is only a name to show affection and it could help them feel more involved and should be up to his mom to set the guide lines down not him !
Neighbor who sprayed herbicide on your lawn. Sue her ass off! Her negligence killed your pets. 1st - you already said you liked the weeds; so getting rid of them is obviously damaging your yard just for that. 2nd - She obviously did not read the warnings that come with garden products - the herbicide would say not to use around animals. So, her negligence killed your pets and your tree. 3rd - she trespassed onto your yard without permission. 4th - it'd be great to find out what the herbicide was in case it's illegal - more charges against her.
I sued my upstairs neighbor for putting in a hardwood floor and won. The carpet was part of the sound proofing and the CCRs said that it couldn’t be removed, only replaced with the same or better carpet and pad. The neighbor was forced to remove the floor and replace the carpet and then have a company come in and certify it for noise reduction. The sound company alone cost $5000.
@@johnclaybaugh9536 That's assuming that the story given is the unvarnished truth. There might be a few self-serving "fixes" to a few minor details like that the floor installed was such a vast improvement and caused no problems. I noticed that according to tale, right after doing all that work for no apparent reason of suddenly wanting a new place they move. It didn't sound like they were planning on it or had made those improvements for any other reason than they themselves wanted them. So they spend time and money to upgrade the place to their liking only to move a few months later? IDK possible, sure people are silly like that, but i wouldn't be surprised if part of the reason they might have had to move was due to those upgrades and noise. That it wasn't just the couple below that got annoyed. And that the carpeting had been there for a reason. Sure they might have been lucky in the timing, and even a condo with bad flooring that needed to be redone went for a high price. Or maybe it had nothing to do with it- we only have OP's version of events and what he chooses to tell of them.
I agree with the mother on this in the story that ends around 1:17:05 I had a kid with my ex and his grandfather’s gf on ex’s side almost took our 6 month old to the nieboring state by asking her bf “the grandfather on ex’s side” if she could not asking me or the mother. As soon as I heard I put my foot down telling them if that happened I would report them to the police for child abduction and a few other charges.⭐️💫🌟✨ feel free to use this short story if you want
And just for everyone to know both me and the mother have a disability which is why she decided to ask the grandfather and not the parents but I am 200% in my sons life as a father and do not let people use my disability as an excuse I was raised by a navy father who always pushed me to be above my disability as much as possible.
the first one was clearly an entitled people story, and OP is the entitled one "You can't reite the lines in my movie, it must not Actually be loud enough to be annoying. I'll try harder" some people don deal well with explosions and gunfire during dinner so playing to the letter not intent of the law just make them the AH. they Could have tried to be considerte, but refuse, instead double down on making the neighbors miserable. and gloat over osting them tens of thousands of dollars. I hope their next place has termites and that the government builds a military air strip in their backyard.

@@johnclaybaugh9536 prefer what you want. Im just saying its cramped. 1100 sqft doesnt leave much for 3b2b and im guessing at least a kitchen/living room.
@@boowee637 and yet the norm is 800 - 1400 sq ft. Think about it. Minimalists don't need a lot of room but they still need multiple rooms for the sake of privacy. I'm not saying these people were minimalists, I'm just pointing out that some people don't own much. Amd they outgrew the apartment. Also, overall, not every household uses every bedroom as a bedroom. So the people who build these apartments know that someone will rent them. There's no need to have a huge apartment if it's not actually needed.
