That happened to me as well. It was a phone call during lockdown so I recorded it on my end , I didn't tell them I was doing i it.. When the result came back, it was like they had written it for a different person.. I was so angry that they were so blatantly lieing.

That's why it's all moving to social care adp they started in Scotland in Oct and they have sent me a pack with letters you can tick the letter saying nothings changed and you don't fill out pack or tick box it has changed then you fill in the changes to circumstances form. There moto is dignity respect and fairness but I'm still terrified although I'm suffering badly from a new health condition I was on dla and was awarded for life as one of my problems is lifelong I was born like it and it can't go away so had a car from them since I was 18 I now 43 yeh I'm not going out unless I really have to because of this new illness nobody could but my car has always been me then when I got assessed for pip I got the care side too not highest rate but still made huge difference now as they moved from PIP to adp I'm getting assessed now but they don't bring you in for assessment unless they really need too and it's a change of circumstances form so if nothings changed you just tick box saying nothings changed and send it back They havnt even been getting ppl in for assessment when there new claiments as long as they have proof there on the medication they say they are they can contact your Dr but it costs them 35 pound everytime so I think they might leave that for new claimants but what disgusting is now PIP is leaving too adp you have to tell your main benefits rent reduction housing benefit inland revenue every single benefit you receive as they going to tax it and reduce money of your other benefits because your getting this money if you get it its never been.like that and I don't think it fair but its on every letter it says its coming to England soon and PIP will be totally gone by 25 So more or less if you get it it makes no odds as they going to take off the extra your getting from other benefits so your basically getting nothing different as they did that with my carers money they took the exact amount of carers allowance and deducted it from there universal credit when asked why they said because your getting that in carers she was like but that's the point it's so I can do things and travel there and they said thats not way it works and they always took the exact amount she got from carers and deducted it from the uni credit I think its terrible there not interested in anything but lining there pockets and that was when it was PIP now it's adp and you got to tell ev1 you get slightest benefit from it says this will affect your other benefits. Life sucks😢

It seems be the standard procedure. I imagine they intend to 'weed' people out of the process. It's awful because the people who need it the most are the least able to cope with their games.

What you suppose to use to record a phone call if your on your phone

I use a program called Cube ACR (it's on Google play). It has a second program called called Cube ACR Helper which you might need as well depending on which version of Android you use. It's dead easy to install and whenever you get a call it brings up a button at the same time which you just press and it records. If you are calling, or are called by, a number you have recorded before it automatically starts recording, though you can stop the recording if you want. Recording a phone call is perfectly legal in the UK if it is for personal use and you don't have to tell someone they are being recorded. I record any conversation with officialdom of any kind as you can trust them about as far as you could throw them with your little finger and with your hands tied behind your back .​@@benjithejackhuahuadogvideo2892

​@@benjithejackhuahuadogvideo2892you can install call recording apps. I have one on my phone and EVERY call is recorded i then decide on whether I want to keep that recording or delete it. Don't trust any corporation or business and certainly do not trust any government agency.

I use a Dictaphone to record everything and I put on the application form All verbal communication will be audio recorded. I've being with a couple of people to their assessments, I call them assassinations, even if the person phones up and says they want their assessment recorded they say on the day the equipment isn't here so I've declined to let the assessment go ahead until they get the recorders available. One time a person I was with got a letter saying they had not attended, they contacted me and I emailed them a copy of the recording I had and asked them if they wanted me to send a copy to the DWP as well, they said yes but the DWP still tried to not give the person PIP so I sent a letter saying notice of prosecution and within 72 hours the person was awarded higher rates on both parts.

Yes l was given zero on my pip assessment. The pip assessor lied about my ability to travel on my own. Trivialised my mental health and physical disabilities. The assessors are not fit for purpose.

Never put a phone number or email address on the forms. If they want to contact you let them write to you. At my own assessment they asked why I hadn't included a phone number and I replied they are for friends and family only and the DWP of anyone associated with them isn't on the list!

sadly ive experienced this ,when i applied for pip after they did away with dla and introduced pip ,every thing i told them was twisted and they gave me zero points so i had to appeal against this judgement over the phone , before this i was reciveing middle rate care and the top rate of mobillity allowence after the appeal they gave me the basic rate care and took my top rate mobillity allowence away , i provided them with my full medical history , proof that i was truely disabled plus my doctor had told me i was not fit for work because i have ostioarthritis and there is no cure for it ,i was told it would only worsen over time, sadly i have to go through all this again next year to be re assest, not looking forward to it incase they lie again.

Yes i believe it is just that if you get a fair assessor your more than likely to be awarded PIP but if you get someone a bit tricky then you dont stand a chance ive read most posts on here and i do believe its the luck of the draw what assessor you get? That is the biggest factor in being awarded PIP.

As everyone said informing them you’re recording them is what’s making the difference here in the assessment. Yes you can not inform them, and then prove the assessor was lying and win at tribunal and I suppose get backpay, but the amount of stress you will endure… it’s just not worth it. However, it’s great to know for any other meeting and calls I make and need to record. Thank you.

I wonder if you could say in your request for Mandatory Reconsideration you recorded the call even if you didn’t to help your case?

When you had the phone call (for me it was a pre-call the day before), it was explained to you that THEY would be recording the call. You have every right to request that recording, or in the very least, a transcript of it. (for anyone who doesn't know what a transcript is, A transcript is a typed log of everything that was said on the call, word for word, and is nearly as good as having the recording). You are perfectly within your rights, at ANY stage of your assessment, reconsideration or Tribunal to request this information. IF they refuse you can demand it under the freedom of information act. At which point they will make up some nonsense about equipment failure and offer you a new assessment. It's an extra faff, Just google it for yourself, how to make a recording, most smartphones (both Android and Iphone) have the functionality to record a call built into the software. the built in functions are not the best, but there are plenty of Apps for this on the play store and the apple store, a lot of which are free. or have a super-small fee. DO IT IN ADVANCE of your call, get yourself prepared. It's up to you if you want to inform the assessor that you are recording the call (this also applies to face to face assessments with a concealed recorder). Under UK law it is perfectly fine and legal to make a recording for your own protection (and yes, protection refers to physical protection of your person or property, but also for the purposes of protecting your rights). For them to make a recording, as they are acting on behalf of an organisation, they are required by law to tell you in advance that they are making a recording. As an individual, the same law does not apply, the way to simplify the understanding of this is to remember the "Rule of 1" when it comes to recordings (video and / or audio). The rule of 1 is simple, AT LEAST 1 participant of the exchange has to be aware of the recording AND as you ARE one of the participants, your awareness of the recording being made, satisfies the criteria. There are arguments to be made both for and against informing them that you are making a recording. On the FOR side, it will, during the assessment stop them being pushy and suggestive, it will stop them trying so hard to trick you into making a statement that is not correct and more importantly stop them from using it against you in their report. It will also have the added benefit, with the knowledge that you have the evidence to prove if they tell any lies, that they MUST write a completely accurate report with no fabrications or inaccuracies. The "against" argument (for those who want to keep the recording covert). Well this comes down to what are your intentions, if it is your intention to get the fastest and most accurate assessment then go with disclose option. BUT for those whose intention is to Expose this obscene behaviour from the assessment service then go with the covert recording. and here is the WARNING, taking this route will both hamper and delay your getting a decision and payment by MONTHS, if not over a YEAR. Both the assessment service and DWP themselves will really get their backs up if you do the covert recording option. Whilst it is perfectly legal practice and you are within your rights to do it. It does not necessarily make it the right way to do things. The other major argument for the covert recording is that you can sometimes come across "Fussy" personnel who will refuse to carry out the assessment if you disclose and insist upon recording it, naturally this also will cause a delay in getting to a conclusion of your application as you will have to wait for a new assessment date. As Charlie repeatedly states, Its your claim and therefore your choice, What I personally do, and is therefore my advice as I have had multiple successes by doing this. Is to declare on the PIP application form, in the box for "extra requirements for face to face assessment" is make it clear in THAT space that for your own protection you will be making your own recording of the Assessment regardless of whether it is a face-to-face or telephone assessment, AND include that you are going to be doing so because it is your right to do so. THAT way they cannot say they were not aware you would be making a recording. But like I say..... Your claim, Your choice, this is only advice. Good Luck to anyone going through the process.

I had my telephone assessment 2 days ago and it really wasn’t as horrible as I thought it was going to be. My assessor was extremely kind and I thanked her at the end for her compassion. We shall see in 2 months if I actually get it! My advice is to have your notes from your original claim in front on you to refer back to and to answer their questions from the perspective of your very worst day. Good luck.

Take them to court i have taken dwp three times and won every time, it is stressful thinking of going to court, but it was such a nice experience the dwp representative sat quietly in a corner. The panel went out of their way to calm me down there was no stress, as my conditions are complicated it took 35 minutes but then they not only warded me everything but put a note on the result that they did not feel there would be any improvement in my situation and suggested no further reviews were needed. I have had no assessment for esa since, but having one soon for pip. I remember the second time i was assessed i asked if i could record, and they said no, my wife secretly recorded and when they said they had lost the recording or it was not clear i advised i had a recording. Quick turnaround by them

There must be an appeal process.

All CAB advisor's are not created equal. some are super good, some are mediocre at best. AND sometimes it just comes down to it being the way DWP operate and have to be pushed to a full appeal and tribunal before they award what a person is truly entitled to. Keep pushing and Good Luck.

It is worth it, take it from a Fibro sufferer, just make sure you put an app on your phone to record the call, well in advance of the date of the call AND make sure you practice using it (get a friend or family member to call you and practice making a recording, practice knowing how to store it, practice how to play it back, and for the love of jebus make a backup of the recording). You will most likely get a call the day before to check all is well for the call to go ahead. It is up to you if you want to tell them you are going to make a recording (personally I would and DO but its your choice you are within your rights to make a recording AND also within your rights to make a covert recording). I am terrified from rejection, humiliation , rudeness(, feeling guilty because I can’t find the thoughts-words often to speak, those feelings that caused my sickness after I have been abused multiple times as a child. Do they do all assessments over the phone now or do they still do in person.. Recording phone conversation is easy just start windows or android or ios voice recorder, have it close to your phone which you put onto speaker. remember to save the recording as "pip assessment with date and time in name".

Keep your head on straight and in the game.... better than 98% chance the Tribunal will overturn the DWP decision and force them to start paying you AND backdate the award level as far back as your initial date of application (no matter how long ago that was). I agree as i was awarded PIP after a fair assessment with an assessor who showed discretion professionalism and empathy.

If the claim, appeal or Tribunal proceedings are still active, then it is not too late to follow Charlie's advice and make a difference to the outcome. Good Luck

Follow the appeal process, both Ehlers Danlos Syndrome and the Hypermobility variant of EDS are severely debilitating conditions that *should score enough points for a full claim (even without a full diagnosis). If it gets as far as Tribunal the decision will likely be overturned and the claim awarded. It does help if you are on medication to control the symptoms and have discussed those symptoms with your G.P. to get it on your medical file as this will be submitted to DWP so they can see you are being treated for the symptoms even if you don't have diagnosis. ​@@Garuthiusthank you, I came on here looking for this as I have hEDS. I have had it all my life but symptoms are much worse now that I am over 60. Having been refused a claim for Crohn's Disease during my 30s, I wasn't sure if the rigmarole was worth it. I will give it a go now as it is affecting my ability to work. 😊

One of my close friends has EDS and she has full PIP and a car! Make sure to appeal!

Best advice here is to make sure you practice practice practice making recordings, saving them, backing them up, and playing them back... do this BEFORE the time comes when you need to do it for an assessment. Fail to prepare and you Prepare to fail. With or without apps any smartphone can be used for the purpose of making both audio and video recordings... (obviously apps, even some of the free ones make the task a lot easier to manage) Good Luck

@@jojosharp5872 I used the voice memo app that automatically comes on iPhones. Just make sure you’re doing it on a phone that has storage, because it’ll be a long recording. I had to use a family members phone as I’m a bit low on storage, and I didn’t want to risk relying on their recording. Do make sure you ask them to record it on their end too, so that they’re aware that it’s being recorded (I feel like they’re more likely to be honest in their report) :)
