Here's the thing: Exhibit B is a bad thing that if true could end up being a huge lawsuit, but like Sweat said in the last video, they made cheats for use offline...in a game that can only be played online.

Like sweat said here, that's their ONLY ground they have to stand on and they're really grasping at straws and hoping to god that the jury and judge don't have a single CLUE as to what all of this coding non-sense means. If they did infact make cheats to be used OFFLINE. then yes, they're in big trouble, because you can't play Destiny AT ALL offline. There is no single-player mode and it's not like Apex Legends where you can hop onto an older patch and play quests n' shit offline, nope, can't do that.

I don't think Exhibit B will lead to anything other than screwing over the retard company even more. I'm not a computer guy, but those files all sounded like things that would either set off the anticheat and get logged, or inject themselves into the game in a way that literally just sends them to Bungie. It all seemed like a bunch of crap to try and derail lawyers/judge/others who likely don't have the programming knowledge to understand what it means. And lying or being inept enough to not know that you're sending the files yourself seems exactly like something some brainless shitter cheat developers would do

Homer is a sports term I hear the most in Hockey. It means you always come out on the side of your team and will support outlandish and even repulsive/dirty/illegal or malicious behavior that your team does by explaining it away and making either justifications for it, blame shifting away from your team for the incident, or just saying it never happened. “A Boston fan showed his deep homerism by saying Zdeno Chara never did anything dirty in his career and is a clean player.”

But a guy that big is bound to hurt someone at some point in this sport I played hockey too so I hope you don’t think I’m just talking out of my ass. Please don’t bring up the MP Montreal incident if you’re gonna rebut but I’m open to other examples to prove me wrong cuz I’m not a close minded dick either. But the MP Montreal incident was in no way shape or form a targeted hit to his head. That was just textbook wrong place wrong time. I had a career altering head injury in 8th grade due to similar circumstances and I mean I was hit straight up from behind but still 10 seconds left in the game we were up by 4 I didn’t need to go to the corner and get the puck. Woulda saved myself a lot of trauma if I just cherry picked the last 10 seconds 😢

They need to read bungies terms of service agreement. It says that it is allowed to scan your computer for anything relevant or related to hacking software, and send it to bungie HQ for examination. So, "Mr.May" had cheating files on his computer, (his secret files) and they got scanned and sent to bungie

Specifically anything that would have been used via injection into the Destiny 2 software and therefore been a part of the client that connects to their servers. The other thing is that the claim cannot prove that Bungie HQ actually obtained copies of any of the alleged files, only their names, which I think were specified to show that Mr. May is involved not only by creation and distribution, but also personal usage.

@@Eggsalad5 That may be explained by the beta testing they had battleeye on before fully initialising the whole "hey, our anticheat does this now" It may have occurred during that stage because I do recall bungie saying there switching anticheat after leaving Activision and thus lost their anticheat program, initialising an anticheat, activating and adjusting it, _and then telling the public and changing the TOS_ may be the issue in this case If so, technical flook in which battleeye started snagging data too early

Those files are scanned by Battleeye and is common behavior for anti-cheat software. It would be like complaining that your anti-virus software scanned your files and made a log. It is something you sign away the rights to when you agree to use Battleeye and play Destiny 2.

That's true but the basis of the countersuit is that Bungie's TOS did not include a clause granting this access and was changed later. CheatJunkies is claiming bungie accessed their files during a time period before their TOS was changed. I don't know how true this is but that's what they are claiming.

The one thing I still don't get is that in Bungie's "Limited Software License Agreement" it basically says that BattleEye has the ability to scan your entire computer and take anything it finds relevant. Is that not what's happening here (or something similar)? It sounds like dude had cheating software (or software used to make said cheats) on his computer so who's to say it wasn't just scanned and then given directly to Bungie?

@@sawder34 if they have shown court docs for an on going case, one that I'm sure because they are screaming privacy concerns, it hurts them to publicly show private info. That sets a precedent that they make private information public regularly and summarily, then how can their privacy be protected? It is why rappers shut up and don't snitch or pillow talk. Anything you say can be used to your destruction, aka used against you in a court of law.

He's not involved because he's not a part of neither sides. He's a part of the Community, which is not even a 3rd Party - only a Consumer side. If Sweat worked for or with Bungie in any way, then he could be connected to the case. But as it is, he has nothing to do with this.

As a developer that has frequently worked on middleware type software in APIs and webservers, I would assume those logs are just files being run through the Destiny application because they have been injected into the process and would otherwise have never shown up. Don't know if that may actually fall under them fabricating evidence / false claims lol.

​@@fridolinj_de7123 What you commented isn't outside of the realm of possibility, but that access would happen a bit differently. As I see it Battleeye would not actively seek out static files but rather monitor what is running on the low-level (or kernel level), so it wouldn't access anything not in use in the running application (Destiny). A static scan of the filesystem could have been initiated by Destiny, however I would not expect it to jump drives (we see multiple like c: and g:). Scans this deep would cause a noticeable hit in startup time/performance and any player would notice it.

@@andbeav Thanks, so my base statement of "Bungie could, but doesnt access private data" is true, but not scanning everything and just the files interacting with Destiny in the case of BattlEye makes a lot of sense. As there are basically just "cheat.exe" files and folders, this isnt grabbing private data, just cheats BattlEye found and supporting Bungies side ones more.

These records were found though discovery chucklefuck. Battle Eye's TOS explicitly allows it to monitor files stored in ram, your active processes, as well as files stored on your drive.

Bungies end only needs to establish damages. They can do that easily because AJs was profitting from damaging the integrity of the software. The counter suit wont hold in either case.

Basically, Bungie can't be proven guilty on these claims because the files in question either tripped their anti cheat or they were explicitly added to battle eye from another client to then trip the anti cheat. They never accessed the computer

Wondering if they were able to access these files because they were accessing the game, not that Bungie went god mode on the computer and just looked at all the files. Again, if the files (.exe's it looks like) were doing something to the game, the game's anticheat might be able to access these files.

For the cheats to work files have to be injected into the game. I think he is now trying to claim that the files he injected included ‘personal files’. Kinda stupid seeing as your the one who took the files from your personal files and put them in the game (hence injection). He literally handed it over to bungie himself. I think someone else would have noticed by now if Destiny 2 had spyware in it

When I had been looking through the other day, I had missed that CheatEngine is in there. That took this from "This is probably a list of programs which hooked in to Destiny and/or tried to write to the active memory of Destiny" to "This is DEFINITELY a list of programs which hooked in to Destiny and/or tried to write to the active memory of Destiny". I am confident enough with that assessment that as someone who is concerned about computer security, I would be willing to go through the steps required to produce elements for this type of list because I know what is being done.

Cheat Engine 6.8.4 sounds like the actually free and pretty nifty tool for SP games(and only SP). It basically reads the memory for variables in which different game parameters are stored and can change them. Say you have a currency. You get the start value from in gam, say 100. Input that...it does an initial scan you get a list of variables and their memory address IIRC where the value has been found in the game's process. Modify the value back in game(buy something for 3 for example). Go back and change the "nex tvalue" to 97, do another scan, the list narrows down...so on and so forth until you remain with one or two entries. You can then edit the value to say 999999 and depending on the game, it either updates instantly or after another purchase. You can do that for anything really...level, skill points, currency etc. I used it a bit for some replays to unlock stuff faster and try them out. It can also be used as a debugger. IIRC it can basically be used to create those "trainer" programs you get for most games. It's harmless for MP.

With the whole personal files thing, I believe what they did is put their cheats in a secure file then ran the destiny with the cheats, technically accessing those ‘personal’ files (The Cheat engine) while running the game

My guess is their system scans the destiny folder itself and if you have to put the cheats in the games folders their system will most likely find it in there under the idea "tampering with game files." I do not know how most game companies investigate their file integrity but that's how I assume it would work.
