Yea but what if the claimer does not have a channel? I mean when someone CC's a video the channel gets a strike and after 3 they lose their channel but they do not get charged with a crime or penalty so its hard to really go after the false claimers. If its a bigger channel they could try to sue but it would cost a lot to do and it would be a tough fight
What's really sad, those 20 videos had nothing about opinions on the game, they were all videos of the best players in action. I am sure he could file a civil case and sue for lost wages/revenue and then some. He would just have to shop around for a lawyer that would take the case with no upfront cost and be paid with a percentage of the settlement to prevent them from drawing out the case to drain his bank account. That would be the major hurdle in the situation.

Copyright law needs to be amended to protect people that aren't stealing from malicious abusers of it. I don't know what the ideal version of it would be, but at the very least it should either [prevent removal of lawful materials without proper authoritative investigation] or [fast-track disputes so videos are restored and monetized rapidly]. False DMCA claims need to be illegal as well.

Thank you for bringing this to people's attention. I've never heard of this myself personally from this particular company..I've actually played Clash Royale and the like made by them..I've been quit years ago but I will definitely go out of my way to not support them any longer by playing any of their games. Forwarding this to all my friends as well. We need to normalize calling out every company that does slimy stuff like this.
Supercell has always been a SHADY company. The fact they are viewed as mainstream is such a weird concept to me. I worked for them remotely early on and I am shocked they are where they are now.

Current US law forces youtube to take down claimed videos first and ask questions about that later. Quite literally, iirc. Human verification does not help either, effectivly that human verification must somehow determine if video complies to fair use, for example, to determine if claim was in fact legit. But only court can do that. Channel deletion must be absolutely verified with human and should not be automated tho. But the main problem here is the copyright law itself.
@sinner5452 it's not that it's too hard to have human reviewers, it's that it is too expensive. By this point, they know that nobody is going to outright stop using RU-vid forever just because their favorite creator got banned unfairly, so why would they care enough to invest that kind of money?

Just because these things happen, doesn't mean RU-vid wants them to happen. The problem stems from one major factor: People can use bots/AI to copyright strike videos, but RU-vid can't use bots/AI to verify if these claims are correct. The only way to be accurate, is for real human beings to manually check them. So they are WILDLY outgunned. What should happen, is RU-vid should limit the number of copyright claims a given company is allowed to make in a single day. That does have some potential legal ramifications, though. But if handled correctly, it's their best option.

There is a game called KOF: Allstar. Out for 6 years and is now closing. One of the share holders (Netmarble) talked crap about the game before they announced the end of the game. So naturally the community started talking crap to him. He went around and copywrite strike each one of the videos and literally said "don't talk hate to me" the abuse that is happening right now is massive.

There are two issues 1. Copyright infingement bullying cancelling channels for exposing point 2. 2. The team memeber was removed and according to supercell rules all have to agree. That did not happen, thus that team needs to be DQ from thiet last event. But there is favouritism behind the scenes.

@kpNov23 it's a long story but CNN is telling ppl on RU-vid that they can't do live commentary on the debate, which historically has always fallen under fair use. They are doing the same thing fox did.
The whole thing of people discussing things that ultimately doesn't matter, where they are not even part of the "population" involved or that understands it (for example being a RU-vid creator who understands that copyright strike abuse is your livelihood gone overnight), can be seen in so many political discussions. People like to have an opinion on things they don't understand, and when you are one of the affected people it really gets irritating that you become the subject of that discussion to say the least.
If a third party can copy right strike a private citizens personal content/speech then the ONLY answer is to make paid advertisements/sponsorships a federal crime. No one should be allowed to pay another person/company to publicly deceive and/or manipulate the publics opinion regarding anything to do with consumerism.
Supercell used to be known for being super friendly to creators and having great relationships with their players, and being open to criticism. It's just sad to see that all be thrown at the window as they make their once beloved games into unplayable pay to win experiences.

what doesn't seem to be, being bought up is that if the channel is banned he can't just go 'oh well that sucks ill start again', no he wouldn't be allowed to start a new channel, his opportunity to utilise RU-vid for his job is forever gone. a company who doesn't employ him shouldn't be able to do what is in essence is firing him.
The copyright strikes regarding Japan and the nature of that is that Japan has no fair use laws for transformative content when it comes to copyrighted material. It doesn't work the same or as it should for a western/US based company that adheres to fair use.

I'm not a lawyer, but I'm pretty sure that every game developer/publisher can take down videos/streams containing footage of their product because of copyright infringement. The thing is that these companies benefit from videos/streams so they tolerate them, but there is no clear legal situation since no one went to court yet. So yes, streamers/youtubers live with risk. I remember that Atlus took down streams when they showed endgame footage of Persona 5 in 2017. Atlus released guidelines that they would do that beforehand. The issue here is that, from my understanding, only one specific person was targeted which can not be legally allowed.

If someone copyright strikes you, the proof is on you instead of them, for some reason. RU-vid favours everyone but their own creators. And when they do favour their content creators its usually in allowing them to abuse the copright system to destroy small creators. Theres people abusing the copyright system basically everyday.

The problem is that our govt is not being proactive about implementing laws and policies that would bring standard business practices that have been going for hundreds of years in line with online business platforms. This is why you should read the ToS when first logging in to a game. Most have the 'company reserves the right to copyright any of there products that are being used elsewhere' clause. That might not be the right phrasing but most companies have something like that in there ToS

One of the main issues is that most streamers and content creators operate in a grey zone for copyright law. Posting gameplay without critiquing it is technically copyright infringement, it is just that most companies recognize that this provides more value for them than it subtracts and thus don't pursue legal action. Ironically, the opinion videos that the company dislikes are protected under fair use, they are just able to weaponize other gameplay videos on the channel to get it taken down.

The fact the RU-vid allows this to happen is even worse. Just to inform you of how youtube works; I made a cover of a song a few years back from a very know band. Got an email from youtube that basically said, if I don't take down the video they will shut down my channel. Then there are dozens of channels that posts videos ripped from dvds and blu-rays that keep on living without consequences. That's how hypocritical RU-vid is and have been for years.

Over the past 10 to 15 years, ALL game developers have been using youtubers and streamers as free advertisement! If any content creator does not fall in line and say nice things or drive more players to spend, spend, spend in their game, developers lose money. It's no longer about creating games that players will love and continue to play. It's about milking gamers for every penny the gamer has!
As i agree on the punishment arguments, You fail to see another aspect of it. If You generate content You choose the platform and its Your sole responsibility. If its Your income source its even more important to do due diligence on this and choose wisely. By going with YT You accept their terms and You are willingly becoming hostage of their policies and decisions and that are the consequences. No one forced people to chose YT as platform they did it on their own, same goes for accepting the risks of it.

Copyright law is kind of insane. The current structure incentivizes bad behavior, and there's no one to be held accountable unless you have a massive presence and are assigned a representative from RU-vid because it's mostly automated.
As long as the laws dont get the extra "If you abuse or misuse X Law; or you are trying to work around it, you get double the punishment" this shit will always happen. And make punishments dependend on the income the company or person is earning. (Percentage based)
Supercell is trash for doing it but lets be honest, by far the biggest issue here is youtube itself. The copyright strike system is absolutely horrid and there is zero effort spent by a real human to verify the validity of the copyright strike claim before a channel gets nuked. youtube should be harshly punished every time a channel is struck down with no real justification.
