Is Child Support Unconstitutional?
There is a lot of chatter online and on RU-vid about child support being declared unconstitutional. I have researched this and it looks like administrative child support has major constitutional issues, but regular child support from a divorce or a custody case appears to still be constitutionally sound from what my research has turned up so far.
If I find anything else, I will update you guys right away.

Well I just sent all the attorneys in my case a color of law violation form and subpoenas to validate the voluntary contract my husband has with Title IV-D, validation of the debt, lien, the original proof of paternity and surety bonds in the case. The Attorney Bar Association contracts with Child support and all you attorneys get incentives. It's illegal, it's coercion and it's fraud. Period!!!!

Yep I’ve proved it in 2 county courts already and they went to tampering with evidence a witness obstructing Justice and due process and violating there own due process safe guards required by title 4d I’m working on tryna stick it too em it’s for welfare recoupment plus they don’t tell the mothers they are surrendering support rights to the state for receiving services any obligation formed under duress and fraud is absolutely void especially by a fake judge surrogate co ram no judice. You are a living breathing free man or woman one of the people of several states and unconditionally sovereign dont let them change your status to a obligor or a person

Family court has nothing to do with law. If you dive into this stuff, you might get angry lol. Even foreclosures have been ruled illegal IN CASE LAW. A man sued his bank after refusing to leave his home after getting behind on mortgage payments. The court deemed the house as his because the bank put no collateral up for the loan (thats nearly all loans) and didnt suffer any loss. Thats true, our money is created at the time that a credit line is extended.

Idk if it's unconstitutional, but I do know it's unjust. While many people can probably agree that it may have it's place in some cases, the fact that it is setup and established the way it is, (the guidelines), allows for the potential for gross abuse by custodial parents, as well as exploitation, extortion, and setting some people up (many people, actually), to fail. It absolutely needs to be changed in many ways.

I have full sole custodial rights for my son and his mother also completely signed over all rights of him too but OAG charges me every month to pay her support for last 5 years now and apparently nothing can be done if I dont hire attorneys while they provided her with one multiple times which have also added to my debt which accrues interest indefinitely ruins my credit score just to pay government bureaucracies corruption

He’s talking about he’s a lawyer, but how are you a lawyer and not know this is unconstitutional. Of course, he’s working for the system. He’s just the agent working for the bar association which is under the umbrella of the state which is in contract with title 4D collecting agency impersonating the state and the fake judge is nothing but a contractor handing out contempts in warrants, when he have no authority to do so I told him that to his face in the court, and all he did was kick me out they’re fake c court it is not even an article 3 court system their frauds nothing more than a crime family stealing your retirement, and making it theirs, and this is not unconstitutional🤔

Exclusive Equity. These attorneys are soo goofy and confuse things even worse. These attorneys will never discuss Article 1 vs Article 3 courts. Technically these article 1 courts are constitutional under Article 1 section 8 and the commerce clause. We are not artificial corporate fictions in our proper standing, we are private Americans protected by the trust indenture that restricts big gov from encroaching on our inalienable rights to freedom and equality. These attorneys practice “at” Law, because they know lawyers that practice “in” Law are not bound by the crown, the BAR or any other conflict of interest. Child support starts with the equal right to raise one’s own children without a third party intervener period. These attorneys are goofy 🤦🏽‍♂️

Nothing wrong with child support,but allowing these 304s to use as a revenge tool is sick! In California, paternity test are inadmissible if older than 5yrs, that's garbage! Taking the DL is VERY wrong, that's a person ability to work and provide properly. NOT making paternity test mandatory is COMPLETELY unconstitutional & does the child harm mentally and emotionally! They even tell you that what you independently do for your child is a gift (clothes,shoes,trips,games etc..)on top of paying support!!! No!! Stevie Wonder can see the "f*ckery" in this whole set up!!! I'm with child support,but it needs to be changed, like still paying rears even after the child is an adult!!! It should end when the kid is an adult, PERIOD!!!!

It is not, though. That is your child, and it is your responsibility to take care of your children, and if you don't have the child, the least you can do is pay the other parent to help them.

I really thought childsupport was for people who were married and got divorced Paternity test should be ruled as the first step in establishing a childsupport case a lot of guys have been put on childsupport and the child wasnt even there's but the attorney general doesnt care especially if you dont have an attorney to represent you and long as the money comes in they dont care anything about your life

Should be a form saying that both parents agreed to have this child. I dad says no it should be hers. Whenever she say no and takes the plan B or abort the child. It was her choice only 100% of the time.

All the states are reimbursed by the fed for any money spent collecting and facilitating child support. It is within their financial interest to force child support judgements. It's the legal definition of a racket. Look it up.

It's not just men anymore women to. I don't support it at all. I'm on child support. My children have been adopted. The original caregiver put me on child support. Meanwhile the sperm donor is blah blah but get to keeps his SSI. That's why he's not on it.. She isn't the caregiver anymore. Someone else adopted my children.

If the dude was on assistance or making little they shouldn't have defaulted to more than what they had proof of. If he was jobless it shouldn't have been set for more than 25 dollars a month.

This is a load of poo poo! I went through a terrible divorce and was put on Unallocated Support in 2021 after it was repealed in 2018. They don't care. If your the high income parent your going on support. FYI if they decide to put you on a IWO your check is sent to the States department of revenue. In some cases the father may not have a IWO, but guess what they are instructed by the court to send the check the ....guess who the department of revenue. Keep researching you have a long way to go!! Hint fallow the money. That 66% of every dollar collected. Research that and post the results.
