Not true your Honor, I’m a retired P.O., and our department, LAPD, we do not take a police report if it’s damage only. We will give a card with the incident number, not a report number. If there is any complaint of an injury, even a minor complaint of injury, with or without paramedics, a report must be completed at the scene.

Someone rear-ended my car in 2006 and the only damage was a small bumper crack and a broken back-up light. Collision shop estimate: $1,000. In 2006. Sorry defendant, you kiss a bumper better prepare to pucker up a lot of dough!

On a minor damage the cops themselves will absolutely try and talk you out of filing a police report. They don't want to spend hours writing up information on forms if they can get away with it. It's easy to say that you should demand that they do. You're a judge and not as easily intimidated as the rest of the citizenry. About two out of three accident cases on these court shows are because the defendant's insurance lapsed for just that day, or the check was lost in the mail or some such nonsense.

I was hit by a negligent driver and when I called the police, they wouldn't even come to the scene because they asked if anyone was hurt or if there was fluid leaking from the car.... I totally believe the plaintiff. it is well known that police doesn't always do their job or what's right

It's such a shame that we pay for insurance for years and years and years but if we want to make a claim we are afraid of being dropped or the rates will skyrocket even if we have a clean record. What a corporate world we live in. It sucks.

Not true judge- i got in an accident and the officer refused to write a report because he said it was under 1k in damages.

Police don't always do a report in every state or every jurisdiction.

That is not true about the police not writing a police report only if both parties agree. They can come up with reasons not to do more paperwork. And, yet, Judge Milian is acting like they are perfect and always do what she expects them to.

The judge was super annoying on this one. First off, it wasn't an "accident", it was negligence. Second, how dismissive she was about the police not bothering to write a report or even check the insurance information.

The Defendant had a lapse in her insurance and got caught up after the accident. Her insurance company is not going to cover her, and she is a liar.

The police stopped writing reports like 7 years old. These rich judges be out of touch. Judge Mathis too. There was a case where the person said the police came to their house n decided not to help them. He called them a liar n dismissed their case for “perjury “. Smh these are not the officers yall grown up with … they literally dont gaf n pick n choose what they wanna do. I literally had a black eye n asked the police to not let my ex come to my property n they said they just goin to let him “cool off” ans he can return the next day. Keep in mind he didnt live there.

In Ontario/CANADA, they want to INCREASE the amount of damage that is required before police even need to be called for traffic collisions. Let alone whether a report needs to be made! They want you to just have you deal with insurance only. EXCEPT that insurance companies are so CROOKED that they will try to scam you too. I call the cops REGARDLESS.

Just make sure you have insurance, and you'll be fine for the most part as long as you're not driving recklessly or under any influence! Uber and Lyft exist for a reason!!

I live in California and they refuse to write a report up unless there is an injury. My 16 year old son was in an accident and we had him call the police. It was other persons fault and the police refused to do a report.

I was rear-ended in my very first brand-new car back when I stationed at Ft. Sam Houston. To the naked eye, it only looked like a couple of minor scuffs on the bumper, but once it was put on the lift, it was discovered that the undercarriage had been bent, which wasn’t surprising because it was a very hard hit that also caused injury.

A couple of years ago I got rear ended on my way to work as the front car of a 3 car accident on the highway. I was the only one who didn't need a wrecker, but once we got my car to the shop it was deemed to be totalled. Since my car was still running after the accident I drove to work and finished out my shift much to my boss' shock after she heard about the accident. I was able to drive home and even get lunch on the way home. It was only when my dad started it a few days later to take it to the body shop and it gave him trouble starting that we realized that the damage was much more severe than we had realized. The hit damaged the stuff underneath the car. We had originally thought that I just had a destroyed bumper and taillight and stuff like that.

Some areas like mine (baltimore) cops won't even come out for an accident unless you need an ambulance. They tell you they will and just don't.

When the judge says “I don’t get why people get upset over accidents” that just shows you how so far removed some people are from average everyday people in society. If you make a lot of money, you might react more calmly cause you have options to a spare vehicle, no hospital bills, etc. But frankly, people with no insurance shouldn’t be on the road. And you can possibly get hurt or die from accidents. Reality check MaM!

As a former crash investigator for a PD, no, police don't always take crash reports.

Judge doesn't know how every officer behaves. I've had an officer take an accident report over the phone for me because they were too busy to come out. Either way the lady deserved to be paid.

Some times there are lazy police officers who don't want to write a report. Some jurisdictions where if there aren't any injuries involved and all vehicles can be driven away from the accident scene, then no report is taken by the police

The judge is rarely wrong but in this case she is totally wrong about a cop not writing a report. In some areas there is a damage threshold and if there are no injuries and the cop feels the damage is below whatever the threshold is they don’t write a report. I got rear ended years ago and the cop WOULD NOT write a report because he thought there was less than $1500 in damage. As it turns out he was wrong because fixing my car cost over 2k.

Defendant is a liar, & should have spent 10 days in jail. I was pulled over for a headlight out, and my insurance expired 3 days prior. I truly had no idea, I had moved and my mail was all screwed up, I was fined $160.00 and had to appear in ct., no excuses was accepted. The Judge said '' if I was in an accident, I would have done jail time, no previous tickets, no criminal record, and I was 42 yrs old

A woman hit my car and a heavy policeman arrived. While chewing on a donut, he said to contact insurance because they don’t file reports for fender benders and walked away. I believed him at first until I called insurance and realized that he was just lazy.

Judge Milan is wrong! My husband was hit on him motorcycle on the corner of our block in Queens, NY. There was damage to his bike. The cops were called and they came out, looked everything over, verified my husband and the other driver had valid licenses and insurance and they left. We assumed they made a report. Two days later we went to the 107th Precinct to pick up a copy of the report and low and behold....no report was ever made. We had to jump through massive hoops to get the responding officers to actually write up a report...it was finally taken care of 2 months later, after writing to the Chief, blasting and tagging the precinct in SM posts and filing 3 formal complaints. This push that cops ALWAYS write reports is BS and on brand with the judge, she is definitely a cops do no wrong kind of lady!
