Prior’s questions implied the realtor was not competent and didn’t know how to do his job, the realtor undoubtedly felt insulted. Prior tries to put statements into witnesses mouths all the time and The realtor was having none of it. Prior did it to himself.

Insulted the wrong witness hey Prior? Prior is getting everything he deserves. All of his snide comments get to some people. I believe the jury is going to feel the same way. Pretty sure there was a few laughs and smiles even from the Judge. 😂 Wild in the court room.

And I'm not getting the point Prior was trying to make in bringing that up. Like, what did it matter?? Even if Prior had asked the question nicely without making it seem like the realtor had done anything wrong, what was the "gotcha" with that. I also don't get why looking at this property and whether they were going to maybe meet Monday matters beyond that several people could put Chad and Alex at a certain location at a certain time that Sunday (like, he couldn't be burying bodies at that time). But the testimony elicited has gone beyond having an "alibi" for the morning after/of the murder of JJ. It's like he's trying to bring in some other information or implication and I'm left scratching my head.

I totally agree. Look at how he is leaning on the podium completely facing the jurors (NOT THE WITNESS) as he is asking the witness questions. That adds to the witness’s feeling of being talked down to and disrespected.

When he said “Well you own it, how many acres is it?” I literally spit water! The judge said it was factual, but not to consider it. The jurors aren’t going to forget that. 🤣

It is immaterial as to the guilt of Chad Daybell. Now, if it were the prosecutor- landlord, there would be a conflict.

The judge is wrong here. Such question about defense attorney owning the defendants home is 100% relevant to show bias, coercion, duress, undue influence, just like when ask expert witness how much they are paid; or just like asking witnesses if they met with prosecutors b4 testifying and for how long and how many times; just like asking who is paying attorney fees in insurance cases like murdaugh boat crash/murder case or amber turd defamation case or car insurance litigation. TLK must know this...he is a criminal defense attorney

If I were a juror, this witness' statement would be no different than the several statements made by Prior which the judge also asked the jury to ignore. What has stuck with me most is Prior fat shaming the victim which stayed on the record.

I was told it's not unusual for missionaries not to come home for funerals- it's a high demand religion. Also I think he was in Africa, so even if he was coming home, making it in time for a Tuesday funeral would have been a stretch. ( and expensive)

I'd rather he hadn't. He could have blown this trial. It could be brought up in an appeal bc its prejudicial. It could have the opposite affect ppl are thinking bc the witness disrespected the judge first & maybe that pissed the the jury off & now they will discredit the very important information about the manufactured home. They might think he's trying to hide something bc he didn't want to answer the question. Maybe they felt it reflected poorly on the prosecution. The jury doesn't have the same negative emotions towards chad and Prior, they just want to do their job and do it well. I honestly don't know if it's worse if they were happy or upset about it. Happy= possible bias= unfair trial= appeal. Upset= points for Chad. My immediate reaction was disappointment and "Nooooo... don't fall into the trap"

I just found it hilarious that Prior had it thrown back at him like that. The other time I was laughing was when he first replayed Tammy's 911 call but stopped it after the first small section then kept telling the witness Tammy never says gun or rifle. The witness said yes she does later in the call. Prior got his condescending tone on and was asking what he meant and that the call had stopped. The witness was like "yeah, because you stopped it" haha The next day Lindsay Blake played it again and IMO it drew attention to the fact that yes, later in the call she does call it just a gun and said it was like a rifle and that Prior was wrong. I thought that made him look to the jury either super shady playing tricks or like he doesn't know the facts.

I will have to find the video of that! I think part of his defense is to discredit the witness in small ways. Since the realtor stated that they were discussing about the home and such, prior asked him about the acreage. He spends way to much time asking stupid questions which is how he got this witty response 😂. I found it hilarious that he asked a question that he seemed not to know the answer to and it was his property now. I think this will not sway the jury but it may build distrust for the defense because he is asking “trick” questions that have no bearing on the trial.

Oh, I don’t think Prior was wrong, I think he was hoping the witness wouldn’t get it in and that it would slide by. John Pryor knew that 911 call like the back of his hand, in my opinion!

If not for the dedication and speed of the police those children might never have been found. Chad knew exactly where they were and he had a hand in their murder and cover up.

Why was prior even asking. He open the door and there was no apparent point to his questions. If there is a successful appeal or mistrial because of this, Prior intentionally instigated it.

Peter explains what the issue is. Witnesses respond to questions asked, they don't provide something irrelevant to the answer that isn't apart of the case or in evidence.

@@Lotus.Lottie But every lawyer has a vested interest in the outcome of their cases, even if only their reputations. And jurors would quickly deduce, oh that must be how Chad is paying his lawyer. Done. It was funny, snarky, and clearly Prior didn't expect to get his own shit slung back at him. It also clearly painted the witness as hostile. But I just really don't understand the "appellate" issue. If anything, Prior opened that door, by asking random facts about the property that were seemingly irrelevant to the crime. I also think the judge could have gently admonished the witness by saying to please answer the question only with no added commentary. Although, the judge also had to be careful not to discredit the witness since it was a true statement as well. Just my $0.02

...and then to top it off, the "hostile real estate agent" asked the judge if he could sit in the audience as he was leaving the stand. The problem for Prior is he has been going after Law Enforcement witnesses, and they can maintain composure on cross. When you put normal people on the stand, who are not used to being picked apart by Prior, feathers get ruffled. This "hostile real estate agent" feathers got ruffled, and he proved to be not only one of the most effective witnesses so far, but the most memorable one. The GOAT Real Estate Agent!!!

They are ALL supposed to be professional - including witnesses. It has to do with fundamental fairness to both sides and the court, and it has to do with overall courtroom decorum. I’ve seen judges admonish witnesses on the record (think of George Floyd trial and the awful paramedic that testified. She got her butt handed to her by the judge, on the record). However, the attorneys can be animated because they aren’t witnesses, and they need to sway the jury with their impassioned rhetoric. Some judges let it go for a little while, some bring them to sidebar to admonish them, and some go so far as to put it on the record if it’s really bad behavior. There is no rule about being an impassioned advocate for your client, it just needs to be professional and judges have wide latitude on this.

I try to stay away from watching such things because everyone sees things differently and that causes too much division and disharmony. This is a very sad case for all involved. @@paulettekelly1146 let me just clarify - I do think Pryor is a jerk.. he's bullish, sarcastic, and rude. I haven't liked him since the beginning. I do agree with you though - why can't people be kind?! On the flip side, this attorney has a monster task to prove the state wrong and his attitude is probably appealing to a defendant who is fighting for his life. I get that... but I just don't like the guy either.

I guess if I was guilty and didn't want to go away for it sure Prior would be the guy. Takes a special kind of attorney to do what he's doing that's for sure.

I always thought that lawyers are taught ‘never ask a question if you don’t already know the answer’. Prior seems to get caught flatfooted an awful lot.

1) Don't ask any question that you don't know the answer to. 2) Use only yes/no leading questions to cross-examine hostile witnesses, because they will slip in derogatory comments if given the opportunity. Example: "Isn't it true that Chad's house sat on a [80 acre or whatever the acreage was -- don't ask if you don't know] parcel?" or "Chad's house sat on an 80 acre parcel, didn't it?" Not "How many acres was the property that Chad's house was on?"

It opens the door so the jury will think that he was thinking of putting a mobile house over the bodies of the children. Peter didn’t show it but the defence asked him what was required to put up the house. He could have done it himself with the kids and machinery and backhoes. Dug up the backyard where the bodies were destroyed almost all the evidence and laid a concrete slab and then put the house on top and just he only needed the to connect water and electricity. It’s much faster than a regular house. It would have required the police pretty much destroying the house to find the children if they ever found any remains that weren’t destroyed in the process (maybe bone fragments).

If I were a juror, that statement by the realtor would have made me laugh, but wouldn't effect anything to do with guilt or innocence. Prior owning the house was simply a way to be paid.

I agree, I guess I don't even understand where the appellate issue comes in since every jury knows that every defendant has to pay their lawyer unless state appointed. Payment does not equal collusion.

Prior was rude. He insinuated the real estate agent was not doing his job properly two times. Not knowing David had enough money to buy, which you would never do at that stage, not researching houses when they were selling land. He tried to put words in his mouth several times. He asked about acreage several times and tried to say the agent was wrong by repeating the question.

Great job, Real Estate Man! Prior is such a “hick” (change first letter) toward ALL of the witnesses, and it was nice to see an actual grown up respond to Prior’s poor behavior. I LOVED it!

“You own it” was such a 🎤 drop, the realtor wasn’t having Prior’s crap, and I’m here for it! That said, If Prior had questioned witnesses as calmly as he did yesterday, it would be better, but most days he’s so abrasive and condescending, I think it’s harming Chad’s case. Just my nonprofessional opinion as I’m not a lawyer. If I were a juror, I wouldn’t care case wise that Prior is getting paid via the house since the Daybells aren’t made of money. My issues with Prior are more with how he’s badgered and condescended and been just plain rude these last few weeks, as well as how his questions sometimes are redundant and pointless. I think the respectful questioning route is best, but save any aggressive tactics for a witness who isn’t being truthful. I think his rude and meandering wear -em-down strategy throughout isn’t going to sit well with the jurors. Culturally, I think rural Idaho isn’t very different than my native South, and rudeness is very frowned on. We all get he’s got to provide the zealous defense, but I think he could have done so with the strong respectful way, and jurors would be much more ok with him. He doesn’t have a lot to work with here, but aggression IMO is hurting him. Strong doesn’t always mean rude and DGAF attitude. In this type of culture, it means confident yet respectful, being competent, calm and capable, like the school principal and Tammy’s friends were. He needs to say, “exhume,” instead of “dig up,” since he apparently agrees the coroner initially f’ed up. He needs to say, “Your Honor,” instead of “Judge.” Honor indeed is what he is missing, and in this somewhat honor culture, like the south, he is shooting himself in the foot so hard but doesn’t realize it or DGAF.

I loved that the witness responded as he did because he set boundaries on prior that he was having none of his bullying, snarky, disrespectful questions. Everyone else prior cross examined just took his rude statements. Mr. Arnold didn’t. Pure and simple! Prior had asked 2-3 times before about acreage. The witness answered 79 vs 88 acres-who cares anyway! Then Prior brings it up AGAIN! If I’m a juror, I’m glad he stood up to Prior. I wouldn’t focus at all on the current owner of the property.

it is not the role of the witness to set boundaries for the lawyer. the witness is there to answer questions. mostly the YES or NO type. This is done for a reason, and the reason is that just like in this instance, it can provide grounds for an appeal!!!! or mistrial!!!! Just because the lawyer is perceived to be snarky, does not mean that the witness has to match the laver of snarkyness... What is great is to let the jury see a snarky lawyer and let them make their own conclusions based on that as well... It all adds up when it comes to decision time.

When I first heard it I laughed because it was so unexpected, although I already know Prior owns the house. Even if I didn’t know though, I think the fact has zero relevance to the case. It doesn’t aid either side one way or another. It was just nice to hear a witness clap back at Prior.

Watch how Pryor is leaning on the podium FACING THE JURORS (not the realtor) as he cross examined this witness. That body language might have suggested to the witness that he was trying to expose him as incompetent…I can see that! And the realtor didn’t appreciate it. I get it! He was probably thinking, “have enough respect for me to look at me as you ask me questions and stop peppering me with details that are irrelevent…ask me questions related to the case!” That’s what I’ve thought about a lot of Pryor’s very detailed/irrelevant questions to try to discredit the witness.

Not that I've seen. I've been in court a number of times and the attorney always gave the witness the respect of their attention when asking a question. Pryor seems to be playing to the jury and this time got burned.

Honestly, as someone who hasn’t been following every minute of this trial, my initial thought would merely be “oh, he turned over his house as payment to the lawyer.” The judge making the record makes it seem like a bigger deal than it probably is.

it is hard to know what influences our decisions and how we look at the facts... what facts do we consider more relevant etc. I believe that a strong dislike of the lawyer can def influence our decision about a case.

BTW, as an real estate agent myself, we are under a fiduciary obligation not to disclose a client's financial information. I was trained to NOT run financials and credit until a person signs a contract with me to avoid situations exactly like this line of questioning, where I have unprotected information on someone.

I felt the witness started getting tense with Pryor when he was asked did you check if David Warwick could afford the property before meeting him. The witness seemed to take offense to that like Pryor was questioning his ability as an agent or if he was a dummy. After that his back was up. So he was a snake waiting in the grass for an opportunity to point out how dumb Pryor could be.

He was seeking to undermine the experience of the Realtor. The witness did a quick retort that he did not know Warwick, that it was Daybell. May I add that the Realtor didn’t want to work on Sunday, and if Warwick was available on Monday as testified, he would have chosen Monday to show the property. These are sel-employed people, Realtors, who have to weigh their income and lifestyle with regard to making an appointment, and how they will practice their dedication to their faith. He pushed back to a point. Then had to show the property.

​@leehowell329 in my area they ask if the bank has pre-approved us for a limit and/or what our budget is if we are paying cash or financing. But usually if financing is happening the bank or broker does the checks.

I never have gotten… the…. “can you afford this?” vibe from these professionals. I know if you zero in and want to make an offer on a property they like you to be pre-approved for a loan or show proof you have the monies …but not when you are just beginning looking.🙄🙄🙄 The question insulting the realtor’s work ethic and ability was rude. Prior deserved what he got in response.

Lori was sitting in jail. Tylee and JJ hadn't been found yet. If he had been allowed to put a trailer on that Property they may have never been found!! I was rooting around out in a old barn at the back of my property we use as storage. We don’t go back there during the winter if the snow is too deep. I went back there at some point ,making a bunch of noise,because I saw some type of creature had dug a hole under the side of the barn. After stopping around a bit a big hairy groundhog jumped up very mad to be woken up & disturbed! He came running out ready to fight 🤣🤣🤣

My immediate reaction was the witness felt John Pryor was attacking him, so therefore, the witness took the opportunity to zing Pryor back. It did not and does not, affect my decision or judgement of any evidence, already presented. I also think the witness may have felt Pryor was insinuating that the witness could have had knowledge about the deaths and it made the witness furious.

Ive never had to pay for a defense lawyer in any kind of case, but current zillow listed value of the daybell property is 449,000. in 2021 when the deed ws transferred to prior is was 219,000. Plus he is supposedly receiving monthly rent from those daybell family members still living there. Just a thought is he really not being paid?

But, they often use statements and reports from witnesses that would have occurred before the property transfer. So, hopefully, justice can be served. Although, it sounds like Emma had already drunk the KoolAid from the get-go.

A mistrial because of the behavior of a witness? The lawyers have created a storytelling atmosphere and prior and/or the judge can remind the witness to answer the question with a yes or no at anytime. Yes, Prior is a defense attorney representing his client but he speaks as though he is not talking to a jury of regular people. Maybe he is just speaking to an appeals court. I feel sorry for the jurors having to listen to him cross-paint. He is exhausting.

Prior wanted to call out Rob Wood for texting with Melanie Gibb. Prior literally rents a home to one of his future witnesses (Emma). Also, it’s not like JP hasn’t been paid anything by Chad. I appreciate that he really wants off of this case (I would too) but you can cross-examine and point out inconsistencies without the condescension, attitude, etc. Don’t give the jury more reasons to hate your awful client 😂

First thing i did when the witness answered, "You own it you should know" lol. I cracked up and thought, well it is true. A real wise guy! Prior got a jolt from that!😂😅👍

I loved the male prosecution trying not to laugh walking to the bench. I'm going to rewatch again to watch the judge as I forgot about his reaction 😂

I follow Hidden True Crime and she is in court evert day and she said when she looked at the Judge ,she could tell he had a little smirk on his face.

That comment from the realtor was gold. It wouldnt make me as a juror change my mind in any way, it would simply confirm to me that I am not the only one who dislikes the defense attorney.

Also- I was waiting for you to zoom in and show the moment Mr Arnold responded to Prior about the acreage. Did you see the prosecutors mouth drop open? Mine did, too. And RW had to cover his mouth while walking around for the side bar. I knew about that fact before and I was seriously laughing my behind off! Prior has asked questions about the property over and over stating he has been by it “a couple of times”. Can we say a couple hundred times?? 👀 Well, at the very least, we know it’s way more than a couple of times.

First reaction was a bit surprised at the zing lol . 2nd thought; As a juror I'd be wondering why Prior owns it, and why would his lawyer want property where his client had 2 dead kids buried on. The judge back on record to jury "...witness just provided what was, essentially, an unsolicited FACTUAL response to the case..." Definitely highlighted the witness response even more.

So much is weird in this case. The fact some of Chads kids rent the house where there mother was murdered and where a murdered child and young teen were buried. Chads kids cannot face the horror that is their father.

As a juror, I would have been surprised but wouldn't have thought too much about the fact of the lawyer owning the house. I would have assumed Daybell had no cash and had to pay the lawyer for his services with his property.

This is why I could never be a juror....if a judge told me to disregard what I just heard, I'm pretty sure it would become one of the most important things I could not forget.

You asked. If I was a juror i would go home and laugh all weekend. As far as whether Chad was guilty or not, it would not matter one bit. It is just a matter of the realtor standing up to the snarky lawyer. Very funny.

If I were a juror, I would have the exact same thought at that statement as the thought I had when I heard it.- This is a bitter witness and good lawyers get paid.

I thought it was smart how the state questioned the realtor about the requirements to set up a mobile home (foundation, plumbing, etc.) and confirming that CD wanted it done very quickly…the testimony intimated the reason CD was wanting this, while avoiding the no-no of actually asking the realtor his opinion
