That smelled like it was coordinated with the defense. And the defense tried to get the witness killed by telling the whole world his face was in that app.

Having the mask on is a violation of the 6th amendment. You have the right to face your accusers which includes witnesses trying to testify in anonymity. The defense should have let it go through and if he was found guilty appeal to Supreme Court it would have been thrown out and impossible to re-try. A violation of your constitutional rights is as series as the crime they were trying him for. I know people only care about your 1st and 2nd amendment but all of them are equally valid and violating any one of them is as serious as any capital case.

It doesn't mean you need to face your accuser face to face. It means you are in same courtroom in front of a judge and jury so that everyone hears the same tesrimony at the same time and you can question in this situation.

I honestly think jurors shouldn't make comments on ongoing cases including mistrials. This ruins melly's chances of a fair trial.

Rewatch crew tonight Peter. My 11 month old grandson had a 6 hour brain surgery today 😢. But everything was a success 😊, by the beautiful grace of God 🥳🎊🎉🙏!!!! Thank you for going over this. In my head, I thought the state proved their case. But I know many did not. It’s best to mistrial when one juror’s mind was never gonna change. But my heart is going out to the victims’ families. Yes, please continue to cover this. I appreciate all your hard work. You are just a breath of fresh air in the legal world!!

There was a disruptive juror who made a stink about the gang expert, one who said they were struggling financially and wanted to get the trial moving faster, and the one who kept getting sick…hmmm, wonder if it’s this same one who was meant “to cause chaos”? 🤔

1 Juror caused chaos through the whole trial. Complaining about the foreperson, the masked witness, asked for a mistrial within the first few hours, complained about a non existent apple watch. How did she make it on the jury? and could she have been replaced by an alternate after she "shut down" ?

Jurors are chosen at random, if you pay taxes you can be randomly selected to serve. They don’t know who they’re actually picking, they don’t research and do background checks on each juror before trial lol

The jury was definitely compromised I’ll say it , who goes out they way to cause chaos the entire case not just deliberations, I bet my bottom dollar she was the one who had a problem with that mask & asked to see the victims phone stalling out the case she was planted !

Total speculation of course, but after hearing the insight from this juror that wanted to set the record straight, I thought back to the juror that raised the concern about the masked witness. They were pretty combative during questioning from the judge and seemed to be adversarial to the court process. That raised some red flags to me and seems like it could have been a foreshadowing of how she would behave during deliberations. Again, could be completely wrong, but just thought I'd share my thoughts.

I agree. I found the fact that they were SO opposed to the detective to be very bizarre. Weight their testimony less or be more skeptics of the content…but to bring it up like it was brought up was bizarre.

What is the voir dire process in FL like? In Louisiana we have a pretty wide open voir dire where asking any relevant questions are allowed and could result in a reversal if the judge shuts it down improperly.

It might just be a simple case that this juror has an inherent distrust of all law enforcement. There are factions of people like that.

@@sallycinnamon5370 Very true possibility. I married into a family like that. The only one who views LE differently now, is my husband. The rest of his family still think that LE is the devil. Funny how when someone straightens up and gets their life together , how that view changes. The last man who arrested my husband passed away about 6 years ago. We went to his funeral. My husband credits his life to that man. So do I. 🖤 It was that important that he see him off, out of respect and appreciation and even love. BTW- we ran into that man in Walmart 😂😂 about 4 years after my husband and I got clean. He got to shake his hand and tell him thank you. 😊 Anyway, just a random story. I forgot what I was actually commenting about. Lol 😂

Fascinating! I have a few questions: 1. Why were the alternates dismissed before a verdict was reached? Is that a Florida thing? (I could swear this didn’t happen in the Murdaugh trial in SC.) 2. Isn’t it a responsibility of jurors to deliberate? Not to cave to pressure, but to at least continue a dialogue re: evidence, logical inferring, etc. 3. What are you looking for in a potential juror, as far as holding out? I like to think I’d continue to advocate strongly for my individual position…but would be open enough to change my position if presented with evidence/logic I had somehow overlooked in reaching my initial conclusions. I’m really looking forward to the series re: media’s impact on the judicial system. Media has always been a factor IMO; it’s just that the pace/reach has changed in the digital era, and the number of voices acting as media has proliferated with the advent of RU-vid and other social media. Haven’t we heard judges say they cannot deliberate unless everyone is in the room? So the juror pulling people aside to have a private conversation would be improper according to those jury instructions.

i'm remembering how mad that one juror was about the "gang expert" testifying with a mask on and how she sounded irritated with the prosecution and wondering whether she was the juror in question. given the actions of the investigators and the prosecution in this case, i thought it might be likely that a juror would just refuse to convict on principle

I have thought she would cause a hung jury this entire time. Have you ever seen or heard of a juror telling a judge what they think about a decision in the middle of the trial? Wanted to see what played out. I’m not surprised about this.

I was on involuntary manslaughter jury. One woman was a non guilty vote. She was so strong about her vote she got in yelling match, got a bloody nose and an ambulance came to remove her from deliberations. The next day we came back voted again. Finally, a hung jury. I felt so strongly about his guilt - I called the prosecutor and she took all my notes and I told her where I thought the issues were in the case. They re-tried the case and got a conviction. The defendant rolled a 100 plus pond log/stump off a cliff over a public beach and the log landed on a sunbather’s head killing her instantly.

On my hung jury, both sides polled us after. The defendant was guilty AF. We asked the ADA, why didn't you get this witness and that witness to testify. They said they only got the case 3 days prior to the trial. I told the defense attorney, "if I ever commit a felony, I'm calling you. You're good." The defendant fired shots into a closed apartment door with people on the other side who had earlier refused to let him back into a small party. He was ID'd by multiple tenants as the only person walking across a large courtyard immediately after the shots - with a gun in his hand. (Who but the shooter would feel safe to be out in the open like that immediately after shots fired?) It shook my faith in our justice system.

The phone was the main evidence the entire trial on gps and he texted his rapper friend to pick him up after a long walk his defense there is multiple ppl using the phone the Icould email is one of the victims email it all points to him only thing is no witness no dna or weapon so we can say 100 percent he was the shooter but they proved he was there just ddint and couldn't put the weapon in his hands reason they are going so hard for death penalty is rumors he killed a cop they dont got the evidence to charge him

It seems like: if lawyers are showing agreements, treating each others with respect (defense/prosecutors), a great judge, showing a great example, it seems like the jury have an easier job & treat each other with respect. Just thinking of the latest trials I've seen. Like Letechia Stauch, Darrell Brooks, Taylor Schaubuisness etc. Where the teams showed each other respect - DA treated DB with respect in anyway lol. Melly trial was so messy from both sides.

FYI…In the Jodi Arias case, in Maricopa County Arizona, THERE WAS a male “outlier” that swore that he believed in-and could vote for-the death penalty, if the evidence PROVED the heinousness of the crime of literally BUTCHERING her victim Travis! Yet, when it came down to deliberations, he did what that woman did in this trial!! The other jurors believed that he lied in the jury process, specifically in the hopes that he would be chosen to serve…BECAUSE he thought she was “too beautiful”, and “not strong enough to commit such an evil BUTCHERING!” The other jurors also believed he was “crushing” on her, and rumor has it that he was(don’t know if this continues to today)communicating with her by phone, and mail, when she was sentenced to LWOP!!🤬 (I think that Arizona didn’t require a unanimous vote for death penalty at the time!🤷‍♀️😳🤬At least the Arias penalty phase did NOT end in a mistrial…THANK GOD!!😂😂😂

I knew they should have asked for that juror to be taken off. I think that was the mistake that cost the conviction. It was obvious to me that that tour who was triggered by the mask, was just trying to cause chaos.

Peter your channel is sooooo important for future jurors. You are forever showing both sides, letting the evidence play out teaching people that we are innocent until proven guilty, and that’s the great thing about our country. The traditional media convicts people constantly tampering with jury pools. The media in my opinion has always been a problem.

That’s why attorneys get to question jurors before trial, and there’s a big pool of jurors before they chose the 12 plus the 3 alternates

Probably the particular juror asked the question regarding meters/versus yards and UTC confusion. The juror would have had the same opinion without hearing any evidence. What a horrible jury experience. I wouldn’t change the death penalty charge for future trials.

Sounds like the same person I was on a jury with about 25 years ago. She was a tad odd during the week long trial and the instant we began deliberations she emerged as a totally disruptive lunatic! She refused to deliberate and locked herself in the bathroom. She'd sing and dance around jury table. Then! Tap-danced ON the table. (No I'm not making this up) - among other crazy things... (particularly with food) ! The rest of us were serious in our duty and did our best. The bulk of the 3 day deliberation time was spent dealing with the bailiff and judge on how to proceed. As I recall, the judge spoke with each of us. She returned, wrote her 'vote' on a scrap of paper and retreated, singing, to the bathroom. Serving on a jury was (is)an honor and responsibility I took very seriously. It was incomprehensible to me someone could be so disrespectful to the process. It was also one of the most unexpectedly interesting things I'd ever done. (It was a drug trafficking case with lots of expert testimony- handwriting analysis, inter workings of airports, etc…and…. A drug sniffing dog!)

Peter I’ve been very positive it was going to be a mistrial. Remember when that female juror had a problem I think it was with the witness wearing a mask? The judge offered to relieve her of her duties and she backed down QUICKLY. Based on this information, I wonder if she wasn’t a plant or paid off and threatened and or offered the others money of some sort. It’s just women’s intuition but I learned MANY years ago to pay attention to that inner voice.

I said the day of the verdict, I wonder if the prosecution can investigate bank accounts of jurors, I think when a suspect has millions of dollars there is always a chance money can get involved.

On the Danny Masterson trial(first one) a man got on the jury on purpose because his daughter had something to to with Scientology. She told him to lie on the jury questionnaire and he did. At the end when it was a mistrial either the man or the Defense Attorneys thanked the other one, just him. The whole trial is on Growing up in Scientology. The man gave an interview and admitted he "forgot" he used to be a cop because it was so long ago and forgot he was estranged from his son. It is a phone interview so you can listen to it.

@@Uptown_504 they were supposedly his best friends. Why would an innocent best friend drive around for 40 minutes before going to the hospital while there friends are bleeding out. A best friend would have rusted them to the hospital and should by their side

@@Uptown_504his phone pinged that location. The bullet trajectory showed the shots came from his side. Two of the four who was present that night testified had different stories of him getting out the car or not. Only unbiased truths we have is the camera showing him get in that seat. Not to mention that “I did that” text when responding to “are y’all good”

There's actually no evidence that proves he shot them imo.. just bc you think he did doesn't make him guilty. They don't have the gun. They don't have a witness. And they have someone testify saying he got out of the cat and went home. I'm sure that's not true but those are the facts. And that being said that means he's not guilty technically.

It seems odd that they allowed them to continue if they seemed biased since the beginning. My dad got dismissed from jury duty just because he questioned the defense’s testimony. All he literally said was “show us the proof to what you’re saying” and they showed him and others that agreed with him the door. Could the rest of the jurors have complained about that other juror in this case? (YNW)

Don't some states not release alternates until after the deliberation is done? I think that would be smarter. I know I personally couldn't handle a juror saying those things to me. I wouldn't cave but I would beg to be removed. My PTSD would trigger big time. I would feel horrible causing a mistrial. Or they could remove me from deliberation room and record my vote however I decided already, I suppose. I will never be on one anyway due to my disability.

the jury has the final say, if it is all or nothing then it only takes one, and that should be the end of the matter. The jury as well as judging the facts and the law which judges and lawyers do not want the jury to know about but if logic is well thought out then it must be common sense that they the jury judge the law of the case, that is how it was under a common law offence in times gone by even before magna carta.

Oy this brings back a bad memory of being on a hung jury back in the late 90's. I hadn't realized how precarious our system is. You get a couple people on the jury who cannot think critically to save their life, for whatever reason (I'm not saying it's always about intelligence, but sometimes it definitely is) AND are easily swayed by smarter more persuasive people (like a defense attorney), add in some stubbornness, or misogeny (usually old dudes who think women are less than), et voila! Hung. When the evidence could not have been more crystal clear to a person who can think logically.

I’ve said since the day I heard the juror complaining about Danny Polo wearing a mask that this was going to result in a hung jury. There was no way in hell that woman was going to vote for anything other than an acquittal. I feel so bad for the victims families.

So Melly is guilty and Cortlen isn’t? How can they convict one on first degree and not even get testimonies from everyone in the car who were alive or even the other car? I wouldn’t be able to say one is completely solely guilty without hearing the other person in the car testimony, I don’t think it’s fair to pick one and not the other just because he’s famous and his trial is first

I missed the chat but here is my thoughts. Murder 1 or not guilty, per the facts; no 'accident'. The manslaughter guilty votes suggest a compromise between Murder 1 vs Manslaughter was made. In my mind, if you can flop from Murder 1 to manslaughter then you have reasonable doubt. Or; the jurors are completely disregarding their legal obligations.

The bug, huge issue to me is the gat slurs, name calling, screaming of this jurir. You can stick to your convuction, that is fine but you cant speak to orhers in that manner. They shoukd never let the alternates go without a verdixt. That juror shoukd have been dismussed for jurormisconduct!!
