Hong Kong court keeps protestors in prison. Should English judges go along with that?
This was also the judge who advised the Post Office to get another judge removed.

As ever, it all boils down to Blair. Usually ONE criminal justice bill is passed every TEN years. Blair passed FIFTY (that's 500 years worth) all unscrutinised. It is actually technically impossible to be law abiding in the UK and Blair's gift to his beloved legal chums is that THEY-rather than an elected accountable government-can make up the law ;everything is up for a judicial review as Blair has left a trail of ambiguous laws-more muddied by the ECHR which he enshrined in the UK . Going out with your 5 and 6 year old kids/grand kids? Buy them some chips ? A seagull attacks! You swat the bird away! GUESS WHAT???!!! What about peacefully attending protests where a small minority become verbally abusive to the police?...do the peaceful protesters have protection in law or are they guilty by association? As in the recent televised court proceedings on the anti illegal immigration protests. @arfurascii2232 2 месяца назад
If they pleaded guilty (most if not all did) then there was no trial, there was a sentencing hearing. If they pleaded guilty at the first opportunity they would have got a third off their sentence. They would have made statements intended to reduce their sentence (e.g. this is my first offence, I'm normally a law-abiding person, I have dependents or I'm a carer etc). If they did their crime during disorder or riot and they were associated with it or seen to encourage it then they would tend to be treated more severely than if they committed the same offence in more orderly circumstances. If they can show grounds their sentence was manifestly excessive then they can appeal. The procedure depends on whether they were sentenced at magistrates court or Crown Court.

I agree that people should have a right to protest, but should not impose that right on people by damaging art works, blocking roads and generally becoming a nuisance to people just trying to go about their daily lives. If your argument is valid and you present it well, people will agree and change can happen by peaceful means, but if you decide that the only way to get anyone to look at your argument is to break the law, then your argument is clearly too weak to gain any meaningful following. We live in a democracy and so the minority cannot force the majority to follow their beliefs just because they destroy art, block roads and smash windows. We all have a say in the running of this country and no one should have the right to make peoples' lives miserable, that's what politicians are for, so leave it to the professionals and chill out. Just my 2p worth. Have a nice day to everyone, Joe

And the whole problem lies in that "can" and the suggestion that civil rights movements are intrinsically rationally motivated reforms rather than challenges to power. Bentham argued for women's suffrage in 1818. Arguably, you couldn't ask for a weightier advocate, but it took over a century to achieve even partial suffrage, and violence was involved. When some suffragettes were sent to prison for breaking windows, Emmeline Pankhurst noted that male political agitators had resorted to violence to advance their civil rights throughout British history.

Northern Ireland Abortion Services was an exclusion to the right to protest to protect other rights. It shouldn't be used to generally suppress protest. The whole point of protest is that it is disruptive and inconveniences others, that's why it's protected. The only reasons for limiting it are firstly if other offences are committed in the act of protest and even then courts should be the aebiters in each case, or secendly if the protest directly harms other's rights, typically privacy, conscience, and speech.

You would be surprised how many solicitors abandon your case because they don't want to do the work for you to actually defend you properly. I was on legal aid at one point and i had to get a judge to transfer counsel as my solicitor screwed up i had to get my original counsel that moved firms back. Solicitors can and do throw cases if they don't want to work with disabled people out of spite. It happened to me. I love my current solicitors though. I have 5 firms on speed dial for different kinds of litigation of i should ever need them in a professional capacity. All really incredible specialists in their fields. A good solicitor is like gold dust. Once you find one keep them

I used to think the English were a very smart and strong race, and their royalty was the wisest and most respected in the world because of their long history. But with all this mass migration landing on their shores from the Middle Eastern regions and their economic woes and riots in many cities, England has become a basket-case nation of the first order, possibly heading into the history books of failure and oblivion. Unless? Weeping with righteous outrage at this infringement on free expression, the demonstrators overthrew the establishment. There have been several uprisings in England's history. It can be wishful thinking to claim that it won't happen again.
