@LBroili

Not entirely true but not altogether incorrect. The first common interest developments (CIDs) in the U.S. date back to the early 1900s. Some, such as Rancho Santa Fe in San Diego County California were formed under laws that were enacted in the late 1880s! Others such as Forest Hills Gardens in NYC also date to the early 1900s. The Homes Association of Cedar Hills, the oldest HOA in Portland Oregon, and perhaps the largest CID in the state, was incorporated in 1946, and is still very much "alive" to this day. The initial purpose of HOAs has been argued by historians but it is fair to say that a confluence of objectives led to the explosion of HOAs development which began in earnest in the 1960s. Saving money on landscaping and other services may have been touted as a selling point by early developers of such real estate schemes but that was not the primary reason for HOAs to become the predominant form of residential real estate development in every state in the U.S.

Yeah, selling it *might* be the right course of action, but it's impossible to know without more information. Does this guy have 27k in the bank to pay the bill? Does have have 27k in equity in the townhouse? If he has it in equity, it might be worthwhile to sell it for 27k below value with the buyer expecting to pay that 27k. But just telling him to sell it is useless. My advice would be to call a lawyer. A lawyer needs to read through the HOA document and find out what recourse their is for failing to administer properly. Do members have the right to look at the books? Can he hire a forensic accountant to look at the books? These questions need to be answered before the HOA gets a dime.

@dodgeplow
@dodgeplow 3 года назад
Location, location, location. They're usually started by the initial builder/developer. Then it's almost impossible to get rid of them because it takes a super majority of the owners to disband them. They're good if the units are for meant renters (if you're the landlord). It keeps other tenants from discouraging another tenant moving in (like if the grass is overgrown, with trash in the yard, and a car up on jack stands).
