This is the first time hearing about the shotgun, with the truck with the Confederate flags at the birthday party. If you take away the shotgun, there's no crime of any kind. You have a freedom of speech in the United States. States. If you want to have a flag and drive around shouting things at people, as long as you don't actually threaten anyone with violence, there is no crime. They were so stupid for using a shotgun because they could have done everything they were doing legally. I'm not condoning going to a child's birthday party and yelling stuff. I'm just saying it's not illegal

They are prohibited from exiling you from the entire state. A case in Georgia, I believe, a man was allowed only one county he could live in - the judge banished him from all other counties.

The only time contempt of court drags on is if the contempt is refusing to follow a court order - you stay until you do. But that's rare. Such an order might be to a Reporter to disclose their source (has happened). Another might be refusing to testify even if granted immunity. The run of the mill behavior-based contempts like you watched are all shortened to the appropriate small number of days required for the lesson. Beyond that serves no purpose. Akin to "go to your room and stay there until you're ready to apologize to your sister."

Our jails are overpopulated and expensive. It's not uncommon for judges to send or extend a person's punishment, only to rescind or reduce it a short time later. After all why should the public be puni$hed for the criminal's behavior... A day or two makes the same point a week does.

In America deputy sheriff's are security in courtrooms and they can move about and do anything with impunity. They need no permission by the judge to do whatever they please.

They more than not let people out the next day after contempt charges but that kind of charge on your record is really going to discredit you. So they're not getting away with not doing time.

Actually a judge in an American Court is almost a god and can almost do whatever he or she wants. They can easily give anyone in their courtroom time in the country jail. Just for contempt. And they are allowed to give just about any amount of time they want without question. Even if you are just a spectator in the courtroom. Although most judges will give a spectator a warning or two before finding them in contemp depending on the severity of what they do. Like that girls mother laughing at the family of the person her daughter ran down and killed. BTW I totally agree with y'all. That woman who ran down that guy on the motorcycle should have gotten a much longer sentence than only six years. Especially considering in state prison you get quite a bit of time off your sentence with good behavior. She probably didn't do more than two years total.

What i didn't understand about USA lows is that some get life sentence for attempted murder, some actually killed people for whatever reason then they get less sentence like 30 or less, thats bs to me, like the girl who killed a man just because of road rage after following him for long periods of time and then proceed to hit him i guess and killed him, and she only get 6 years because of lack of evidence, but i didn't think it was lack of evidence cause they clearly say she followed him and chace him down yeah there would be evidence in her car and on the bike for sure. But as I say ive seen this types of things many times while some other people attempted murder but get life sentence and some actually kill peoples and dont get life sentence, many of the case i expect them to get more severe sentencess they don't while some minor cases get devastating sentencess. Its very confusing to me....

A number of those clips have had heavy rotation on the internet. I know you all do not have the time for the channel, but there are a number of Zoom episodes of misdemeanor court proceedings and CPS proceedings from around the country--an impact post-Covid. CPS proceedings are grim. Misdemeanor court proceedings are interesting as you do see the one time violators from the frequent flyers versus real psychos. Sometimes, sentencing court can be no cost entertainment--seeing the differences people respond to being sentenced--reflecting a whole lot of their life experiences in general---which actually almost predetermines why they are at that stage in criminal justice. The looney woman who tried to attack the judge--her husband had a protection from abuse order out on her--she was attending a violation hearing. I am thinking her actions directed to the judge indicate his request for relief is on point. I actually thought the judge just took it in stride---she sees a lot of crazy stuff at that court level. That segment of the couple threatening the kids birthday party--it was not just them--it was a convoy of them. Screaming all kinds of vile at little kids and their parents at a birthday party. Pretty sure those kids will remember that event. I appreciated the banning the people from that county. Yes, that is a thing. May not be universally applied--I think there are 10K counties in the states. Where I live that is used on occasion.

There’s an argument, not really sure how I feel about so no attacks on this that and the other ONLY that some researchers are studying the effects of road rage on the brain and if it reduces mental capacity I.E. temporary insanity. I wonder if they used that defense. I’ve had road rage and I can honestly say o didn’t like who I became in that haze but I’m not sure about the association with temporary insanity. That being said; murder has to be proven premeditated and while yes she chased him down with her car it wasn’t clear and they NEVER do go into the culpability factors of the other driver. I.E. how did the crash actually occur? Did she simply distract him or run him off the road? Was it to comp/neg? Any speeding involved, etc. those tiny things matter when going for a murder charge. Manslaughter the crime of killing a human being without malice aforethought, or otherwise in circumstances not. Basically she wanted to be a jerk and likely did not take into account the severity of her actions and didn’t leave the house that day planning to kill him. These two concepts are highly misunderstood because of how people feel but the law isn’t subjective. It either falls within the boundary of it or it doesn’t. It’s why so many cases where conviction of manslaughter was likely they go for murder due to the longer jail time and LOSE. I feel awful for the family

And honestly, I find emotional judgements dished out when you literally know almost nothing about the case cringe af.

Honestly I was shocked to hear that after watching true crime videos Dave wouldn’t know that lol I’m like nahhhh I sit watch a lot of crime videos and it’s truly how I started getting a grasp of the law. Truly though murder and manslaughter are so misunderstood but that’s why many aren’t lawyers or judges and sidebar commentators and we can correct their misconceptions….maybe 😂 you’re spot on with the emotional justice vs what is the law.

@@binxbolling not at all complicated. Freedom of speech is a protected Amendment that the judge clearly overlooked based on feelings. Just because they drove by with Confederate flags on their vehicle does not mean they were harassing. But let's say they were for the sake of argument. Last time I checked streets are public and once again I'm going to bring this right back up, the first amendment protects everything except for hate speech which they did not use because they were not charged with.
